PERFORMANCE WORK STATEMENT (PWS)

FOR

GREEN WASTE DISPOSAL SERVICES

KALOKO-HONOKOHAU NATIONAL HISTORICAL PARK

KAILUA-KONA, HAWAII

6 April 2022

1.0 DESCRIPTION OF SERVICES

The Contractor shall provide all management, tools, equipment, and labor necessary to ensure the disposition of green waste accumulated at Kaloko-Honokohau National Historical Park (KAHO). The Contractor shall accomplish the required services using up to eight (8) Contractor furnished 30-yard open top containers. Contractor furnished containers will be transported by the Contractor to KAHO via designated roads in KAHO. The NPS shall accumulate, process and store green waste in the up to eight (8) contractor furnished 30-yard open top containers at three separate locations at KAHO. The Contractor shall collect filled containers upon request by the NPS and dispose of the green waste material.

1.1 GREEN WASTE DISPOSAL SERVICES

1.1.1 CONTAINER DELIVERY

The Contractor shall deliver eight (8) empty 30-yard open-top to three separate locations at KAHO; One in the south section of KAHO near the Honokohau Harbor gate, four at the KAHO Visitor Center and three at Kaloko Fishpond. Delivered containers will remain at KAHO until the NPS fills them. All Contractor provided containers must be free of excessive rust that impacts structural integrity, or have holes. The specific delivery location, time and procedures will be provided by the Contracting Officer’s Representative (COR) prior to the initial container delivery.

1.1.2 CONTAINER COLLECTION

The Contractor shall collect, dispose of green waste material and then return any of the eight Contractor furnished 30-yard open-top containers upon request by the NPS when a container(s) are full. The collected containers will contain green waste material. The Contractor shall ensure that collected containers are safe for transport and are transported outside the Park within as soon as schedule allows and within 24-120 hours of NPS request. The specific collection location, time and procedures will be provided by the COR prior to the collection date.

1.1.3 WASTE DISPOSAL

The Contractor shall dispose of all green waste from collected containers at appropriate green waste processing facilities. Contractor may take the collected containers to a facility other than the County of Hawaii Green Waste Diversion Program at Puuanahulu if the cost is cheaper.

1.1.3.1 WASTE DISPOSAL REPORT

When weight determines the cost for disposal, the Contractor must submit to the COR documentation indicating the total weight of waste disposed from each container. This documentation is required as part of the vendor payment process.

1.1.4 Permits, License & Insurance

The Contractor shall be responsible for obtaining and holding all the necessary permits, licenses and insurance required to accomplish these services, including final disposition.

1.2 CONTRACTOR PROVIDED EQUIPMENT AND SUPPLIES.

1.2.1 CONTRACTOR-FURNISHED EQUIPMENT/VEHICLES.

The Contractor shall provide and maintain all equipment and vehicles necessary to perform the requirements of this contract. The Contractor may not perform any cleaning, repair and/or maintenance requirements of equipment on site. Maintenance and repair of Contractor containers, vehicles or their privately owned vehicles shall not be accomplished on site. Contractor equipment and vehicles shall be maintained to present a neat, professional appearance. Contractor equipment and vehicles shall be used solely for the intended purpose of performing services in this performance work statement during normal hours of operation.

All equipment used in the performance of this contract shall be in good operable condition. Equipment found to be unsafe and unable to function as designed, shall not be used in performance of this contract. The Contracting Officer (CO) or COR may inspect the Contractor’s equipment at any time while on government property and may direct the removal of any unsafe or unusable equipment from those locations.

The Contractor shall provide adequate numbers of equipment items and vehicles to effectively fulfill the scope of this contract. In addition, the Contractor shall maintain or have backup capability to provide continued service in the event primary equipment or vehicles are unsatisfactory or down for extended maintenance or repairs. Equipment failure shall not alleviate the Contractor from performing any requirement contained in this contract.

2.0 SERVICE SUMMARY (SS):

The contract service requirements are summarized in the performance objectives below. The performance threshold briefly describes the minimally acceptable levels of service required for each requirement. The SS provides information on contract requirements, the expected level of Contractor performance and the expected method of government validation and confirmation of services provided. These thresholds are critical to mission success. Procedures as set forth in the FAR 52.212-4 (a), Contract Terms and Conditions - Commercial Items, Inspection/Acceptance, will be used to remedy all deficiencies. Barge services to Kalaupapa are performed only once per year and any identified performance defect will be actively managed by the Government.

2.1 Quality Control

The Contractor shall develop and maintain a quality program to ensure these described services are performed in accordance with commonly accepted commercial practices. The Contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. At a minimum the contractor shall develop quality control procedures addressing the areas identified in paragraph 2.0, Service Summary.

2.2 QUALITY ASSURANCE

The Government shall inspect and evaluate the Contractor’s performance to ensure services are received in accordance with requirements set forth in this PWS. The COR may inspect by validating actual work performance, physically checking an attribute of the completed task, checking a management information report, investigating customer complaints, conferring with facility managers or otherwise inspecting the task or its results to determine whether or not performance meets the standards contained in this PWS.

2.3 GOVERNMENT REMEDIES

The CO will follow FAR 52.212-4 Contract Terms and Conditions-Commercial Items, for the contractor’s failure to perform satisfactory services or failure to correct non-conforming services.

3.0 CONTRACT MANAGER

The contractor shall establish a contract manager or alternate(s) that can be contacted during work hours. The contract manager or alternate shall be available during normal duty hours to discuss contract related matters. The Contractor shall provide the CO the telephone number(s) where performance validation results and complaints can be reported. This information will be kept updated by the contractor whenever personnel changes occur. The contract manager or alternate shall have full authority to act for the contractor on all contract matters relating to the daily operation of this contract.

4.0 SAFETY REQUIREMENTS AND REPORTS

The Contractor shall perform work in a safe manner as required by OSHA Safety and Health Requirements. The Contractor shall immediately provide a verbal report to the CO and COR for each occurrence of damage to Government property or an accident resulting in death, injury, occupational disease, or adverse environmental impact.

5.0 CONTRACTOR QUALIFICATION

The contractor shall be responsible for complying with all Federal, State and Local requirements for waste disposal and any other service activities made under this effort. The contractor shall possess all appropriate licensing for the service which is being provided. The contractor shall be responsible to ensure sub-contractors possess the appropriate licensing for the sub-contracted service activities provided.

6.0 CONTRACTING OFFICER (CO) AND CONTRACTING OFFICER REPRESENTATIVE (COR) (QUALITY ASSURANCE PERSONNEL).

The CO will appoint a primary and alternate representative for management of the day-to-day activities of the contract. The identity, title, and authority of this representative will be provided in writing to the Contractor after contact award.
