JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

FAR PART 6

I. IDENTIFICATION OF AGENCY AND CONTRACTING ACTIVITY

Requirement Originating Organization: The Office of Scientific and Technical Information Identification Number (Purchase Request/Solicitation Number): TBD Contracting Officer: Mary C. Halterman Phone: 865‐576‐3356

The U.S. Department of Energy (DOE) Office of Scientific and Technical Information (OSTI) plans to contract by means other than full and open competition. This Justification for Other than Full and Open Competition (JOFOC) establishes the justification and approval for the use of one of the exceptions to full and open competition allowed by 41 U.S.C. 3304 as promulgated by Federal Acquisition Regulation (FAR) Part 6.302.

II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING APPROVED

Establish a follow‐on contract to renew an institutional subscription for periodicals published by the American Institute of Physics. Contract type will be a firm‐fixed price for a one‐year base period and three one‐year option periods.

The American Institute of Physics subscription includes the following 29 periodicals:

AIP Select:

Applied Physics Letters Chaos Journal of Applied Physics Journal of Chemical Physics Journal of Mathematical Physics Physics of Fluids Physics of Plasmas Physics Today Review of Scientific Instruments

American Journal of Physics

Journal of Physical and Chemical Reference Data

AVS All:

AVS Quantum

ScienceBiointerphases Journal of Vacuum Science and

Technology A Journal of Vacuum Science and

Technology B Surface Science Spectra

Access Only Journals:

AIP Conference Proceedings Applied Physics Reviews Biomicrofluidics Biophysics Reviews Chemical Physics Reviews

Chinese Journal of Chemical Physics

Journal of Laser Applications (includes LIA Conference Proceedings)

Journal of Renewable and Sustainable Energy

Journal of Rheology Journal of the Acoustical Society of America Journal of the Physical Society of

Japan Low Temperature Physics The Physics Teacher

III. DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED TO MEET THE AGENCY’S NEEDS

DOE/OSTI requires online access to the American Institute of Physics periodicals listed in Section II above.

DOE/OSTI is required to provide Office of Science (SC) management and staff electronic access to key peer‐ reviewed scientific journals. Access to the journals is restricted to the Office of Science Program Offices, Laboratories and partners via a direct link provided by the publisher. Access is not publicly accessible.

The anticipated award consists of a one‐year base period and three one‐year option periods. The DOE ICPT agreement ends in 2024 so the publisher could only offer three option years. The period of the base year subscription is January 1, 2021 through December 31, 2021. The total estimated contract cost is $315,756.00. The applicable NAICS Code is 511120 ‐ Internet Periodical Publishers, with the size standard of 1,000 employees.

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION

41 U.S.C. 3304, as implemented by FAR 6.302 (FAR 6.303‐2(b)(4)).

V. DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE QUALIFICATIONS OR THE NATURE OF THE

ACQUISITION REQUIRES USE OF THE AUTHORITY CITED

These periodicals provide highly specialized research information for DOE scientists and researchers. The periodicals provided by American Institute of Physics are copyrighted and proprietary. The periodicals include published articles that contain work performed by the Department of Energy. Access to this information is essential to program managers to monitor what research has been performed so there is no duplication in research efforts. Only American Institute of Physics can deliver immediate electronic access to the most recent and previous issues of the periodicals. Per FAR 6.302‐1, Only One Responsible Source and no other supplies or services will satisfy agency requirements. No other publishers are authorized to provide online access to the periodicals and there are no other known sources with equivalent capabilities. Without access to these periodicals there is the potential for DOE scientists and researchers to duplicate work that has already been completed resulting in substantial duplication in costs that would not be recovered through competition.

VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS MANY POTENTIAL SOURCES AS IS PRACTICABLE, INCLUDING WHETHER A NOTICE WAS OR WILL BE PUBLICIZED AS REQUIRED BY FAR

SUBPART 5.2 AND, IF NOT, WHICH EXCEPTION UNDER FAR 5.202 APPLIES

Due to the propriety control of the periodicals, no equivalent periodicals can meet the agency’s requirements. No other publisher can provide online access to the specified periodicals. Therefore, there is no anticipated area of competition. A notice of intent to issue a sole‐source award will be posted on Sam.gov.

VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO THE GOVERNMENT WILL BE

FAIR AND REASONABLE

The total estimated contract cost is $315,738.00. The price for this contract action will be fair and reasonable based on historical pricing and reliance on subject matter expertise. The 2021 subscription rate of $75,470.00 includes a 6% increase from the 2020 rate of $71,198.00. The price increase for the three one‐year option periods is 3%. The institutional rate offered to DOE is discounted 23% from the published annual list price of $98,277.00 (total if purchased separately). Certified cost or pricing data will not be required per FAR 15.403‐1 (b) (3).

VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE RESULTS

Market research was conducted in accordance with FAR Part 10 and included Internet searches for publishers that could provide the required periodicals or equivalent periodicals. No other publisher was located that could provide online access to the required periodicals and no equivalent periodicals were located.

IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN COMPETITION SUCH AS:

a. Explanation of why technical data packages, specifications, engineering descriptions, statements of work, or purchase descriptions suitable for full and open competition have not been developed or are not available:

See Section V above.

b. When FAR 6.302‐1 is cited for follow‐on acquisitions as described in 6.302‐1(a)(2)(ii), an estimate of the cost to the Government that would be duplicated and how the estimate was derived:

N/A

c. When FAR 6.302‐2 is cited, data, estimated cost, or other rationale as to the extent and nature of the harm to the Government:

N/A

X. A LISTING OF THE SOURCES, IF ANY, THAT EXPRESSED, IN WRITING, AN INTEREST IN THE ACQUISITION

See Section VIII above.

XI. STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE ANY SUBSEQUENT ACQUISITION FOR THE SUPPLIES OR SERVICES REQUIRED:

DOE/OSTI will continue to conduct market research prior to awarding any follow‐on actions to insure if any other publishers can be used to meet the agency requirement for access to the required journals.
