Performance Work Statement For Laboratory Gas Services
PART 1
General Information
Description of Services/Introduction:
The contractor shall provide bulk quantities of high-quality gasses and commodities to OTC.
Background:
The contractor shall assist the OTC in its programs for carrying out the Agency’s statutory responsibilities and other obligations.
Objectives:
This contract covers activities in the areas of industrial hygiene chemistry and its mission.
Scope:
The contractor shall provide the required gasses to accomplish the tasks defined in Part 5 no more than 3 days from the date of award.
Period of Performance:
The period of performance will be one 12-month Base Period and four 12-month option periods beginning on 9-15-2024.
The Government reserves the right to extend the term of this contract at the prices set forth in Section B in accordance with the terms and conditions contained in clause 52.217-9 entitled, “Option to Extend the Term of the Contract”.
General Information Quality Control:
The contractor shall develop and maintain an effective quality control program to ensure services are performed in accordance with this PWS. The contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The contractor’s quality control program is the means by which he assures himself that his work complies with the requirement of the contract. As a minimum, the contractor shall develop quality control procedures that address the areas identified in Technical Exhibit 1, “Performance Requirements Summary”. After acceptance of the quality control plan the contractor shall receive the contracting officer’s acceptance in writing of any proposed change to his QC system. The QC plan will be delivered to the COR within 30 days after award of the contract.
Quality Assurance:
The government shall evaluate the contractor’s performance under this contract in accordance with the Quality Assurance Surveillance Plan. This plan is primarily focused on what the Government must do to ensure that the contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and the minimum acceptable defect rate(s).
Government Remedies:
The Contracting Officer shall follow FAR 52.212-4, “Contract Terms and Conditions-Commercial Items” or 52.246-4, “Inspection of Services-Fixed Price” for contractor’s failure to perform satisfactory services or failure to correct non-conforming services.
Recognized Holidays:
The contract is not required to perform services on holidays.

Independence Day
Hours of Operation:
The contractor is responsible for conducting performance between the hours of 8:00 am to 4:30 pm Monday thru Friday, except Federal holidays or when the government facility is closed due to local or national emergencies, administrative closings, or similar government directed facility closings. The contractor must at all times maintain an adequate work force for the uninterrupted performance of all tasks defined within this statement of work when the government facility is not closed for the above reasons. When hiring personnel, the contractor shall keep in mind that the stability and continuity of the work force are essential. Telecommuting or “work at home” is not authorized under this contract action unless under emergency situations as determined by the Contracting Officer’s Representative (COR).
Place of Performance:
The work to be performed under this contract action will be performed at Salt Lake Technical Center
Type of Contract:
The government anticipates award of a fixed price Indefinite Quantity Indefinite Delivery (IDIQ) contract.
Security Requirements:
The contractor shall adhere to all current DOL OSHA facility security policies.
Physical Security.
The contractor shall be responsible for safeguarding all government property provided for contractor use. At the close of each work period, government facilities, equipment, and materials shall be secured.

Conservation of Utilities.
The contractor shall instruct employees in utilities conservation practices. The contractor shall be responsible for operating under conditions that preclude the waste of utilities, which include turning off the water faucets or valves after using the required amount to accomplish cleaning vehicles and equipment.

Post Award Conference/Periodic Progress Meetings:
The contractor agrees to attend any post award conference convened by the contracting activity or contract administration office in accordance with Federal Acquisition Regulation Subpart 42.5. The Contracting Officer, Contracting Officer’s Representative (COR), and other government personnel, as appropriate, may meet periodically with the contractor to review the contractor's performance. At these meetings, the Contracting Officer will apprise the contractor of how the government views the contractor's performance and the contractor will apprise the government of problems, if any, being experienced. Appropriate action shall be taken to resolve outstanding issues. These meetings shall be at no additional cost to the government.
Contracting Officer’s Representative:
A COR will be delegated separately.
Key Personnel:
The contractor shall provide a contract manager who shall be responsible for the performance of the work. The name of this person and an alternate who shall act for the contractor when the manager is absent shall be designated in writing to the Contracting Officer. The contract manager or alternate shall have full authority to act for the contractor on all contract matters relating to daily operation of this contract action.

Organizational Conflict of Interest:
Contractor and subcontractor personnel performing work under this contract action may receive, have access to or participate in the development of proprietary or source selection information (e.g., cost or pricing information, budget information or analyses, specifications or work statements, etc.) or perform evaluation services which may create a current or subsequent Organizational Conflict of Interests (OCI), as defined in FAR Subpart 9.5. The contractor shall notify the Contracting Officer immediately whenever it becomes aware that such access or participation may result in any actual or potential OCI and shall promptly submit a plan to the Contracting Officer to avoid or mitigate any such OCI. The contractor’s mitigation plan will be determined to be acceptable solely at the discretion of the Contracting Officer and in the event the Contracting Officer unilaterally determines that any such OCI cannot be satisfactorily avoided or mitigated, the Contracting Officer may affect other remedies as he or she deems necessary, including prohibiting the contractor from participation in subsequent contracted requirements which may be affected by the OCI.

Part 2 Definition & Acronyms
PWS. Performance Work Statement
Contracting Officer’s Representative (COR). A representative from the requiring activity assigned by the Contracting Officer to perform surveillance and to act as liaison to the contractor.
Defective Service. A service output that does not meet the standard of performance associated with it in the Performance Work Statement.
DOL. Department of Labor
Quality Assurance Surveillance Plan (QASP). An organized written document specifying the surveillance methodology to be used for surveillance of contractor performance.
Quality Control. Those actions taken by a contractor to control the performance of services so that they meet the requirements of the PWS.
Quality Assurance. Those actions taken by the government to assure services meet the requirements of the Performance Work Statement.
SLTC. Salt Lake Technical Center
LIMS. laboratory information management system. Software used to manage, track, archive, and report laboratory results.
OSHA. Occupational Health and Safety Administration

Part 3 Government Furnished Property, Equipment, And Services
0. General:
The government will provide, the facilities, equipment, materials, and/or services listed below.

All utilities in the facility will be available for the contractor’s use in performance of duties outlined in this PWS. The contractor shall instruct employees in utilities conservation practices. The contractor shall be responsible for operating under conditions that preclude the waste of utilities.
0. Facilities:
Onsite. The government will furnish all necessary workspace required for the contractor to support the effort(s) outlined in this PWS, to include desk space, telephones, computers and other items necessary to maintain an office environment.

Contractor Furnish Items and Services
4.1 General:
Except for those items specifically states to be government furnished in Part 3, the contractor shall furnish all other items required to perform the services in this PWS.

5.1 Services:
Commodities listed below and high-quality liquid nitrogen, liquid argon (4.8 purity or higher), helium, hydrogen, nitrogen, argon, acetylene, nitrous oxide, and compressed breathing air are constantly used and consumed by:
· Sample preparation.
· Specific analytical instruments (e.g., AA, ISP, GC, etc.)
· Different laboratory operations (e.g., eluent sparging, etc.)
· Contractor must be able to deliver analytical grade and purity of gases in sufficient quantities within 3 days of request.

5.2 The vendor will monitor the tanks and when needed fill the tanks located at the Salt Lake Technical Center. The tanks located at the Salt Lake Technical Center will have a monitoring system, or other alarm system, that will notify vendor by way of an alarm line when the tank is at a certain point that is lower than required to run the equipment.
5.3 The bulk storage located at SLTC is larger than the standard size K high-pressure gas cylinder (9.25 diameter x 60 inches high, internal volume is 1.76 cu ft.). Delivery of these types of gases will be in accordance with state transportation laws that govern such transportation to and from the location in a legal and safe manor.
5.4 All gases will be provided within 3 days of submitting an order, or on unusual occasions the vendor will acknowledge to request and notify the center POC of the expected date of delivery. List of commodities listed below represents an incomplete sampling of the possible gases to be required for us by SLTC laboratory.
5.5 One invoice billed at the end of each month for all charges no later than the fifth of the following month. A monthly usage report to be emailed at the end of each month to the COR that is descriptive (no acronyms), is clearly understood and outlines what products were orders, what products were delivered, when they were delivered, the cost associated with each to include amount and units delivered that can be reader friendly to verify against monthly invoice.
5.6 If improper billing occurs vendor will notify SLTC of when and how monies will be credited back to the contract via written documentation on invoice and monthly usage report.
5.7 Upon notice of any cross contamination SLTC will not be billed for any of the product, time, or transportation cost associated with the error.
5.8 If required the contractor will provide a rental basis the SLTC appropriate storage cylinders and tanks for the period of time that the gas is needed. Bulk gases (Liquid Nitrogen and Liquid Argon) will be supplied by the vendor as needed by monitoring and alarm system provided and installed by the vendor such as a telemetry alarm keeping the volumes at required levels.
5.9 Telemetry or alarm equipment will be provided by the vendor as part of the contract and all repairs to the equipment will be the responsibility of the vendor.

Types of Surveillance to select from:
Random Sampling: Appropriate for frequently recurring tasks. Evaluate randomly selected samples of the lot to determine the acceptability of the entire lot.
Random Inspection Guide, Method of surveillance, Lot size, Sample size, Performance requirement, Sampling procedure, Inspection procedure 100 Percent Inspection: Appropriate for tasks that occur infrequently. Inspect and evaluate performance each time task is performed.
Periodic Surveillance: Evaluation of samples selected on other than 100% or statistically random basis. (I.e., monthly, quarterly, semi-annually etc.)
