National Emission Standard for Hazardous Air Pollutants (NESHAP), and Virginia Law. The

Asbestos Standard for Construction, 29 CFR 1926.1101, applies for both regulated and non-regulated ACM. Category I/II no friable ACM must not become friable during the activity or have the high probability of becoming crumbled, pulverized or reduced to powder by the forces expected to act on the material in the course of demolition or renovation operations. Resilient floor coverings are considered Category I no friable, mastics are considered Category II no friable in meeting the definition of 40 CFR 61 subpart M. All procedures for the removal of no friable Category I/II ACM must be in accordance with all federal, state and local regulations. If during removal, the asbestos containing material becomes friable, all applicable regulations must be met and the Contracting Officer notified of the change in project status.
