MEMORANDUM FOR RECORD
Sole Source Determination

The U.S. Department of Energy (DOE) Office of Scientific and Technical Information (OSTI) plans to contract by means other than full and open competition. This requirement is being procured in accordance with FAR 13.106(b) and with Federal Acquisition Regulation (FAR) Part 6.302‐1(a)(2)(i)(ii), Only One Responsible Source and No Other Supplies or Services will Satisfy Agency Requirements, as promulgated by 41 U.S.C. 3304. The award of a firm‐fixed price contract is anticipated to Sitecore USA, Inc.
The proposed action is a follow‐on contract to renew the Sitecore Experience Platform license for the Office of Scientific and Technical Information (OSTI). The period of performance is 5/1/23 – 4/30/24.
The Sitecore platform is a critical tool for the management of Office of Science (SC) public content and communications, and a key component of existing SC web infrastructure and workflow processes. The Sitecore Experience Platform license is required to leverage and expand use of the existing training, process, and infrastructure investments to additionally support development of new services, and the re‐implementation of existing services within a more data‐centric structure, in turn enabling more facile reuse and interoperability of public SC content in keeping with Office strategic objectives. Critically, the Sitecore platform also allows for seamless integration of Coveo business intelligence services, leveraging machine‐learning AI to predictively enhance search results and content relationships, improving quality, relevance, and effectiveness of delivered content. These features are needed to support the Sitecore web properties satisfying both new communication requirements and refactoring critical legacy reporting and CM systems.
The estimated total contract cost is $72,090.00. The applicable NAICS Code is 513210 – Software Publishers with a size standard of $47M.
Market research was conducted in accordance with FAR Part 10 and included GSA Library searches for contractors that could provide the required Sitecore Experience Platform license. The results of this research indicated that Sitecore USA, Inc., was the only viable source. Therefore, there is no anticipated area of competition.
Since a determination has been made that there is no expectation of competition for this order and in accordance with FAR Part 6.302‐1 ‐‐ it is determined to be in the best interest of the Government to award a purchase order to Sitecore USA, Inc., in the amount of $72,090.00. A Notice of Intent to issue a sole‐source award was posted on Sam.gov from 2/9/23‐2/23/23. No inquiries or responses were received. Per FAR Part 13.106‐1(b) ‐ The purchase amount of the Sitecore license does not exceed the Simplified Acquisition threshold. The Contracting Officer determined only one reasonable source was available for this procurement.
