13.501(a)(1)(ii) Sole source, including brand name, under Simplified
Procedures for Certain Commercial Items. This acquisition is using this justification format, modified to reflect that the procedures in FAR subpart 13.5 were used in accordance with 41 U.S.C. 1901 or the authority of 41 U.S.C. 1903.
5. Demonstration that the proposed contractor(s) unique qualifications or the nature of the acquisition requires use of the authority cited.
a. Name and address of the proposed contractor(s).
RehabPlus Staffing Group, Inc.
7474 Greenway Center Drive, Suite 620 Greenbelt, MD 20770 Phone 301-220-0580
b. Demonstration that the proposed contractor(s) unique qualifications or the nature of the acquisition requires use of the authority cited.
The proposed contractor for this action has the wide and specific capabilities to provide clinical occupational health support services readily throughout the Clinical West Region, and will ensure that no interruption in services would occur that would affect the large number of FOH clients and their employees.
By selecting the incumbent contractor, the expertise and knowledge the contractor has would enable the contractor to continue services uninterrupted, and without any degradation of services that FOH bases its reputation on.
Additionally, the transitional period of approximately six months would be eliminated, the now current 60-day personnel security clearance and onboarding process would be eliminated and no break in essential clinical occupational health support services to the clinics would occur. Patient care to thousands of federal agency employees would continue unimpeded and uninterrupted. The proposed contractor will deliver these services with no transitional start-up/mobilization delays, therefore eliminating performance risks and potential for schedule delays.
FOH strives to exceed our customers' expectations by providing superior services delivered efficiently and cost-effectively. An interruption of these services would impact the missions of our federal agency client base and tarnish our reputation as the occupational health provider of choice for the federal government as well as compromise our mission of improving the health, safety, and productivity of our Federal employees.
6. Description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by subpart 5.2 and, if not, which exception under 5.202 applies.
As required by FAR Subpart 5.2, the intent to sole source was posted on FedBizOps beginning January 4, 2017 for twenty (20) calendar days.
7. Determination by the Contracting Officer that the anticipated cost/price to the Government will be fair and reasonable.
Pricing for this extension will remain the same as the last pre-priced option period that ended on January 31, 2017. Pricing was determined at that time to be fair and reasonable.
8. Description of the market research conducted (see FAR Part 10) and the results, or a statement of the reasons market research was not conducted.
Market Research was completed by viewing the previous completed contract and historical data.
9. Any other facts supporting the use of other than full and open competition.
Essentially, should the current contract expire without the extension granted, FOH would not be able to provide or deliver Occupational Health and Clinical Services to our Federal clients and their employees, which would immediately impact the client agencies’ fulfilment of their missions.
10. Listing of sources, if any, that expressed, in writing, an interest in the acquisition.
Based on the results of the intent to sole source posting on FedBizOps, no sources expressed in writing an interest in this acquisition.
11. Statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the required supplies or services.
FOH has plans to continue the acquisition process to procure the same type of supplies and services. All efforts will be taken to overcome barriers for competition for future acquisitions.
