About this file
This is a Louisiana Preference Note to Bidder form issued by the State of Louisiana Department of Transportation and Development (DOTD) for procurement of extruded aluminum panels measuring 12 inches by 36 feet. The document serves as the official mechanism through which bidders may claim eligibility for Louisiana preference consideration under Louisiana Revised Statutes 39:1604(H) & (I). Bidders must complete and submit this form prior to bid opening to have their preference claim considered; submissions on alternative documents or after bid opening will not be accepted. The preference applies only to products produced, manufactured, or assembled within Louisiana and only to bidders whose workforce comprises a minimum of 50 percent Louisiana residents.
To qualify for the 10 percent Louisiana preference, bidders must meet three conditions: the cost of Louisiana-produced items cannot exceed the cost of out-of-state items by more than 10 percent; the vendor must agree to sell Louisiana items at the same price as the lowest bid; and in cases of multiple Louisiana bids within the 10 percent threshold, the lowest bidder on Louisiana items may accept the price of the lowest overall bid. The form requires bidders to specify whether they claim the preference, confirm their Louisiana workforce composition, identify applicable line items, and detail the specific Louisiana locations where products are produced, manufactured, or assembled. Definitions provided establish that "assembled" requires all component parts be put together at an assembly plant within Louisiana, while "manufactured" refers to making products from raw materials, and other terms address processing, production, and cultivation activities.
