The contemplated acquisition will be conducted using other than competitive procedures pursuant to 41 U.S.C. 3304(a)(5), 38 U.S.C. 8127(c), RFO 6.103-5 (Authorized or Required by

replacement and finishing of concrete; and final operational testing of the geothermal system.

The objective is to repair identified leaks and compromised components and restore the geothermal-loop distribution system to normal operation. The existing system includes a supply-line leak estimated at approximately 200 gallons per hour affecting one or more circuits serving the geothermal loop field. The type of contract planned is a Firm-Fixed-Price Construction contract with a period of performance of 180 calendar days from the Notice to Proceed.

The magnitude of construction is between $250,000 and $500,000.

BASIS FOR SOLE-SOURCE ACQUISITION

VA intends to solicit DOMINGUEZ DESIGN-BUILD, INC. on a sole-source basis under the Veterans First Contracting Program pursuant to 38 U.S.C. 8127(c) and VAAR 819.7008 (DEVIATION). VAAR 819.7008 (DEVIATION) permits a sole-source award to an eligible SDVOSB when the applicable requirements of that section are satisfied. A determination that only one SDVOSB can meet the requirement is not required under this authority.

Based on market research, the Government has determined that DOMINGUEZ DESIGN- BUILD, INC. is a responsible SDVOSB source capable of performing the requirement. The Contracting Officer has determined that use of the VAAR 819.7008 (DEVIATION) sole-source authority for this acquisition is in the best interest of the Government, subject to successful negotiation of a fair and reasonable price that offers best value to the Government.

NOTICE TO RESPONSIBLE SOURCES

This notice is not a request for competitive proposals and does not constitute a solicitation.

Notwithstanding the Government's intent to conduct a sole-source acquisition, all responsible sources may submit a quotation or other written information demonstrating their capability to satisfy the requirement, which will be considered by the agency.

Responses should contain sufficient information for the Government to evaluate the respondent's capability to perform the requirement and should include, at a minimum, the firm's legal business name, Unique Entity Identifier (UEI), point of contact, relevant construction experience, and current SDVOSB certification status.

Information received will be considered in determining whether the Government should proceed with the contemplated sole-source acquisition. The Government will not reimburse respondents for any costs incurred in preparing or submitting a response to this notice.

SDVOSB ELIGIBILITY

For an award under the Veterans First Contracting Program, the concern must meet the applicable eligibility requirements of VAAR 819.7003 (DEVIATION), including applicable SDVOSB certification and small-business status requirements at the time required by that provision.

DEFINITIZATION OF EQUITABLE ADJUSTMENTS FOR CHANGE ORDERS

For any change orders issued under the resulting construction contract, VA will follow the applicable procedures in FAR Part 43, VAAR Part 843, and applicable VA acquisition policy.

The Contracting Officer will make final decisions on matters not otherwise addressed by regulation or policy. Definitization of equitable adjustments for any potential change orders will be handled in accordance with (IAW) federal regulations and policies as outlined in the Federal Acquisition Regulation (FAR), Department of Veterans Affairs Acquisition Regulation (VAAR), Veterans Affairs Acquisition Manual (VAAM), and any other applicable Veterans Affairs (VA) guidelines and policies. Applicable provisions and clauses will be included in the solicitation and subsequent contract. Data regarding VA timelines on definitizations within the past 3 fiscal years is currently unavailable.

RESPONSE INSTRUCTIONS

Responses to this notice must be received no later than 4:30pm ET on 10/16/2026 and shall be submitted electronically to the contracting point of contact above.
