About this file

This is a Description of Intended Single Source Purchase (PUR 7776) filed by the State of Florida Department of Transportation for a Zetium equipment service agreement with Malvern Panalytical, Inc. The Department seeks a one-year service agreement for X-ray fluorescence (XRF) equipment maintenance to support the State Materials Office's testing operations. The XRF method is the approved methodology for testing cementitious materials pursuant to FDOT's AASHTO accreditation requirements. The equipment is used to analyze materials from construction projects, source approvals, proficiency samples, and various highway construction and traffic control materials, including forensic analysis. The service agreement must provide 48-hour on-site response during normal business hours, spare parts coverage (excluding consumables, tubes, and x-ray detectors), unlimited corrective maintenance calls, phone support, labor and travel during regular business hours, two preventative maintenance calls per year, and remote support for hardware, software, and applications. The posting was made on October 6, 2026, with a final receipt date of October 27, 2026, allowing the required 15 business day posting period for prospective vendor submissions.

The estimated dollar amount for the contract is $39,711.00 for the one-year term. Malvern Panalytical, Inc. is identified as the sole intended source because it is the only authorized vendor to perform maintenance on the Zetium equipment, holding exclusive rights to proprietary software and application support necessary for identifying and correcting equipment issues. The contract contact is Destyne Grayson at the Department of Transportation's procurement office. The requestor, Melanie Sowers of the State Materials Office, identified this single-source acquisition as necessary due to the equipment's specialized nature and the vendor's exclusive authorization and technical capabilities.

Performance and/or Design Requirements (intended use, function or application, compatibility etc. requirements; reference to policy, rule, statute or other act of the Legislature, etc., as appropriate): The X-ray fluorescence (XRF) Method is the approved method to test cementitious materials as per FDOT’s AASHTO accreditation. The Department routinely tests samples from projects, source approvals, and Cement and Concrete Reference Laboratory (CCRL) proficiency samples required to maintain accreditation. Failure to perform proper maintenance on the instrument will compromise data accuracy and will also lead to delays in sample test schedules. In addition to cementitious materials, the instrument is used to analyze several materials used for highway construction and traffic control, including forensic analysis. Results are used by the Department to approve cementitious materials sources and APL products approvals. The Department requires a XRF Service Agreement for the Zetium equiment which provides the following: Efforts to provide 48 hour on site response during normal business hours, spare parts coverage (excluding consumables, tubes, and e-ray detectors), unlimited corrective maintenance calls, phone support during regular business hours, labor and travel during regular business hours, two preventative maintenance calls per year within the contract period, remote support for hardware/software and remote support for applications.

Justification for single source acquisition (what is necessary and unique about the product, service or source; steps taken to confirm unavailability of competition, as appropriate): Malvern Panalytical is the only known vendor authorized to perform maintenance on the Zetium equipment. The software is proprietary to Malvern Panalytical who has exclusive software and application support and owns necessary hardware and software to identify and correct equipment issues.
