About this file

This document is a Request for Information (RFI) regarding the use of Project Labor Agreements (PLAs) for a federal construction project. The first page outlines the federal policy on PLAs, specifically Executive Order 14063, which requires agencies to use project labor agreements in large-scale construction projects to promote economy and efficiency. The subsequent pages contain a detailed questionnaire inviting construction firms to provide feedback on PLA implementation for the specific project.

The RFI asks construction companies to respond to multiple questions, including: local PLA usage, skilled labor shortages, scheduling requirements, potential benefits and drawbacks of PLAs, and willingness to submit a proposal under a PLA. Respondents are also requested to provide detailed information about their recent projects, such as project name, location, description, cost estimates, completion timeline, number of craft trades, PLA usage, and any challenges encountered. The document seeks comprehensive input from the construction community to inform decision-making about PLA implementation for the referenced project.

Project Labor Agreement:

A Project Labor Agreement (PLA) is defined as a pre-hire collective bargaining agreement with one or more labor organizations that establishes the terms and conditions of employment for a specific construction project and is an agreement described in 29 U.S.C. 158(f). Federal Acquisition Regulation (FAR) 22.503 Policy provides that:

(a) Executive Order 14063, Use of PLA’s for Federal Construction Projects, requires agencies to use project labor agreements in large-scale construction projects to promote economy and efficiency in the administration and completion of Federal construction projects.

(b) When awarding a contract in connection with a large-scale construction project (see 22.502), agencies shall require use of project labor agreements for contractors and subcontractors engaged in construction on the project, unless an exception at 22.504(d) applies.

Refer also to FAR 52.222-33 Notice of Requirement for Project Labor Agreement and FAR 52.222-34 Project Labor Agreement.

The construction community is invited to comment on the use of PLAs pertaining to this project.
