Summary
This is an Invitation to Bid (ITB) issued by the City of Spokane Purchasing Department for the purchase and installation of replacement refrigeration components at the Police Evidence Facility located at 4010 E Alki Ave, Spokane, WA 99202. The project requires the installation of two separate refrigeration systems, each capable of maintaining a temperature range of 35-37 degrees Fahrenheit independently, with automatic daily alternation between units to distribute wear and automatic failover capability if one unit malfunctions. The scope of work includes decommissioning and disposal of existing refrigeration equipment, securing all necessary permits, and providing all labor, materials, equipment, and testing for installation. Specified equipment includes two Bohn BCH0035MBACZC0284 scroll units, two Bohn BEL0125AS6AMA intelligent control systems, and two Bohn BEL0125AS6AMAB0200 low-profile intelligent air defrost evaporators, or approved equals. A mandatory pre-bid meeting is scheduled for Thursday, October 1, 2026, at 10:00 AM, with the question deadline on Monday, October 5, 2026, at 11:00 AM. Bids are due Tuesday, October 13, 2026, with sealed bids opening at 11:15 AM via Teams meeting. The anticipated Notice to Proceed date is November 6, 2026, with work completion and invoicing required by December 11, 2026.
Bidders must submit bids electronically through the City's ProcureWare portal and include a 5% bid bond. Award will be made to the lowest responsive responsible bidder. Washington State prevailing wage rules under RCW 39.12 and Federal Davis Bacon wage requirements apply to this project, which is funded through Department of Justice pass-through funds administered by the Washington State Attorney General's Office. Contractors must comply with mandatory bidder responsibility criteria including current Washington contractor registration, UBI number, workers' compensation insurance, and Public Works prevailing wage training certification. All employees working on site must complete fingerprinting, background checks, and Criminal Justice Security Awareness Training prior to work commencement. The City has established laudatory goals of 10% minority business enterprise (MBE) and 6% women's business enterprise (WBE) participation, though failure to achieve these goals will not impact bid responsiveness. Insurance requirements include workers' compensation with $1,000,000 employers' liability, general liability of $1,000,000 per occurrence/$2,000,000 aggregate, and automobile liability of $1,000,000 per accident.

A. the bidder does not meet the mandatory bidder responsibility criteria in SMC7.06.500 and RCW 39.04.350(1), as amended; or
B. the bidder does not meet the supplemental bidder responsibility criteria as shown in these bid specifications. The bidder may be required by the City to submit documentation demonstrating compliance with the criteria.
If a potential bidder believes that the supplemental bidder responsibility criteria will exclude it from bidding, it may request the City to consider modifying the criteria. Any request shall be submitted to the Purchasing Department no later than five (5) days before the bid opening. The City shall evaluate any such request, and if a decision is made by the City to modify the criteria, the modification shall be communicated to all bidders and plan holders via the issuance of an addendum to the bidding documents. Likewise, in the event the City decides not to modify the criteria, it will endeavor to notify the requesting bidder of its decision.
As evidence that the Bidder meets the supplemental bidder responsibility criteria, the apparent lowest Bidder shall submit to the City within twenty-four (24) hours of the notification time the completed supplementary bidder responsibility form with any required documentation. The City reserves the right to request this documentation from other bidders as well, and to request further documentation as needed to assess the bidder’s responsibility.
The basis for evaluation of bidder compliance with the supplemental criteria shall be any documents or facts obtained by the City (whether from the bidder or third parties) which any reasonable owner would rely on for determining compliance. Determinations of responsibility or non-responsibility of a bidder due to the supplemental criteria shall be based on a review of all the supplemental criteria factors as a whole with no single item being determinative.
If the City determines the low bidder does not meet either the mandatory bidder criteria or the supplemental bidder criteria and is therefore not a responsible bidder, the Contracting Agency shall notify the bidder in writing with reasons for the determination. If the bidder disagrees with this determination, it will have a minimum of three (3) business days from receiving the determination to submit additional written information to the City. The City will consider any timely submitted additional information received from the bidder before issuing its subsequent determination. If the bidder disagrees with the City’s subsequent determination it may appeal the determination to the Mayor or designee in writing within two (2) business days of receiving the City’s determination. If the final appeal affirms that the bidder is not responsible, the City will not execute a contract with any other bidder until at least two (2) business days after the bidder determined to be not responsible has received the final determination.
12. BIDDING ERRORS.
Unit pricing will prevail in the circumstances of unit and extension pricing discrepancies.
When, after the opening and tabulation of Bids, a Bidder claims error, and requests to be relieved of award, he will be required to promptly present certified work sheets. The Purchaser will review the work sheets and if the Purchaser is convinced, by clear and convincing evidence, that an honest, mathematically excusable error or critical omission of costs has been made, the Bidder may be relieved of his Bid.
13. REJECTION OF BIDS.
The City reserves the right to reject any or all bids, to waive minor deviations from the specifications, to waive minor informalities in bidding, whenever it is in the City's best interest, and to accept or reject all or part of this Request for Bids, at the prices shown.
