About this file
This file comprises the Prebid Meeting Minutes and Addendum No. 1 for the KOS972821A Nutrient Reduction Wetland Project (Bid 26-01), issued by the Iowa Department of Agriculture and Land Stewardship, Division of Soil Conservation and Water Quality, in cooperation with Ducks Unlimited. The project involves comprehensive wetland construction services in Kossuth County, Iowa, including site stripping and preparation, excavation (6,962 cubic yards), earthfill operations (4,146 cubic yards across three categories), steel sheet piling installation (1,444 square feet), drainage tile investigation and installation (515 linear feet of various pipe types), water control structure installation, riprap placement (548 tons), concrete grouting (108 cubic yards), topsoil placement (680 cubic yards), and seeding of 17 acres across two phases. The prebid meeting was held on April 23, 2026, at the USDA-NRCS office in Algona, Iowa. Sealed bids must be submitted through the Iowa Management of Procurement and Contracts System (IMPACS) by 3:00 PM on May 20, 2026, with the public bid opening occurring immediately thereafter via Microsoft Teams. All construction work except seeding must be completed by December 31, 2026; structure seeding is due by May 15, 2027, and buffer seeding by June 30, 2027. Construction cannot commence until after August 1, 2026, due to federal migratory bird nesting season restrictions, and tree removal cannot occur until after October 1, 2026, to protect endangered bat species.
Bidders must submit a 10 percent proposal guarantee (bid bond) and a notarized affidavit confirming examination of contract documents and absence of collusion. A Performance Bond equal to 100 percent of the contract price is required within 14 days of the Notice-of-Award. Materials are exempt from Iowa sales and use tax, which bidders should account for in pricing submissions. Liquidated damages are assessed at $175.00 per calendar day for failure to complete all work except seeding by December 31, 2026, and $125.00 per calendar day for seeding work delays beyond specified deadlines, reflecting additional administrative, design, inspection, and environmental costs. Payment will be made monthly at 97 percent of completed work value, with retainage held for 30 days following final acceptance. The project is a unit price contract with 26 bid items; Addendum No. 1, issued May 8, 2026, updated the topsoil placement quantity to 680 cubic yards and clarified earthwork estimates and construction notes. Technical questions regarding plans and specifications must be directed to engineer Andrew Schippers (aschippers@ducks.org, 832-704-3286) and received by 3:00 PM on May 4, 2026. The estimated construction cost range is $350,000 to $450,000.

The undersigned hereby agrees, if awarded the contract, to execute the proposed contract and to furnish satisfactory Performance Bond in an amount not less than one hundred percent (100%) of the contract award within fourteen (14) days from the date when Notice-of-Award is received, and to provide all supervision, labor, materials, and equipment required to complete the project designated above, for the prices hereinafter set forth, in strict compliance with the Contract Documents prepared by the Division.
Further, the parties agree and acknowledge as follows:
The amount of loss or damages likely to be incurred by Division are uncertain and said loss is incapable or very difficult to quantify and estimate;

The amount of liquidated damages fixed herein are fair and reasonable and it approximates to the extent possible the actual loss to Division as a result of any delay on the part of Contractor; and
Division and Contractor are sophisticated parties and negotiated this Agreement at arm’s length.
Now therefore, in consideration of the mutual obligations set forth herein, the receipt and sufficiency of which is hereby acknowledged, the parties agree as follows:
Contractor will commence the work after the Preconstruction Conference and by the Construction Start Date approved by Division in the Construction Progress Schedule.
Contractor will complete the work within the specified time period identified in the contract, or as amended, or be responsible for liquidated damages per day as set forth in the above table.
The liquidated damages may be withheld from payments made to the Contractor by the Division upon written notice that liquidated damages have begun to accrue, and such damages are in addition to other remedies available as provided for in this contract and applicable law.
A Proposal Guarantee in the amount stipulated herein is included with this proposal, to be forfeited to the Division, if the undersigned fails or refuses to execute the contract and furnish satisfactory Performance Bond, if awarded the contract.

This should be considered when determining the unit prices submitted in the bid.
4. Measurement and Payment:
The specifications describing the work to be accomplished under each particular work item, also describe the method to be used in measuring and calculating the payment quantities for each work item set forth in the proposal. Payments will be made on the basis of monthly estimates in amounts equal to ninety-seven percent (97%) of the value of work completed. Mobilization will be paid at a percentage of the lump sum bid amount for this item equal to the overall percent complete of the project (less retainage). In preparing monthly estimates, advancement will be made therein for ninety-seven percent (97%) of the cost of materials stored on site.
5. Method of Bidding:
This is a unit price contract and bidders shall submit unit price bids as required for the work items covered by the specifications. Prices shall cover complete work and include all costs incidental thereto unless otherwise indicated. The base bid includes all items 1 through 25 in IMPACS for each

C) Engineer’s Discussion:
1. Ducks Unlimited:
mailto:aschippers@ducks.org
April 23, 2026, 10:30AM
i. IDALS would like to complete this project this year.
ii. Sales Tax Exempt.
iii. 5/4/26 at 3:00 pm is the last day for questions. a. Technical questions should go to Andrew.
iv. Contract Administration questions should go to Tracy.
v. Crop Damage bid item is not on Impact.
vi. Materials do not necessarily need to be made in the US.
vii. Andrew went over Sheet C101 – Site Plan and gave an overview of the project. a. Items discussed were the berm, sheet pile weir, stilling basin, draw-down structure, auxiliary spillway, submerged berms, wetland pool expansion/excavation, sedimentation basin, tile modification, and minor earthwork at fenceline of Reising and Huber properties.
viii. Andrew indicated that the Water Control Structure is fully aluminum and provided 3 manufacturers that can make the structures: Wisconsin Flowgate, Energy Culvert, and Contech.
ix. Andrew proceeded to describe each bid item and read the construction notes on sheet C002.
x. Andrew explained that the bid item for drainage tile investigation is minimal and that DU already has GPS points on the tile that need to be found/modified.
xi. Andrew explained that dewatering is a bid item on this project, which is not typically done.
The reasoning for this is that this is a wetland bottom adjacent to Union Slough NWR and conditions could become wet to work in. We want the contractor to consider this in their bid as there will be no adjustments for dewatering price.
xii. Andrew explained to pay attention that the tile modification uses both non-perforated and perforated pipe.
xiii. Andrew explained the incidental earthwork quantities listed below the bid item table on Sheet C002.
xiv. Andrew explained that the start date of the project cannot proceed until after the primary nesting season date of August 1, 2026 due to the request of FWS.
xv. Andrew explained that the tree removal of the project cannot proceed until after 10/1/26.
2. Addendum No. 1 has been issued to update Bid Item #14 “Topsoil” quantity and to include a
Table with Earthwork quantities. A revised Plan C002 has been issued including these changes and clarifications to the construction notes corresponding to earthwork.
