PERFORMANCE WORK STATEMENT (PWS)

Temporary Traffic Control Installation J. Earle Bowden Road

State Highway 399 (GUIS Route 0011)

PMIS 312303

Gulf Breeze, Florida

Gulf Islands National Seashore

1. General Information Gulf Islands National Seashore (GUIS) is a unit of the National Park Service and is head quartered in Gulf Breeze, FL. Portions of the J. Earle Bowden Parkway, or Hwy 399, between Pensacola Beach and Navarre Beach, were damaged during Hurricane Sally in September 2020.

The road is currently closed to public traffic due to its condition. In 2019, the park welcomed 5.6 million visitors. J. Earle Bowden Parkway carries about 2,000 average daily traffic.

2. Facility Background J. Earle Bowden Parkway is approximately 7.1 miles in length. The roadway is approximately 22 feet wide with 5 feet wide bike lanes on either side. There are six parking areas along the roadway on both the north and south sides. Approximately 1,100 LF total of roadway is damaged. The width of the damage is less than ½ lane in all cases. About 8,200 LF of bike lane is damaged. The road has gates with signage at both ends. Currently the gates are closed and the road is closed to public traffic.

This project will allow the park to open J. Bowden Parkway to public traffic to provide access between Pensacola Beach and Navarre Beach. The table on page 2 shows the portions of the road and bike lane that were damaged.

3. Scope of Work The scope of work for this project is as follows:

TEMPORARY TRAFFIC CONTROL SIGNS AND APPERTENANCES

Contractor shall furnish and install temporary traffic control signs, tubular markers, striping, and speed humps in all areas as indicated in plan drawings. The tubular markers shall be affixed to the asphalt in a manner that shall be in place for up to one year. All signs shall be post mounted.

No temporary signs may be used.

PERMANENT ROAD SIGNS

Contractor shall furnish and install all signs and 3 inch by 12 feet aluminum posts per plan quantity sheet. All sign backs shall be painted NPS Brown. Contractor shall furnish color samples to COR for approval.

4. Contractor Responsibilities Contractor Shall Provide the Following Materials and Services:

5. Government Furnished Property, Materials & Supplies Gulf Islands National Seashore will not be providing any property, materials or supplies for the subject project.

6. Business Hours The contractor shall typically complete on-site work or delivery, including unloading, during normal business hours of 7:30 am to 4:30 pm, Monday through Friday, excluding weekends and Federal holidays. However, upon coordination with the COR, the contractor may work earlier or later as required. The contractor may also work weekends if necessary upon coordination with the COR. The contractor shall coordinate specific on-site work schedule with the Contracting Officer and COR five days prior to performance start date. While on site, the COR may be reached by mobile phone during normal business hours.

7. Management During Normal Working Hours The contractor shall manage the total work effort in accordance with effective and efficient management principles and safe working practices to ensure safety of the public and on-time completion of this contract.

8. Maintenance of Traffic The roadway will be closed during the course of the proposed work; therefore, Traffic Control is expected to be minimal during the course of the work. The contractor shall follow the Manual of https://highways.dot.gov/federal-lands/specs

Uniform Traffic Control Devices (MUTCD) for any traffic control that might be required for administrative and emergency traffic. Contractor shall use appropriate traffic control devices needed for this work and for protecting workers and visitors.

9. Safety & Environmental Compliance

• The contractor shall comply with pertinent provisions of the Occupational Safety and Health Act (OSHA), and state, local, safety, laws.

• The contractor shall comply with pertinent Environmental Protection Agency laws and regulations.

• Contractor must be licensed in the State of Florida.

• The Gulf Islands National Seashore safety officer has the authority to issue restraint or cease-and-desist orders to the contractor when violations or unsafe acts are present and threaten Government and contractor employees or damage to Government property.

• The contractor shall immediately report to the Contracting Officer, COR and Gulf Islands National Seashore safety officer all accidents resulting in employee injury or death or damage to property while performing this contract.

10. Insurance The Contractor shall be insured in accordance with State of Florida insurance regulations. The Government is not responsible for damage to Contractor’s equipment, vehicles, tools or materials or their employees and the personal property brought on-site. The Government will not accept any liability due to contractor employee negligence.

11. Motor Vehicle & Traffic Regulations Contractor employees operating motor vehicles shall possess an appropriate, valid driver's license. Driver and vehicle permits, licenses, registrations and proof of insurance shall be maintained in the vehicle at all times and made available upon request. Contractor employees shall comply with federal vehicle motor law requiring seat belts be worn at all times. Contractor employees shall adhere to the posted speed limits.

12. Performance Requirements Summary (PRS) The contractor performance requirements are summarized into required services that relates directly to successful contract completion. The performance standard identifies the minimum acceptable levels of service allowed.

13. Maintenance of Roadways Contractor shall show due diligence to ensure that asphalt on roadways and developed parking areas are protected from damage.

14. Gates at park boundaries Contractor shall be responsible for ensuring gates are locked at the end of each shift.

1. Contractor shall provide a lock to be used on a joint locking system serving both the Park and the Contractor.

2. Gates shall be closed during the day and at the end of each day.

15. Employee Parking All contractor employees shall in established parking areas or as approved by COR.

16. Replacement of Contractor Employee for Security Reasons The Government retains the right to request removal of the contractor’s employee(s), regardless of prior clearances.

17. Non-Payment for Additional Work Any additional contractor performed services not specified in contract, either at its own volition or at the request of an individual other than an appointed Contracting Officer, except as may be explicitly authorized in the contract, shall be performed at the financial risk of the contractor.

Only an appointed Contracting Officer is authorized to bind the Government to a change in specifications, contract terms, or conditions.

18. Conflict of Interest The contractor shall not employ off-duty COR’s or other Government employees if such employment would create a conflict of interest or be contrary to the policies contained in conflict-of-interest directives.

19. Quality Control The contractor shall establish and maintain a Quality Control Plan (QCP) to ensure the work performed conforms to the contract requirements. The Performance Requirements Summary (Section 12) establishes performance standards that are the minimum requirements for acceptable performance of required services. The contractor’s QCP shall address methods for remedying poor performance. The Contractor shall develop QCP and submit with proposal package. The Contractor’s QCP includes:

• Required services identified in Performance Requirements Summary

• Contractor’s surveillance methodology

• Method and timeframe for responding to COR or customer complaints

• Progress meetings with Government stakeholders

20. Quality Assurance The COR will monitor the contractor’s performance under this contract using the quality assurance procedures specified in the Government’s Quality Assurance Surveillance Plan (QASP). The QASP may be modified after contract award upon review and acceptance of the contractor’s QCP to ensure both plans are mutually supportive. The purpose of the QASP is to ensure that the required services are performed in accordance with the contract requirements.

The plan ensures reliable and continued operation by precluding unnecessary complaints and unacceptable performance. Government’s QASP includes:

• Acceptance of the contractor’s quality control plan

• Random inspection of the contractor’s work

• Communicating customer complaints

• Progress meetings with the contractor

The implementation of this QASP does not relieve the contractor of its responsibility to implement and abide by the QCP incorporated into this contract, and to provide acceptable performance of all required services listed herein. At the CO’s discretion, the contractor may incur a payment deduction for lack of compliance with the QCP, PWS or PRS.

21. Contractor’s Proposal Package The following deliverables are to be submitted with offer in response to RFQ.

• Technical approach to perform required services.

• Contractor safety plan.

• Contractor’s QCP

• Proof of Insurance–Business Liability & Workers Compensation.

22. Inspection.

The Government will conduct inspections during and upon completion of required services.

Final payment will be processed upon confirming that all noted contractor performance deficiencies have been satisfactorily corrected.

23. Schedule The proposed work must be completed within 3 weeks after notice to proceed is given.

Contractor shall provide a realistic schedule for the completion of the proposed work, and notify the Park if there is not sufficient time in the schedule prior to accepting the contract.

24. Liquidated Damages There will be no liquidated damages.
