About this file

This justification for other than full and open competition document outlines the National Nuclear Security Administration's requirement for Knight's Armament Company AN-PVS-30LW night vision scopes to support the Office of Secure Transportation. The justification cites the AN-PVS-30LW's improved visual clarity, ergonomics, and lower weight compared to predecessor models. Extensive market research found Knight's Armament to be the sole manufacturer that can meet the required reliability, extended five-year warranty, armorer training, and post-sale maintenance. A notice of intent received no responses. The contract was awarded sole source on August 24, 2021 for an unknown amount to an unknown vendor.

JOFOC – SOLICITATION NUMBER 89233121QNA000191 Page 4

. Based on routine and non-routine training and field testing, OST experienced focal and image alignment issues

. Although OST contracted to service and refurbish these units, the focal and image alignment issues persisted

Accordingly, OST requires the KAC’s AN-PVS-30LW with the Gen 3 white phospur intensifier tube and a FOM of 2350 or higher. At this time, no other manufacturer can match the improved visual clarity, ergonomics, and lower weight that the AN-PVS- 30LWs provide

. OST recently conducted testing of the PVS-30LW and confirmed their performance . As part of OST’s market research, OST Subject Matter Experts fired in excess of 1,000 rounds with the PVS-30LW which remained within .5 minutes of angle indicating that the PVS-30LW is highly accurate. This currently cannot be achieved with OST’s current optics.

The AN-PVS-30s are available commercially or as a non-developmental COTS item but there are limited quantities available. The AN-PVS-30LWs are widely used by the U.S.

Military and other Federal Law Enforcement agencies. However, although there are multiple commercial vendors and distributors of the AN-PVS-30LWs, most, if not all, do not offer an extended warranty beyond the typical one-year warranty period.

Additionally, all commercial vendors and distributors do not provide extensive armorer training or provide maintenance of the AN-PVS-30LWs after purchase as required during the contract’s five-year period of performance.

VI. EFFORTS TO IDENTIFY ADDITIONAL SOURCES

In accordance with FAR §5.201, a Notice of Intent (NOI)/Sole Source Synopsis (SSS) was posted through Contract Opportunities on June 9, 2021 to notify the public of the Government’s intent to award this action by means of other than full and open competition. The NOI closed on June 24, 2021 and received zero responses. As discussed in greater detail in Section VIII Market Research, based on the extensive market research that the Government has conducted, the Government does not anticipate additional sources other than KAC will meet its requirements. However, the Government will continue to identify additional sources as information becomes available.

VII. DETERMINATION OF REASONABLENESS OF COST OR PRICE

The Contracting Officer shall conduct a thorough review of recent contract awards for the AN-PVS-30LW Night Optic by the US Marine Corps and US Army. The CO will then make a determination of cost/price reasonableness utilizing various methods including a price analysis which incorporates a technical analysis and an Independent Government Cost Estimate, including any other relevant market research and other cost estimating methodologies. Accordingly, it is the determination of the CO that the anticipated costs will be fair and reasonable.

VIII. MARKET RESEARCH

Market research was conducted in accordance with FAR §10.001(a) (2). OST SMEs reviewed a number of companies to determine whether their products met OST’s requirements. OST SMEs also attended Trade Shows, contacted vendors, and conducted internet searches. OST’s market research indicates that KAC is the only manufacturer of the AN-PVS-30LW. Open searches on the internet to include thomasregister.com indicated a score of commercial distributors of KAC products, to include the AN-PVS- 30LW with a price range between $14,376 and $14,995 for new AN-PVS-30LW with white phosphor and "high" FOM (FOM not specified). Websites that include the high-end features indicate they are not in stock and will be backordered. Searches on contractsdirectory.gov yielded no results. Additionally, OST’s market research discovered that the commercial vendors are limited to retail and cannot provide the quantities that OST requires, and all vendors do not offer a five-year extended warranty with factory maintenance and armorer training.

IX. OTHER FACTS

As discussed in Section VIII, a technical evaluation performed by OST’s SMEs revealed only one known responsible and available source that can meet the Government’s requirement. OST SMEs shall continue to conduct market research to determine vendor capabilities in meeting OST’s training requirements. However, at this time, KAC is the sole manufacturer and the only vendor who can meet all of OST’s requirements as discussed in Section V. OST requires that the KAC AN-PVS-30LW are equipped with the Gen 3 white phospur intensifier tube and FOM of 2350 or higher. These attributes offer improved visual clarity, ergonomics and lower weight than predecessor models like the AN-PVS-27 which have been proven to be unreliable and cost prohibitive. Although there are multiple vendors of the AN-PVS-30, KAC is the only manufacturer that can meet OST’s requirements for reliability, extended warranty, armorer training, and after

JOFOC – SOLICITATION NUMBER 89233121QNA000191 Page 6 the sale maintenance for the five-year period of performance.

X. INTERESTED SOURCES

The Government issued a Notice of Intent (NOI)/Sole Source Synopsis (SSS) through Contract Opportunities on June 9, 2021. The NOI closed on June 24, 2021 and received zero responses. In the interim, OST continues to conduct market research to determine if there are other firms capable of meeting OST’s training requirements.

XI. STEPS TO FOSTER COMPETITION

OST will continue to research additional sources of suppliers for their requirements.
