BERLIN DAM TREE REMOVAL
PERFORMANCE WORK STATEMENT
Berlin Dam 2030 Bonner Road Deerfield, OH 44411 Phone No. 330-654-0879
1. GENERAL REQUIREMENTS
The purpose of this contract is to remove trees and grind stumps on the East side of Berlin Dam. All trees shall be cut and removed from project lands within the designated clearing area. All stumps shall be ground to 8” below grade. Designated clearing area is described in the Site Map at the end of this Performance Work Statement.
All work shall be conducted in strict accordance with the following standards of practice:
· ANSI Z133.1 – Tree Care Safety Standard
· 29 CFR 1910.266 – Logging Operations
· 29 CFR 1910.269 – Electrical Power Generation, Transmission and Distribution
· USACE EM 385-1-1 Section 31 Tree Maintenance and Removal
1.1 GENERAL DESCRIPTION
Contractor shall furnish all labor, materials, equipment, tools, transportation, supervision, expertise, and related supplies to safely remove selected trees.
1.2 SAFETY
Hazards may be (but are not limited to) bee stings, snake bites, and overhead electrical hazards. All personal protective gear and safety protocols shall be adhered to by the Contractor and their employees. At any time when the Government representative witnesses a safety violation, work shall immediately be stopped, and the violation documented and corrected before work can resume.

The Contractor shall develop an Activity Hazard Analysis (AHA) for all work under this contract and submit it to the Contracting Officer’s Representative. A blank AHA form is attached (Attachment 1 – Blank AHA Form).
The following specific Personal Protective Equipment shall be required under this contract:
· Safety Shoes – All employees engaged in construction operations shall wear safety shoes meeting the requirements of EM 385-1-1, Section 05.E.
· Protective Eyewear – All workers on the site shall wear, as a minimum, protective eyewear meeting the requirements of EM 385-1-1, Section 05.A. Additional eye protection may be required in accordance with the requirements of EM 385-1-1, Section 05.B.
· Hearing Protection – Hearing protection shall be provided for workers in accordance with EM 385-1-1, Section 05.C.
· Head Protection - Head protection shall be provided for workers in accordance with EM 385-1-1, Section 05.D.
· Fall Protection - If working from a lift or at heights greater than 6 feet, workers shall use fall protection in accordance with EM 385-1-1, Section 21.
The Contractor shall identify and protect all overhead utility lines prior to commencing work in that area.
1.3 COORDINATION MEETING AND POINTS OF CONTACT (POC)
Prior to commencement of any work being performed on site, the contractor shall participate in a meeting with the Berlin Lake Resource Manager and Contracting Officer’s Representative (COR), which will include approving a work progression plan.

1.4 VERIFICATION OF FIELD CONDITIONS
The Contractor shall verify all conditions in the field and shall advise the COR of any discrepancy before performing any work.
1.5 PROJECT/SITE CONDITIONS
1.5.1. WORK AREAS
The Contractor's attention is directed to the fact that the work to be performed is located in areas heavily used by the public. It shall be the responsibility of the Contractor to provide the controls necessary to prevent any interference by the public to his operations. The Contractor shall take all necessary and reasonable precautions to secure the area against vandalism and to ensure the safety and well-being of the public until final acceptance by the Government.
1.5.2 TIME OF PERFORMANCE
The Contractor shall confine all operations at the work site between the hours of 7:00 AM and 4:00 PM, Monday through Friday, unless otherwise approved. Work will be permitted on weekends or Federal holidays, with permission of the COR (SCA wage rates will apply). Access guidelines will be provided by the COR. Contractor shall coordinate contract tasks and activities with the COR.

1.6 PROTECTION OF GOVERNMENT PROPERTY
The contractor shall protect all government property during the performance of this contract. All damage to existing government property, including turf, as a result of the contractor’s work shall be repaired or replaced to the satisfaction of the Government. Work areas shall be cleaned by the contractor after the work is complete.
1.6.1 Protection of Improvements
The Contractor shall protect all trails, roads, ditches, fences, campsites, picnic sites, interpretive signs, bulletin boards, restrooms and showers, utilities, and other improvements in the project area. Access guidelines will be provided by the Points of Contact. Any road or trail used by the Contractor that is damaged by his operations shall be promptly repaired by him. The Contractor shall protect all utilities from damage, immediately contact the appropriate utility if damage should occur, and shall be solely responsible for locating all existing utilities above ground prior to commencing work. Any damage to these improvements shall be replaced by the Contractor at no additional expense to the government.
1.6.2 Protection of Archaeological/Historical Resources
The Contractor, upon the discovery of suspected archaeological or historical materials, shall cease work in the vicinity of such materials and immediately notify the COR.
1.7 PROTECTION OF PERSONNEL
The Contractor shall ensure that adequate measures are in place to protect workers, facility operation personnel and the public from injury due to the operations being performed. All protective measures shall be in accordance with EM 385-1-1.
1.8 SECURITY REQUIREMENTS
1.8.1 Access and General Protection and Security Policy and Procedures
The security requirements described below apply to all contract personnel (including employees of the prime Contractor and all subcontractors’ employees) supporting the performance requirements of this contract. The Contractor is responsible for compliance with these security requirements. Questions regarding security matters shall be addressed to the designated Government representative (e.g., Contracting Officer Representative (COR) Requiring Activity (RA) representative, or Contracting Officer (if a COR or other RA representative is not appointed)). Contract personnel are critical to the overall security and safety of US Army Corps of Engineers (USACE) installations, facilities, and activities, and security awareness training contributes to those efforts. The Department of Defense (DoD) and Army security training requirements specified below, if applicable, are performance requirements; all applicable contract personnel shall complete initial training within 30 days of contract award of the date new contract personnel begin performance on the contract. Within five business days form the completion of training, the Contractor shall provide written documentation to the Government representative. The documentation shall include the names of contract personnel trained and which training they completed; the Contractor shall maintain training records as part of their contract files and be prepared to provide copies of training certificates to the Government representative. Contractor personnel and vehicles are subject to search when entering federal installations. Additionally, all contract personnel shall comply with Force Protection Conditions (FPCON) measures, Random Antiterrorism Measures (commonly referred to as “RAMs), and Health Protection Conditions (HPCON) measures. The Contractor is responsible for meeting performance requirements during elevated FPCON and/or HPCON levels in accordance with applicable RA plans and procedures; this includes identifying missions essential and non-mission essential personnel. In addition to the changes otherwise authorized by the changes clause of this contract, should the FPCON of HPCON levels at any individual facility or installation change, the Government may implement security changes that affect contract personnel. The Contractor shall ensure all contract personnel are aware of their security responsibilities, including any site-specific requirements identified in local policies or procedures. The contractor must submit the full name, Social Security Number, and Date of Birth for all associated contractor or subcontractor employees to the USACE Security Office, Ivan Russell , 412-395-7591, ivan.r.russell@usace.army.mil, and Joseph Bali, Security Manager, 412-395-7162 Joseph.M.Bali@usace.army.mil. LRP Security Information Sheet, (Attachment 2 – LRP Security Information Sheet) is to be completed and returned to Mr. Russell. The contract number and title of the project including the location is to be identified on the Sheet. To protect employee PII, the submission of the completed form through a secure fax is preferred; however, a secured email is acceptable. If e-mailing required information, e-mail must be encrypted to protect Personally Identifiable Information (PII). The District retains the right to deny any contractor and subcontractor employee from working on one of its contracts based on final background investigation results.
1.8.2 Instant Verification of Employment Eligibility (E‐Verify)
The Contractor must pre‐screen Candidates using the E‐verify Program (http://www.uscis.gov/e-verify) website to meet the established employment eligibility requirements. The Vendor must ensure that the Candidate has two valid forms of Government issued identification prior to ensure the correct information is entered into the E‐verify system. An initial list of verified/eligible Candidates must be provided to the COR no later than 3 business days after the initial contract award.
1.8.3 Employee Identification and Background Check
The Contractor shall be responsible for furnishing an identification badge/card to each employee prior to the employee working on-site and for requiring each employee engaged on the work to display identification. Identification shall consist of name tags with the name of the Contractor and the employee's name. Additionally, a valid state driver's license or other Government-issued photo identification card is required for positive identification.
2. EXECUTION
2.1 DESCRIPTION AND LOCATION
2.1.1 General
The contract consists of removing one hundred and thirty (130) trees and grinding 130 stumps 8” below grade. The average diameter at breast height (DBH) is 8” – 12” and the identified trees are shown in the clearing corridor located in the Site Map. The boundary of the area to be cleared is marked on site with flagging. The Contractor will be responsible for any damage to Government property. The choice of equipment to perform the work is left to the contractor. Contractor’s equipment shall only be operated by qualified operators.
2.1.2 Debris and Wood Removal
All logs, wood, limbs, mulch, stump grinding waste and other debris generated by the Contractor shall become the property of the Contractor and removed from Government land.
2.1.3 Stumps
All tree stumps shall be ground 8” below grade with a stump grinding machine.
2.1.4 Final Clean-Up and Disposal
Before final acceptance all trash, rubbish, and debris generated by Contractor's operation shall become the property of the Contractor and removed from the work area and disposed of properly off site in accordance with all applicable local, State and Federal regulations. On-site burning will not be permitted. Any damage to turf, ditches, are roadways shall be repaired to the satisfaction of the government.
2.1.5 Schedule
Due to the area of work being located within the Indiana Bat range, work may only be done under this contract between November 15 and March 31 of any year. If the work cannot be completed by March 31, 2025, any remaining work must be completed no later than March 31, 2026.
In accordance with the Migratory Bird Treaty Act of 1918, no tree will be cut/removed if an active avian nest is detected. Work may be performed after it has been determined that the avian nest is no longer active.
