Presolicitation Notice Summary

This is a Presolicitation Notice issued by the Department of Veterans Affairs, Network Contracting Office (NCO) 7, announcing the agency's intent to sole source a construction period services (CPS) contract to APOGEE CONSULTING GROUP, P.A. for project 619A4-24-102, "Replace Roofs Buildings 19, 20, 50, 51 and 62, AE CPS RENEWAL" at the Central Alabama Veterans Healthcare System (CAVHCS). The solicitation number is 36C24726R0042, with responses due by February 27, 2026 at 1:00 PM ET. The anticipated contract award date is on or about March 20, 2026. This is a firm-fixed price contract following a previously descoped contract (36C24723C0152) and represents a follow-on to earlier competed services under Solicitation 36C24723R0061.

The required engineering services include construction submittal reviews, responses to contractor Requests for Information (RFIs), execution of design changes and potential design changes, and attendance at site visits and construction-related meetings to ensure proper execution of design documents. The notice explicitly states this is not a request for competitive proposals and no solicitation will be issued on SAM.gov; however, SAM-registered firms meeting the requirements may submit capability statements or proposals by the response deadline explaining how they could provide equal CPS services as the designer of record. The Government reserves discretion to conduct competitive procurement based on market research from responses received. The NAICS code is 541330 with a $25.5 million size standard, and there will be no reimbursement for response development.

DESCRIPTION

NOTICE OF INTENT TO SOLE SOURCE

The Department of Veterans Affairs, Network Contracting Office (NCO) 7 intends to award a contract in accordance with RFO 6.103-5, Authorized or required by statute and VAAR 806.302-570. This action is in accordance with 38 U.S.C. 8127 and VAAR 819.7008. NCO 7 intends to negotiate and award to sole/single source, firm-fixed price contract for construction period services (CPS) to APOGEE CONSULTING GROUP, P.A. The Project number and title is as follows: 619A4-24-102 - Replace Roofs Buildings 19, 20, 50, 51 and 62, AE CPS to be completed at the Central Alabama Veterans Healthcare System (CAVHCS).

The current design contract is 100% complete but no longer has CPS as part of the scope.

The requirement is to provide engineering services for post award activities associated with

Presolicitation Notice the construction contract awarded for subject design project. The intent is to retain the A-E designer of record (i.e., Apogee Consulting Group, P.A.) for the Construction solicitation and for the duration of the Construction contract. This acquisition is anticipated to take place on or about 3/20/2026. This proposed contract is a follow-on of a previously descoped contract, 36C24723C0152. These CPS services were previously competed under Solicitation 36C24723R0061. Sole sourcing to the designer of record (DOR) will allow the Government to decrease lead times for award of the Construction project and ensure the DOR is readily available to provide expertise in relation to their own Design documents.

Required AE CPS services include, but are not limited to, construction submittal reviews, responses to contractor Requests for Information (RFI’s), execution of design changes and potential design changes, and attendance at necessary site visits and construction related meetings in order to ensure the DOR’s design is properly executed, adjusted, and interpreted in order to deliver a complete and useable facility consistent with original design intent.

THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS, no solicitation will be issued on SAM.gov, and no response to this notice is requested. However, any System for Award Management (SAM) registered firm that can meet the requirement may provide a capability statement or proposal which will be considered by the Contracting Officer and should include an explanation how the contractor would be able to complete the same CPS services as efficiently and effectively as the DOR. Any prospective design firm will need to possess working knowledge of all issues that may arise and will assume the liabilities associated with all aspects of the design. Responses must be provided by 2/27/2026 at 1:00pm ET.

A determination by the Government not to compete this procurement will be based on market research including responses to this notice. It is within the Government's sole discretion to decide whether the information received in response to this notice warrants development of an alternative approach. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. There will not be reimbursement to any firm for developing a response to this notice. The NAICS for this requirement is 541330 and the size standard is $25.5M.
