(Rev. 08/18)

U.S. Department of Energy Consolidated Service Center

LIMITED-SOURCES JUSTIFICATION

(Above Simplified Acquisition Threshold (SAT))

FAR PART 8

I. CONTRACTING ACTIVITY

Requirement Originating Organization: U.S. Department of Energy (DOE) Identification Number: Order No. 89243121FSC400272

Contracting Officer: Aaron Fehl Phone: 865-576-4173

The Consolidated Service Center (CSC) DOE plans to contract by means other than full and open competition. This document sets forth the justification and approval for restricting its consideration to one source in accordance with Federal Acquisition Regulation (FAR) 8.405-6 Limiting Sources.

II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING APPROVED

This short-term task order will be awarded to the incumbent contractor, RER Solutions, Inc. (RER), as a sole-source, logical follow-on under General Services Administration (GSA) Federal Supply Schedule contract No. GS-00F-233CA, to serve as a bridge between the expiration of order no. DE- DT0010287 and the award of a task order for substantially similar services under GSA’s One Acquisition Solution for Integrated Services (OASIS) contract. Acquisition planning is in process for a new task order under OASIS. The period of performance of the bridge contract will be from March 30, 2021 through December 29, 2021, with an option to extend services for up to six months thereafter. The contract type for this task order is Time-and-Materials.

III. DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED TO MEET THE AGENCY’S

NEEDS (including estimated value)

The purpose of this task order is to acquire professional and business management support services to assist leadership and management in carrying out day to day operations and will cover a broad range of professional and technical services to include project management and management analysis support, human resource and administration, and technical and consulting services. The total task order anticipated value is $2,264,678

IV. AUTHORITY AND SUPPORTING RATIONALE FOR LIMITING SOURCES AND

DEMONSTRATION OF THE CONTRACTOR'S UNIQUE QUALIFICATIONS TO

PROVIDE THE REQUIRED SUPPLY/SERVICE, IF APPLICABLE

FAR 8.405-6 requires an ordering activity to justify its actions when restricting consideration of schedule contractors to fewer than required in FAR 8.405-1 or 8.405-2.

FAR 8.405-6(a) (1) (i) (C), provides that “in the interest of economy and efficiency, [an agency may award] a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering https://www.ecfr.gov/cgi-bin/retrieveECFR?gp=&SID=57392fcb3ac80797108c567237e035a4&mc=true&n=sp48.1.8.8_14&r=SUBPART&ty=HTML#se48.1.8_1405_66 https://www.ecfr.gov/cgi-bin/retrieveECFR?gp=&SID=57392fcb3ac80797108c567237e035a4&mc=true&n=sp48.1.8.8_14&r=SUBPART&ty=HTML#se48.1.8_1405_61 https://www.ecfr.gov/cgi-bin/retrieveECFR?gp=&SID=57392fcb3ac80797108c567237e035a4&mc=true&n=sp48.1.8.8_14&r=SUBPART&ty=HTML#se48.1.8_1405_62 https://www.ecfr.gov/cgi-bin/retrieveECFR?gp=&SID=57392fcb3ac80797108c567237e035a4&mc=true&n=sp48.1.8.8_14&r=SUBPART&ty=HTML#se48.1.8_1405_66

(Above Simplified Acquisition Threshold (SAT)) procedures.” Furthermore, the original order must not have been previously issued under sole-source or limited-sources procedures.

The initial order was established in accordance with applicable FSS ordering procedures, and was not issued under sole-source or limited-sources procedures. Awarding a logical follow-on is in the interest of economy and efficiency because it avoids duplicating costs and efforts, and the potential risks associated with transitioning the work for such a short period to another contractor while completing the planned competition.

V. DETERMINATION BY THE ORDERING ACTIVITY CONTRACTING OFFICER THAT

THE ORDER REPRESENTS THE BEST VALUE CONSISTENT WITH FAR 8.404(d)

This task order will be awarded to RER Solutions under Contract No. GS-00F-233CA. Given the bridge order will be awarded against the same FSS that was in place during the original award to RER, the labor rates for this short-term award are considered to be fair and reasonable. Additionally, since the scope of work of the bridge contract is essentially a continuation of the services that are currently provided by RER under order no. DE-DT0010287, the Government’s previous determination that RER’s level of effort and the mix of labor proposed to perform the subject scope of work represented the best value to the Government remains unchanged.

VI. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE RESULTS, OR

EXPLAIN WHY MARKET RESEARCH WAS NOT CONDUCTED

Market research was not conducted for this acquisition because the agency is not required to do so prior to exercising the authority granted to it under FAR 8.405-6(a)(1)(i)(C) to establish a logical follow-on order.

VII. OTHER FACTS SUPPORTING THE JUSTIFICATION

Not applicable

VIII. ACTIONS THE AGENCY MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS

THAT LED TO RESTRICTED CONSIDERATION BEFORE ANY SUBSEQUENT

ACQUISITIONS OF THE SUPPLIES OR SERVICES

The Government is currently preparing to issue a solicitation for this requirement as a Woman Owned Small Business Set Aside. However, due to the fact that the CSC has recently undergone a reorganization, contracting personnel turn-over, and a re-assignment of workload, the timeline for conducting and ultimately awarding a follow-on contract for this requirement has been adversely impacted. Recognizing that solicitation efforts are underway, but that there will likely be a gap between the expiration of the task order under which these services are currently being provided and

IX. APPROVING OFFICIAL’S DETERMINATION IDENTIFYING APPLICABLE

CIRCUMSTANCE FOR LIMITING THE SOURCE (for justifications under FAR 8.405-6(a) (1))

Awarding a task order to the incumbent contractor, RER, for a nine-month period of performance, is an economical and efficient choice. Changing contractors in the midst of a contract competition would place the Agency in an untenable position considering the critical and mandatory services provided to DOE and would pose unnecessary risk to mission continuity, and cannot be justified.

Instead, permitting the incumbent contractor, which possesses the requisite institutional knowledge, to continue the work it began nearly five years ago would conserve time, reduce costs associated with transitioning contract responsibility, and eliminates the risk of unacceptable delays in service, thus making the award to the incumbent an economical and efficient choice to allow the Agency to complete its ongoing acquisition activities for the intended long-term award.
