About this file

This is a Presolicitation Notice and Notice of Intent to Sole Source issued by the Department of Veterans Affairs, VISN 7 Network Contracting Activity for a sole-source architect-engineer services contract.

The VA intends to award a firm-fixed-price contract to Mills-Conoly Engineering, P.C., Montgomery, Alabama, for construction-period architect-engineer services related to Project 619-25-902, Mitigate Critical Electrical Hazards, at the Central Alabama Veterans Health Care System (CAVHCS) Tuskegee and Montgomery campuses. The contemplated services include technical support during construction solicitation, responses to requests for information, review of contractor submittals and shop drawings, technical review of changes and change proposals, design clarifications and revisions, site visits and construction inspections, final inspection support, and preparation or updating of as-built design documentation and BIM information. The contract period is anticipated to be approximately 365 calendar days running concurrently with the construction project. The solicitation number is 36C24727R0003, with a response deadline of October 22, 2026, at 12:00 PM Eastern Time and an anticipated award date of November 30, 2026. The contract value is above $25,000 and at or below the Simplified Acquisition Threshold. Mills-Conoly's designation as Designer of Record (DOR) for the existing design justifies the sole-source justification, as using another firm would require costly independent review and validation of the existing design. Interested firms may submit capability statements by the response deadline to Gregory.Snyder@va.gov; pricing is not required at this stage. The NAICS code is 541330 (Engineering Services) with a small business size standard of $25.5 million, and the Product Service Code is C1DA.

DESCRIPTION

PRESOLICITATION NOTICE - NOTICE OF INTENT TO SOLE SOURCE

Purpose and authority. The Department of Veterans Affairs (VA), Network Contracting Office (NCO) 7, issues this presolicitation notice and architect-engineer public announcement in accordance with RFO 5.101 and RFO 36.102-1. Subject to consideration of timely responses to this notice, the VA intends to solicit and negotiate on a sole-source basis with Mills-Conoly Engineering, P.C. under 41 U.S.C. 3304(a)(1), as implemented by RFO 6.103-1(b), Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.

Intended source. Mills-Conoly Engineering, P.C., Montgomery, Alabama. Mills-Conoly is the Designer of Record (DOR) for the existing construction design associated with Project 619-25-902, Mitigate Critical Electrical Hazards.

Requirement. VA requires architect-engineer construction-period services and related solicitation support for Project 619-25-902 at the CAVHCS Tuskegee and Montgomery campuses. The contemplated services include technical support during the construction solicitation, responses to requests for information and technical questions, review of contractor submittals and shop drawings, technical review of changes and change proposals, design clarifications and revisions when required, site visits and construction inspections, final inspection support, and preparation or updating of as-built design documentation and BIM information, as applicable. The anticipated contract type is firm-fixed-price, with an anticipated period of performance of approximately 365 calendar days from the start of the Construction project running concurrently.

Basis for proposed noncompetitive action. Mills-Conoly prepared and took professional responsibility for the existing design that will be used for the construction acquisition. The contemplated construction-period services will require recurring interpretation and clarification of that design, review of contractor RFIs and submittals against the design intent, evaluation of proposed changes, and preparation or review of design revisions during construction. Although other architect-engineer firms may possess general engineering qualifications, a successor firm would first need to perform sufficient independent review and validation of the existing design to establish a professional basis for interpreting or modifying the design and for assuming responsibility for its own technical determinations. VA's current requirement is for construction-period support of the existing design, not for a separate successor-design validation or redesign effort. The VA therefore presently anticipates that use of another firm would result in material duplication of professional engineering effort and transition impacts that would not be required if the DOR performs the services.

Acquisition procedures and anticipated award. This proposed contract action is valued above $25,000 and at or below the Simplified Acquisition Threshold. If, after consideration of responses to this notice, the Government determines that the basis for other than full and open competition remains supported, the VA intends to issue a solicitation directly to Mills-Conoly Engineering, P.C. and negotiate a firm-fixed-price architect-engineer contract in accordance with RFO Parts 6 and 36. No competitive solicitation is available at this time.

The anticipated award date is approximately 11/30/2026.

Trade agreements. Not applicable.

Technical data availability. The complete design package is not being provided with this notice. A firm that requires additional technical information to prepare a meaningful capability response may request available and releasable information from the Contracting Officer at Gregory.Snyder@va.gov. The request should identify the specific information needed.

Construction equitable-adjustment information. Not applicable.

Consideration of responsible sources. THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS AND DOES NOT CONSTITUTE A SOLICITATION. However, all responsible sources may submit a timely capability statement, proposal, or quotation, as appropriate, and the Government will consider the information received. The Government is requesting capability information at this stage; pricing is not required for purposes of responding to this notice. Any prospective design firm will need to possess working knowledge of all issues that may arise and will need to assume the liabilities associated with all aspects of the design.

Capability response content. At a minimum, an interested firm should provide: (1) legal business name, address, UEI, CAGE code, and confirmation of active SAM registration; (2) business size under NAICS 541330 and applicable socioeconomic status, including current SBA VetCert SDVOSB/VOSB status if applicable; (3) professional engineering qualifications, registrations, and relevant construction-period services experience; (4) a description of experience interpreting, revising, or assuming responsibility for design documents prepared by another architect-engineer; (5) a specific explanation of the review and validation the firm would perform before interpreting or modifying the existing Mills- Conoly design, including the anticipated level of effort and transition schedule; (6) evidence of current capacity to perform the required services within the contemplated performance period; and (7) any additional Government information the firm believes is necessary to substantiate its capability. A current SF 330, Part II may be included to support the response.

Qualification requirements. No separate formal qualification requirement under RFO Part 9 has been established for this notice. Any firm considered for award of architect-engineer services must nevertheless be legally permitted to practice the applicable architecture or engineering profession and must satisfy applicable professional registration requirements under RFO Part 36.

Response deadline and submission. Responses must be received no later than 10/22/2026 at 12:00pm ET and must be submitted electronically to Gregory.Snyder@va.gov. The subject line should reference 36C24727R0003 and Project 619-25-902. Telephone responses will not be accepted.

Government consideration of responses. The Government will evaluate timely information received in response to this notice before making its final acquisition determination. If a response demonstrates that another responsible source can satisfy the Government's requirement, the Government will reassess the contemplated acquisition strategy. A decision to proceed with the proposed noncompetitive action will be based on the complete acquisition record, including market research and responses to this notice.

The Government will not reimburse respondents for costs incurred in preparing or submitting information. This notice does not obligate VA to issue a solicitation or award a contract.

Codes. NAICS 541330 - Engineering Services; small business size standard: $25.5 million.
