Performance Work Statement (PWS) Geotechnical Investigation Support Services for Champlain Towers South NCST Teams
Background:
The National Construction Safety Team Act (“Act”), Pub. L. 107-231, codified at 15 U.S.C. 7301 et seq., was enacted to provide for the establishment of investigative teams (“Teams”) to assess building performance and emergency response and evacuation procedures in the wake of any building failure that has resulted in substantial loss of life or that posed significant potential of substantial loss of life. The purpose of investigations by Teams is to improve the safety and structural integrity of buildings in the United States.
As stated in the statute, a Team shall (1) establish the likely technical cause or causes of the building failure; (2) evaluate the technical aspects of evacuation and emergency response procedures; (3) recommend, as necessary, specific improvements to building standards, codes, and practices based on the findings made pursuant to (1) and (2); and (4) recommend any research and other appropriate actions needed to improve the structural safety of buildings, and improve evacuation and emergency response procedures, based on the findings of the investigation. In addition, NIST has promulgated regulations implementing the Act. The regulations are found at 15 CFR part 270.
NIST sent a preliminary reconnaissance team to collect information and data related to the collapse of the Champlain Towers South (CTS) Condominium in Surfside, FL that occurred on June 24, 2021. Based on the recommendations of the preliminary reconnaissance team and evaluation of the criteria listed in the regulations implementing the Act, specifically in 15 CFR § 270.102, on June 30, 2021, the Director of the National Institute of Standards and Technology (NIST), United States Department of Commerce, established a Team (called herein the Champlain Towers South National Construction Safety Team or CTS NCST) to study the collapse of the Champlain Towers South Condominium in Surfside, FL. The Team may include members who are Federal employees and members who are not Federal employees. Team members who are Federal employees are governed by the Federal conflict of interest laws. Team members who are not Federal employees will be Federal government contractors.
Objectives:
The objective of this acquisition is to procure technical assistance in evaluating selected geotechnical aspects of the CTS site. In particular, support is needed to assess technical contributors to the site characterization and foundation design, its as-built construction, and its condition at the time of collapse. This project is expected to be critical for analyzing the relationship and interactions between the structure and the subsurface of the site.
Scope of Work:
General Requirements:
The Contractor shall be available to be on location in the Surfside, FL area, when needed, for observations, sampling, or testing of the CTS building, site, and warehouse evidence, or adjacent areas and to meet with building code officials and others (contractors, maintenance personnel, etc.) with relevant knowledge on the building and site’s history and characteristics that could pertain to the partial collapse event. Remote work may include analysis, presentations, project team meetings, and providing input and assistance to NIST in creating professional grade reports documenting the investigation being performed pertaining to the partial collapse.
Specific Task Requirements:
Task 1 Project Management and Planning Task 1.1 Project Director Support The Contractor shall appoint a Project Director (PD) who shall have overall responsibility for project management and execution of tasks detailed herein. The PD shall be responsible for progress of the project, its deliverables, and the overall technical quality of the project. In addition, the PD shall be responsible for reviewing project deliverables prior to submission, providing advice and consultation throughout the project, and shall serve as a liaison to outside organizations or persons as directed by the NIST Contracting Officer’s Representative (COR).
As the work required by this Performance Work Statement (PWS) is one component of the overall geotechnical investigation of the CTS condominium collapse, the PD shall ensure appropriate communication and coordination with all NIST contract personnel. The PD is responsible for working closely with the COR to coordinate any new developments in the CTS NCST investigation. This shall require meetings amongst all Contractor Personnel, and with NIST staff working on geotechnical and other aspects of the CTS investigation. The PD shall participate and, when appropriate, present at CTS NCST meetings.
Task 1.2 Kick off meeting Within five calendar days of award, the Contractor shall host and conduct a project kickoff meeting via web-supported videoconference with NIST and all key project personnel. The goal of this meeting shall be to review the study approach, data needs, and coordinate activities as needed to develop a project work plan and a timeline for the project. This meeting shall include the NIST COR and other NIST personnel identified by the COR.
Task 1.3 Project Work Plan (PWP) Within twenty-one calendar days of contract award, the Contractor shall develop and submit to NIST a draft project work plan (PWP, Deliverable 1) for review and approval. The PWP shall include descriptions of more detailed plans for the tasks identified in this PWS, their schedules, and any potential risks for implementation anticipated along with mitigation strategies. Within the PWP, the Contractor shall explicitly define its quality assurance and quality control (QA/QC) plan for the project. For each deliverable a written record of the QA/QC process, and final certification, shall be retained by the Contractor and delivered to the COR alongside each deliverable.
The NIST COR will approve the PWP or provide review comments for revision within ten calendar days of receipt. The Contractor shall have ten calendar days to incorporate review comments provided by NIST and submit a final PWP. The PWP shall be revised as needed throughout the life of the contract with updates mutually agreed upon by NIST and the Contractor, with the Contractor providing the proposed revision and NIST approving or providing comments for revision within ten calendar days of receipt. The act of exercising options may also require an update to the Project Work Plan which the Contractor shall perform and revise following the same procedures as outlined above.
Task 1.4 Monthly Update Calls, Other meetings, and Reports The PD shall be responsible for communication of the contract status through monthly update reports which shall provide information on the progress, schedule, and risks associated with the project and each deliverable. Information on travel and other direct costs shall also be provided. Status reports (Deliverable 2) are to be completed and submitted to NIST’s COR by the final day of each month during the contract performance period. As necessary, the COR will discuss and propose resolutions to mitigate any difficulties in coordination with the PD. Virtual meetings may also be required to facilitate conversations related to the above updates.
It is anticipated that the scope of work detailed in this PWS will require regular meetings of Contractor Personnel with NIST, amongst Contractor Personnel, and potentially the creation of smaller task-oriented working groups. The PD is expected to make provisions for these interactions and take responsibility for ensuring coordination is both effective and efficient. The Contractor shall host and conduct meetings as described in this section in accordance with the tasks of this contract. All meetings shall be conducted during regular business hours for Eastern Time. Notification for NIST personnel shall be provided with two working days’ notice prior to the meeting. The Contractor shall host and conduct monthly web-supported teleconference meetings, and keep minutes of these meetings to be provided to NIST within two working days after each meeting. The PD shall inform NIST’s COR immediately of any challenges identified in the coordination process, and the COR and PD shall work together to create a solution to these challenges.
