Questions for Solicitation: 75P00121R00107 Clinical Occupational Health Support Services – NCR

Revised Date: 02/16/2022

# Question Section Page No.

Answer/Response

1 The requirement that personnel in the reference be geographically dispersed in at least 3 states would be satisfied if an offeror had experience on a project in

Connecticut, Rhode Island, and Massachusetts, with a distance between facilities of 40 miles.

However, it would not be satisfied if an offeror severed multiple facilities in only two states but that spanned, e.g., 350 miles, or within a large state like

California which has no RN compact status and where facilities might be much more greatly dispersed than in the NCR and indicative that the offeror’s experience shows it can manage a program of the complexity of the

NCR requirement.

Please permit offerors show how their references meet or exceed the program size, scope, and

M.5.1 121 The three (3) state requirement in a single contract represents the minimum complexity and in FOH's experience is one of the greatest elements of complexity for any vendor to successfully perform. Although the National Capital Region only encompasses the states of Maryland, Virginia and the District of Columbia, the volume of work in this region is comparable to a three (3) state requirement.

complexity for the NCR if the facilities covered are in at least two states or one very large state.

2 As the government has selected this large requirement be competed among small businesses, to have the capability to perform, businesses under the applicable (low) size standard are going to need to bring significant capabilities to bear, and many of them will see to do so through joint ventures formed in accordance with the SBA Mentor/Protégé program.

SBA approved joint ventures are not permitted to have employees and, therefore, cannot be certified themselves by TJC. That means that the terms of the solicitation categorically disallows joint ventures the ability to receive award, because none can pass

Phase I.

Please permit joint venture offerors to “pass” the TJC portion of Phase I review if a member of the joint venturer is certified by

TJC in HCSS, and the joint

venture agreement states that the certified member(s) will perform the majority of services performed by the offeror.

3 Is the government willing to consider (accepting) Prime or

Subcontractors who are in process of obtaining their

Certification from the Joint Commission (TJC) in Health

Care Staffing Services (HCSS) and/or obtaining accreditation from the TJC in Ambulatory Care

(AC)?

L.9.3 113 Revised:

No. The Prime and any subcontractors must have their Certification from the Joint Commission (TJC) in Health Care Staffing Services (HCSS) and/or accreditation from the TJC in Ambulatory Care (AC) at time of submitting their offer. As per L.9.3, The Offeror shall provide a copy of its Certification from The Joint Commission (TJC) in Health Care Staffing Services (HCSS) and/or its Accreditation from the TJC in Ambulatory Care (AC).

4 Would the government consider 30 single spaced pages in the

Technical Volume? The compliance matrix suggests additional space will be needed to ensure proposal responsiveness.

l.9 112 L.9 has been updated to “The Technical proposal shall be limited to 30-single spaced pages total.”

6 Please confirm that it is acceptable for tables to be single space, Times New Roman, no smaller than 9 font size.

9 Did the Agency’s market research to support a set-aside determination pursuant to the

“rule of two” consider the impact of the Phase 1 requirements on the eligibility of small businesses to compete for this procurement?

If not, why not?

L.5 111 Yes. The Agency performed market research for the Phase I criteria and market research supported a set-aside determination pursuant to the “rule of two”.

10 The Phase 1 certification and experience requirements as drafted are in violation of 13 CFR 125.8(e), which provides as follows: “Capabilities, past performance and experience.

When evaluating the capabilities, past performance, experience, business systems and certifications of an entity submitting an offer for a contract set aside or reserved for small business as a joint venture established pursuant to this

Revised:

Any vendor/partner/team who provides direct-patient care staff to FOH in the fulfillment of this requirement must be TJC accredited and/or certified. For JV entities, if one of the members is TJC accredited and/or certified, then this will fulfill the TJC requirement.

Applicable sections have been updated. Please refer to section, a procuring activity must consider work done and qualifications held individually by each partner to the joint venture as well as any work done by the joint venture itself previously. A procuring activity may not require the protégé firm to individually meet the same evaluation or responsibility criteria as that required of other offerors generally. The partners to the joint venture in the aggregate must demonstrate the past performance, experience, business systems and certifications necessary to perform the contract.” The Phase I criteria are identified as pass/fail requirements and issued as definitive responsibility requirements. Sections L.9.3 and M.5.1 provide that the TJC certification/accreditation and experience requirements must be satisfied by the “offeror” as well as individually for “each proposed subcontractor, teaming partner or other workshare arrangement that has a 20% workshare or more.” As drafted, the RFP requires a protégé of a mentor-protégé joint venture to individually satisfy these requirements (in addition to the mentor and potentially other contractors on the team). This is in direct violation of SBA’s regulations. Will the Agency revise the RFP to provide that the Phase 1 criteria may be satisfied by any partner to a joint venture?

11 The Phase 1 eligibility requirements are unduly restrictive as drafted particularly in the context of a small business set aside. In addition to violating the SBA regulations, the Phase 1 requirements must be satisfied by the “offeror” as well as individually for “each proposed subcontractor, teaming partner or other workshare arrangement that has a 20% workshare or more.”

These requirements are directly inconsistent with the Agency’s statement in Section L.10.2 that the “Government encourages

teaming arrangements and partnerships of all variations in order to enhance small business opportunities and provide Offerors with flexibility in comprising a total solution to meet FOH’s needs.” Will the

Agency revise the Phase 1 requirements to be satisfied by the “offeror or proposed subcontractor, teaming partner or other workshare arrangement that has a 20% workshare or more”?

12 The Phase 1 experience relevancy requirements are unduly restrictive of competition, particularly in the context of a small business set aside. Section M.5.1 provides that each corporate experience requirement must meet all of the following criteria: “Period of Performance - Within the past 5 years;

“Locations where services provided - must be geographically dispersed in at least three (3) different states;”

Types of labor categories employed, must be registered

nurses, board certified physicians;” and “Quantities of each full and part time staff - total of 100 or more individuals.”

Particularly in the context of a small business set aside in which small businesses are more likely to rely on experience from joint venture members and/or teaming partners/subcontractors, it is unduly restrictive to require two references for each contractor performing over 20% of the workshare to meet all four relevancy criteria for each reference. Will the Agency revise the RFP to require a total of two experience references to be submitted by the “offeror or proposed subcontractor, teaming partner or other workshare arrangement that has a 20% workshare or more”?

13 The Phase 1 experience relevancy requirements are unduly restrictive of competition, particularly in the context of a small business set aside. Sections L.9.3 and M.5.1 require “offeror”

as well “each proposed subcontractor, teaming partner or other workshare arrangement that has a 20% workshare or more” to submit at least one experience reference “for an occupational health program.” Will the Agency revise the RFP to require a total of one experience reference “for an occupational health program” to be submitted by the “offeror or proposed subcontractor, teaming partner or other workshare arrangement that has a 20% workshare or more”?

14 The NCR includes only two states (Maryland and Virginia) and the District of Columbia, but the RFP requires experience references for relevancy to demonstrate performance “in at least three (3) different states.”

Will the Agency clarify if it interprets the District of

Columbia as a state?

M.5.1 121 Revised:

Yes, the agency does consider the District of Columbia as a state.

15 Please confirm that past performance references may also be submitted from individual members of a joint venture and

L.11 118 As per section L.11, Past performance references can be for the offeror, predecessor companies, key personnel who have relevant experience and/or subcontractors that will perform major or critical aspects of the requirement when such information is relevant to the acquisition.

evaluated as relevant consistent with 13 CFR 125.8(e).

16 The RFP provides for a reasonableness analysis but does not identify a price realism evaluation. However, the RFP provides For a price to be reasonable, it must represent a price to the government that a prudent person would pay when consideration is given to prices in the market.” As written, this provides that a proposed price must not be higher or lower than what a prudent person would pay.

Will the Agency revise Sections

M.7 and M.3.7 to provide: “For a price to be reasonable, it must not exceed the price to the government that a prudent person would pay when consideration is given to prices in the market”?

M.7, M.3.7 124 No. IAW M.7 “An Offeror’s price may be evaluated, using one or more of the techniques defined in FAR 12.209, in order to determine reasonableness. IAW FAR 15.403-1(b), the Government may require submission of information other than cost or pricing data to the extent necessary to evaluate price criteria for reasonableness. When adequate price competition exists, generally no additional information is necessary to determine the “reasonableness of price.

17 Will the Government consider removing the Executive

Summary from the 30 page limit for the Technical Volume?

L.9, L.9.1 112-

No. L.9 has been updated to “The Technical proposal shall be limited to 30-single spaced pages total.”

18 Will the Government allow tables and figures to be single- spaced?

L.9 112 Yes. L.9 has been updated to “Tables and figures can be single spaced Times New Roman and no smaller than 9 point font.”

19 Will the Government consider removing the Joint Commission Certification/Accreditation copy from the 30 page limit for the Technical Volume? If not, can the copy be placed in the Technical Appendix?

L.9, L.9.3 112, Revised:

Yes. The technical appendices may include transcripts, resumes, and letters of commitment, actual TJC certifications and/or accreditation artifacts.

Applicable section has been updated. Please refer to revised solicitation.

20 Can the Government confirm that the executed Consent Letters and Client Authorization Letters can be placed in the Technical Appendix?

L.9.3 114-

Confirmed.

21 Can the Government confirm that a Past Performance Questionnaire is only required for references that do not have information available in CPARS?

L.11 118-

Revised:

Yes.

L.11 “For contracts with the Federal Government, indicate whether the government has evaluated the contractor and past performance information is available through CPARS or whether the reference will be providing information via the past performance questionnaire.”

22 Is the required PRN pool size set at 100? Given that the PRN minimum requirement is to work at least (4) hours per month, will the Government consider scaling this baseline number down (decreased ad-hoc demand, clinic closures, reduced clinic staffing requirements) or scaling the number up ( increased ad-hoc

C.9.3 26 The required PRN pool size is set at 100.

No. At this time 100 is the minimum number of PRN the Government has assessed to be able to perform the functions of a PRN as described in the Performance Work Statement (PWS). This number may increase and/or decrease during the life of the contract as the Government experiences growth and/or reduction of work within the

NCR.

new clinic starts) in response to requirement changes that occur during the life of the contract?

23 C.1 states that “FOH maintains sole responsibility for consulting with Federal Agencies”. If there is a Federal Agency work site “constraint” that is adversely impacting vendor staffing/sustainment of staffing in that work site, we expect that we would document this constraint for FOH review and action. If for any reason FOH is unable to effectively resolve this constraint within the noted Federal Agency work site, will the vendor be relieved from performance penalties associated with this problematic work site until resolution between FOH and the owning Federal Agency is achieved (and documented back with the vendor)?

C.1 7 The Government will assess each situation on a case by case basis. If the contractor believes that performance penalties should be waived, then a formal waiver request would be appropriate for the Contractor to submit to the Government and assessed on a case by case basis.

24 Can the Government provide a monthly schedule of the types of quizzes our employees will be required to complete? If not, can the Government provide links for

the actual quizzes so that the contractor can assist the ACMs in the process of giving staff time to study in advance and be able to complete in a timely process?

25 Would the government allow to show geographically disbursement to include one (1) state vs three (3) if the contract included multiple locations/facilities within the said state?

M.5.1 121 The three (3) state requirement in a single contract represents the minimum complexity and in FOH's experience is one of the greatest elements of complexity for any vendor to successfully perform. Although the National Capital Region only encompasses the states of Maryland, Virginia and the District of Columbia, the volume of work in this region is comparable to a three (3) state requirement.

26 “At any point during the life of the contract, the Contractor may be issued a task order to provide

PerSCs to another SPS(s) in a different region should FOH request it.” Can the government advise if this has been a previous situation on the current contract and if so, provide historical information on how many task orders and in what regions were previously included in the NCR contract?

C.2 8 The current NCR staffing contract is not an IDIQ contract and so this has not occurred.

27 Would the government consider allowing a joint venture to “pass” the TJC review (Phase 1) if a

TJC accredited and/or certified. For JV entities, if one of the members is TJC accredited and/or certified, then this will fulfill the TJC requirement.

28 Can the government please advise if there are currently contract positions that require Secret/Top Secret personnel clearances? Does the offeror need to have facility clearance in place at time of award?

C.4/J.4 11 No. There are not currently any Secret/Top Secret personnel clearances at this time.

No. a facility clearance is not required at time of award.

29 Is submitting a summary section acceptable for the Past

Performance Volume? If so, can you please advise the total page count for the volume?

L.11 118 No. L.11 states a maximum of three performance references limited to two pages.

30 Is there a preference for the proposal volumes be submitted in

PDF or Word format?

L.7 111 Revised:

Preference is PDF except for Attachment 1 – Pricing worksheet. Applicable section has been updated. Please refer to revised solicitation.

Applicable section has been updated. Please refer to revised solicitation.

46 There is a large disparity between incentives and disincentives. We understand that the Government has high expense associated with turnover. Contractors do as well, including but not limited to

C11.2 34-44 The government will not be revising any stated incentives/disincentives as stated in the solicitation.

similar recruitment, credentialing, orientation, payroll expenses, etc that have already been expensed at the time of turnover. Such disincentives with the present terms compound upon these costs that contractors also incur and is somewhat counterintuitive to successful ongoing performance

– by reducing a Small Business’s invoices in this way, the Government may limit the ability of any small business awardee from making appropriate corrective action and providing successful ongoing performance.

Further, it takes as little as a few turnovers, reflecting approximately 1-2% of staff, to exceed the total incentive for a 12 month period of turnover below

9%.

The additional disincentives that compound daily for credentialing and privileging delays further compounds upon the above statements. There is also no inventive for hitting the goal.

Reviewing down to the hours of operation, a $100 deduction per hour is exorbitant and will exceed bill rates for many HCPs on this contract. We also see again that it takes only 101 hours (a fractional percentage of the total ordering requirement) to exceed the entire 6 months incentive for fill above 98%.

Similar comments can be extrapolated down the remaining list of disincentives. Many of these items are contradictory – where we can be meeting acceptable performance for the incentive yet still receive deductions on the same objective.

We request that the Government reconsider this type of process and the amounts and how such damages are applied.

47 Are such incentives/disincentives and performance requirements calculated on a per task order basis, or on the consolidated contract effort?

C11.2 34-44 Incentives/disincentives are assessed at the task order level.

48 Recommend increasing Technical page count to 50 pages double spaced to enable appropriate documentation of processes and requested information.

L9 112 No. Page limit will remain at 30 pages.

49 Can the Government please confirm that proposal introduction and appendixes do not count towards page count.

L9.1 and 9.2 113 Confirmed.

50 Many facilities in which we support follow TJC principles but are not TJC accredited. As the contractor. This included DoD and other federal facilities. Since TJC accreditation requires the contractor to follow associated protocol regardless of whether the facility itself is certified, will the Government consider revising the requirement currently stating that the 2 corporate references to be TJC accredited facility?

L9.3 113 Revised:

Any vendor/partner/team who provides direct-patient care staff to FOH in the fulfillment of this requirement must be TJC accredited and/or certified. For JV entities, if one of the members is TJC accredited and/or certified, then this will fulfill the TJC requirement.

51 Many contracts in which we support include appropriate staff quantities/labor categories and include occupational health considerations yet are not specifically occupational health programs. Will the Government consider revising the requirement currently stating that the 2 corporate references must be in support of occupational health programs?

L9.3 113 No. As per L.9.3 and M.5.1, two (2) corporate references of past or current experience, self-performed within the past 5 years, demonstrate the Offeror’s capability to staff a health program of similar scope, size and complexity described in the PWS where at least one reference is for an occupational health program; and Revised:

L9.3 114 Confirmed.

53 Can the Government confirm if there is a specific line of credit amount being sought to confirm financial capability. For example 2 months of service calculated at

L10.4 117 There is not a specific line of credit amount being sought for the government to assess financial capability. The requested information on financial capability is to assist the Contracting Officer in making the responsibility determination, specifically FAR 9.104-1(a).

54 Can the Government please clarify if both prime and subcontractor each need 2 corporate references? For example, a prime with 1 subcontractor performing 20%+ would be required to submit 4 total corporate references, 2 from the prime and 2 from the sub?

M5.1 121 As per M.5.1, two (2) corporate references of past or current experience, self-performed within the past 5 years, demonstrate the Offeror’s capability to staff a health program of similar scope, size and complexity described in the PWS where at least one reference is for an occupational health program; and Revised:

55 Referencing the required size, scope, and complexity of the

M5.1 121 The Government will not be revising the requirement. The Government has determined that the requirements are not performance, it is unlikely that any small business will have 2 references, that meet these requirements. If such were the case, they would likely not be small. Additionally, outside of FOH’s larger occupational health requirements, other agencies like the DoD, NASA, and National Guard issue requirements by a single site. Thus having geographic dispersion across multiple states on a single requirement is very rare if not non-existent. Recommend revision of these requirements to a much smaller scale appropriate for a small business procurement, while maintaining a relevant scope of labor categories and a scale of a single site of service as contemplated under this requirement.
