About this file
This is a Description of Intended Single Source Purchase (PUR 7776) filed by the Florida Department of Environmental Protection (DEP), Division of Environmental Assessment and Restoration (DEAR). The procurement seeks Agilent Technologies Analytical Laboratory Instrumentation Maintenance and Repair Services, classified under UNSPSC codes 81101706 (Laboratory Equipment Maintenance) and 73171605 (Laboratory Equipment Manufacture Services). The contract term runs from July 1, 2026, through June 30, 2029, with a three-year duration. The posting date was April 13, 2026, with a deadline for receipt of vendor information on May 5, 2026, allowing the statutorily required 15 business day advertisement period. No bidders conference or site visits are mentioned in the documentation.
The estimated contract value is $457,000.00 over the three-year period. The single source justification centers on Agilent Technologies Inc.'s exclusive control over proprietary resources, including factory-recommended replacement parts, proprietary software updates, official upgrades, and service notes. The agency emphasizes that only Agilent-certified representatives possess factory-authorized training necessary to maintain these mission-critical laboratory instruments without invalidating manufacturer warranties. The procurement is statutorily supported under Sections 120.57(3) and 287.057(3), Florida Statutes, and Rule 60A-1.045, F.A.C. The intended single source vendor is Agilent Technologies Inc., located at 2850 Centerville Road, Wilmington, Delaware 19808-1610. Primary contact for the procurement is Kimberly Bowling, Purchasing Specialist Supervisor, at 850-245-2631 or Kimberly.Bowling@FloridaDEP.gov.

Performance and/or Design Requirements (e.g. intended use, function or application, compatibility, requirements; reference to policy, rule, statute or other act of the Legislature, etc., as appropriate):
The Florida Department of Environmental Protection (DEP), Division of Environmental Assessment and Restoration (DEAR), requires highly specialized analytical instrumentation to fulfill its statutory mandate under Chapter 215.422, Florida Statutes, to monitor and assess the state's surface and groundwater quality. Given the critical role the Division’s laboratory plays in providing high-quality environmental analytical services and technical guidance to state and local entities, maintaining this equipment in peak operational condition is essential for ensuring accurate, reliable, and timely data. Because Agilent Technologies instruments are uniquely

technical and sensitive, the laboratory requires that all repair, maintenance, and calibration be performed directly by Agilent, an ISO 9000-certified source.
As the Original Equipment Manufacturer (OEM), Agilent Technologies Inc. is the sole source for factory-recommended replacement parts, proprietary software updates, and official upgrades that are vital to instrument integrity. Only Agilent Technologies Inc. authorized service representatives possess the factory training and exclusive access to proprietary service notes and escalation protocols necessary to resolve complex technical issues and prevent significant equipment downtime. Furthermore, utilizing third-party providers would invalidate existing warranties and breach contract terms, risking the laboratory's ability to meet its performance expectations. Consequently, Agilent Technologies Inc. is the only authorized entity capable of providing the certified services and proprietary resources required to sustain the functionality and reliability of these essential laboratory systems.

Justification for single source acquisition (what is necessary and unique about the product, service or source; steps taken to confirm unavailability of competition, as appropriate):
Agilent Technologies, Inc. is the sole provider of the proprietary resources necessary to ensure the continued operational readiness and accuracy of these instruments. Specifically, Agilent Technologies Inc. maintains exclusive control over factory-recommended replacement parts, proprietary software updates, and official factory-recommended upgrades and service notes.
Furthermore, only Agilent Technologies Inc. certified representatives possess the factory-authorized training required to perform these specialized services. This procurement is also uniquely supported by Agilent Technologies Inc.’s proprietary escalation services, which provide the government with direct access to factory-level expertise and the authority to replace a complete instrument if deemed necessary by the manufacturer. Consequently, Agilent Technologies, Inc. is the only source capable of providing the required services to the exclusion of all others.
The Agilent Technologies Inc. chemical analysis and life sciences instruments currently in operation are highly technical, sensitive, and mission-critical systems. Due to their unique technical requirements, it is essential that all repair, maintenance, and calibration services be performed exclusively by Agilent Technologies, Inc., an ISO 9000-certified source for factory-authorized service. Maintenance performed by any entity other than an Agilent Technologies Inc.
Authorized Support Provider poses a substantial risk to the government, as it may invalidate existing manufacturer warranties and breach the terms of the standing contract proposal.
