SECTION 1: GENERAL INFORMATION

OF THE POSTAL SERVICE FOR MARKET DOMINANT PRODUCTS TO LEVELS OF JULY 1, 2012
AND JANUARY 1, 2021
The House of Representatives recently adopted language into its appropriations bill, (H. Rep. No. 117-79) directing the Postal Regulatory Commission:
…”to analyze the feasibility of restoring service standards for market-dominant products that were in effect on July 1, 2012, including an examination of the resources and structural and operational changes needed, and the impacts on market growth and revenue. If service standards are decreased from their January 2021 levels, the PRC shall also conduct a similar analysis of the costs and benefits of restoring USPS service and performance levels to their January 1, 2021, levels. The PRC shall report to the Committee on its findings within 1 year of enactment of this Act.”
1.2 RFP PURPOSE
The Postal Regulatory Commission (Commission) requires assistance in conducting the analysis and preparing the report described above.
1.3 DISCLAIMER
Offerors are advised that the Commission will not pay for any information or administrative costs incurred in response to this RFP; all costs associated with responding to this RFP will be incurred solely at the interested party’s expense. The Commission reserves the right to contact any respondent to this notice for the sole purpose of enhancing Commission's understanding of the responder’s proposal. The content of any responses to this RFP may be reflected in any subsequent solicitations.
1.4 CONFIDENTIALITY
All information included in responses to this RFP is confidential and only for the use of the Commission. No information included in offeror proposals or in discussions connected to this RFP may be disclosed to any other party outside the Commission without the written consent of the offeror.
1.5 POSTAL REGULATORY COMMISSION
The Postal Regulatory Commission (Commission) is an independent agency that is part of the executive branch of the Federal government. In addition, the Postal Service Reform Act (PSRA) of 2022 legislation tasked the Commission with various studies and analyses, one of which is the subject of this RFP. The Commission is composed of five (5) Commissioners, each of whom is appointed by the President and confirmed by the Senate for a term of six (6) years.
Assisting the Commission is a staff with expertise in law, economics, finance, statistics, and cost accounting. The Commission is organized into four (4) operating offices:
• Office of Accountability and Compliance (OAC)
• Office of the General Counsel (OGC)
• Office of Public Affairs and Government Relations (PAGR)
• Office of the Secretary and Administration (OSA)
The Office of Accountability and Compliance (OAC) (39 CFR 3000.112) is responsible for technical analysis and formulation of policy recommendations for the Commission in both domestic and international matters. OAC provides the analytic support for PRC review of rate changes, negotiated service agreements, classifications of new products, post office closings, amendments to international postal treaties and conventions, among other issues.
The Office of General Counsel (OGC) (39 CFR 3000.113) directs and coordinates the functions of the OGC and is directly responsible for the counseling and advisory services set forth in 39 CFR 3000.735-203. In accordance with
3001.8 of the rules of practice, the General Counsel does not appear as an attorney in hearings in any proceeding before the PRC and takes no part in the preparation of evidence or argument presented in such hearings.
Public Affairs and Governmental Relations (PAGR) (39 CFR 3000.115) serves the public and other stakeholders in providing periodic updates as to how the Commission is accomplishing its mission. As such, PAGR the Commission's primary resource in support of public outreach and education, media relations, and relationships with Congress, the United States Postal Service, and other government agencies. PAGR provides information for consumers and responds to their inquiries; informal complaints regarding individual rate and service inquiries are referred to the Consumer Advocate of the Postal Service. PAGR staff also works closely with members of Congress and their staff.
The Office of the Secretary and Administration (OSA) (39 CFR 3000.111) provides management and staff support to the Commission’s operational offices, the PRC’s strategic plan and various initiatives of the Executive Branch. OSA ensures that the Commission has the physical, financial, technology, and human capital infrastructure needed to accomplish the Commission’s mission. The effort led by OSA provides financial management, records management, administrative and organizational support, planning and human capital resources for the Commission.
SECTION 2: GENERAL RFP INFORMATION
2.1 SCOPE
The Commission is seeking a thorough examination of the feasibility and effects of restoring service standards in effect in FY 2012. The Commission would also like an examination of the feasibility of returning to the service standards in effect in January 2021.
2.2 REPORT OVERVIEW
The House of Representatives adopted language into its appropriations bill (H. Rep. No. 117-79) directing the Commission:
…”to analyze the feasibility of restoring service standards for market-dominant products that were in effect on July 1, 2012, including an examination of the resources and structural and operational changes needed, and the impacts on market growth and revenue. If service standards are decreased from their January 2021 levels, the PRC shall also conduct a similar analysis of the costs and benefits of restoring USPS service and performance levels to their January 1, 2021, levels.
Since July 1, 2012, the Commission has conducted two nature of service cases (N-Cases) that considered a relaxation of one or more service standards applicable to market dominant First-Class Mail delivery. One of the two N-Cases was conducted after January 1, 2021. These N-Cases are briefly discussed below. Current and historical Market Dominant Service Standards can be found in 39 C.F.R. Part 121.
Docket No. N2012-1 In response to a Postal Service request, the Commission, in Order No. 1027, initiated Docket No. N-2012-1 on December 15, 2011. In this docket, the Postal Service proposed to revise service standards for First-Class Mail, Periodicals, Package Services, and Standard Mail as one element of the Postal Service’s Mail Processing Network Rationalization MPNR) Initiative, a plan to provide forecasted net cost savings by consolidating its processing and transportation networks to better match estimated mail volume. The most significant revisions would have eliminated the expectation of overnight service for all single-piece First-Class Mail. Presort First-Class Mail and Periodicals would have to meet new, more stringent entry requirements in order to retain overnight service. In general, 45 percent of all First-Class Mail would no longer receive overnight service and the majority of First-Class Mail previously receiving 2-day service would be deferred to 3-day. Within First-Class Mail, 3-digit ZIP Code origin-destination pair service standards would have been modified to change overnight delivery to 2-day delivery, and to change a large portion of 2-day delivery to 3-day delivery.
On May 17, 2012, the Postal Service moved forward with a modified plan that would have preserved approximately 80 percent of previous overnight service through January 31, 2014, Intra-SCF mail would continue to receive overnight service through this date. On July 1, 2012, interim service standards were adopted that included eliminating overnight service for inter-SCF First-Class Mail. There were no changes to the service standards for Standard Mail that originated and destinated within the contiguous states. The delivery day range would remain 2 to 10 days. The Commission’s Advisory Opinion in that docket was issued September 28, 2012.
Docket No. N2021-1 In this docket, the Postal Service proposed to revise the service standards for First-Class Mail and end-to-end periodicals. Specifically, the Postal Service sought to increase the service standards by up to two additional days for
38.5 percent of First-Class Mail and 7 percent of Periodicals mail to improve its service capabilities, achievement of service standards and reduce mail transportation costs. The Commission’s Advisory Opinion in this docket was issued July 21, 2021. These changes were to put into effect by the Postal Service on October 1, 2021.
2.3 DELIVERABLES
This section is the deliverable guideline for this project. The proposal must include a work plan to include all the items listed below. However, the bidder’s work/task plan to implement the scope of work is at the discretion of the bidder and should be included as part of your capabilities.
2.3.1 Postal Service Standards Report
Deliverable 1: A draft written report containing at a minimum, the following sections
• Executive summary of findings and recommendations
• Summary and review of relevant historical information, research, dockets, and Commission findings relating to changes in service standards since July 1, 2012
• Analysis of the feasibility of reverting to service standards for market dominant products then in effect on (1) July 1, 2012, and (2) January 1, 2021, including an examination of the resources, structural and operational changes that would be needed, and the resulting impact on market growth and revenue
Deliverable 2: A final written report incorporating feedback received from Commission staff.
2.4 ASSISTANCE FROM THE COMMISSION
The Commission will assist the Contractor in obtaining access to relevant background documents and data that may be nonpublic. The COTR will also make reasonable efforts to answer any questions the Contractor may have while completing the deliverables.
2.5 PLACE OF PERFORMANCE
Performance under this contract, including meetings, will be provided remotely.
2.6 PERIOD OF PERFORMANCE
The Commission intends to issue a Fixed-Price contract for this effort. The work is expected to be start on the award date and completed no later than February 16, 2023.
2.7 RFP MEETINGS AND DISCUSSIONS
The Commission may or may not choose to meet with potential offerors. Such discussions would only be intended to get further clarification of potential capability to meet the requirements, especially any development and/or certification risks.
2.8 QUALITY CONTROL
As a micro-agency, the Commission has found that Contractors can contribute significantly to the Commission and its mission success. Whenever the Commission awards a contract, it expects to receive top quality service. This section provides the crucial foundation for identifying, measuring and ensuring quality standards for consultative services. The Contractor will provide information, guidance, and support to the Commission for its Quality Assurance (QA) of the services provided under the contract. QA is a systematic and planned pattern of actions taken to ensure that necessary technical requirements are established, that the deliverables conform to these requirements, and that acceptable performance is achieved. Thus, the Contractor will help the Commission to verify that the Contractor’s own Quality Control (QC) is sufficient and that their deliverables meet the agreed upon criteria. To plan and conduct QC, the Contractor considers among other factors the generic criteria listed in the next paragraph.
A useful service for the government is delivered in a timely manner and thus the quality of performance exhibited by the Contractor, will depend on their ability to deliver their services by established deadlines. The Commission expects accuracy of the services and deliverables rendered on time by the Contractor. Procedures and communication between the Contractor and the Commission concerning the contract shall be unmistakably clear to avoid misunderstandings and ambiguities. The procedures and deliverables of the Contractor shall be consistent and in compliance with this statement of work and shall result in services rendered that effectively meet the Commission’s needs. The Contractor’s work shall be done in an efficient manner, and their services under the contract shall meet the highest standards (e.g., user friendly, innovative, and provide the best value to the government). With the signatures of the Contractor and the Contracting Officer on a finalized contract and any associated task orders, the Contractor certifies that it can meet the quality standards and criteria as cited within the agreed-upon cost framework. For substandard Contractor performance under the contract where delays, cost overruns as well as deviations from the agreed upon acceptable quality levels occur, the Contractor will perform rework of the deliverables at no additional cost to the Government. An example of a delay that deviates from an acceptable quality level would be where timelines and contract specifications are not implemented, requiring rework of deliverables and additional cost. If the Commission is responsible for the delays or cost overruns, the Commission will incur the additional cost.
2.9 POSTAL REGULATORY COMMISSION RIGHTS
• The Commission reserves the right to amend this RFP, and/or to make no award or cancel this RFP.
• The Commission reserves the right to accept or reject any or all proposals received as a result of this solicitation, to negotiate and award separately with competing respondents, and to accept that proposal which, in its judgment, is in the best interests of the Commission. This does not necessarily mean the lowest bid.
• The Commission reserves the right to make a full or partial award in response to this RFP.
• At any time prior to the deadline for submission of bids, the Commission may amend this RFP by issuing addenda. Any addendum issued shall be part of this document and shall be communicated in writing to all who have obtained this RFP directly from the Commission. To give prospective Contractors sufficient time in which to take an addendum into account in preparing their bids, the Commission may, at its discretion, extend the deadline for the submission of offers.
• The Commission reserves its right to rescind an offer at any time for any reason.
• Pre-award Survey: The Commission reserves the right to perform a pre-award survey that may include but is not limited to: (1) interviews with individuals to establish their ability to perform contract duties under the project conditions; (2) a review of the prime Contractor’s financial condition, business, and personnel procedures; and, site visits to the offeror’s institution.
SECTION 3: CONTRACT DETAILS
3.1 CONTRACT TYPE, PERIOD OF AGREEMENT, AND EXPECTED TERMS
The Commission intends to issue a Fixed-Price Contract for this effort. The work is expected to be completed no later than February 16, 2023.
3.2 PAYMENT FOR UNAUTHORIZED WORK
No payments will be made for any unauthorized supplies and/or services or for any unauthorized changes to the work specified herein. This includes any services performed by the Contractor of their own volition or at the request of an individual other than a duly appointed Commission Contracting Officer. Only a duly appointed Commission Contracting Officer is authorized to change the specifications, terms, and conditions under this effort.
3.3 DISCLOSURE OF INFORMATION
Information made available to the Contractor by the Commission for the performance or administration of this effort shall be used only for those purposes and shall not be used in any other way without the written agreement of the Contracting Officer. The Contractor agrees to assume responsibility for protecting the confidentiality of Government records, which are not public information. Each sub-Contractor or employee of the Contractor to whom information may be made available or disclosed shall be notified in writing by the Contractor that such information may be disclosed only for a purpose and to the extent authorized herein.
3.4 LIMITED USE OF DATA
Performance of this effort may require the Contractor to access and use data and information proprietary to a Government agency or Government Contractor which is of such a nature that its dissemination or use, other than in performance of this effort, would be averse to the interests of the Government and/or others.
The Contractor and/or Contractor personnel shall not divulge or release data or information developed or obtained in performance of this effort, until made public by the Commission, except to authorize Government personnel or upon written approval of the Contracting Officer (CO). The Contractor shall not use, disclose, or reproduce proprietary data that bears a restrictive legend, other than as required in the performance of this effort. Nothing herein shall preclude the use of any data independently acquired by the Contractor without such limitations or prohibit an agreement at no cost to the Government between the Contractor and the data owner which provides for greater rights to the Contractor.
3.5 GOVERNMENT FURNISHED INFORMATION AND EQUIPMENT
Space and facilities on site will be provided to the primary Contractors if required. In addition, appropriate information and access to PRC personnel and managers will be provided. The selected Contractor will provide required hardware and software and will have access to the PRC’s systems if necessary.
3.6 TRAVEL
Travel will not be provided or reimbursed for the work conducted under the Contract.
3.8 ADDITIONAL CONTRACT TERMS
In addition to other deliverables listed throughout this RFP, the Commission requires the following clauses to be included in all contracts for this project:
• Contractual provisions or conditions that allow for administrative, contractual, or legal remedies when a Contractor violates or breaches the contract terms and provide for remedial actions as may be appropriate.
• A provision for Commission termination of the contract for cause or convenience. In addition, contracts shall describe conditions under which the contract may be terminated for default as well as conditions where the contract may be terminated due to circumstances beyond the control of the Contractor.
• A provision allowing Federal access to any documents, papers and records the Contractor has that are related to the contract for auditing purposes.
• A provision stating that the Contractor will abide by the Commission’s records retention requirements.
• A provision for the evaluation of the timeliness and satisfaction of service delivery.
• Provisions prohibiting discrimination against Contractor’s employees, sexual harassment, and other illegal conduct by the Contractor.
• Contract terms and conditions will be negotiated upon selection of the winning bidder for this RFP. All contractual terms and conditions will be subject to review by the Commission’ Office of the General Counsel and will include scope, cost, schedule, and other necessary items pertaining to the contract.
3.9 TECHNICAL AND DOCUMENTATION REQUIREMENTS
The Contractor selected must have the ability to submit electronic records for all reports, presentation slides, briefing materials, and supporting technical materials detailed in the scope of work upon completion of the work required.
The Contractor will also provide any documentation adequate to identify, service, and interpret electronic records that could be designated for preservation by the National Archives and Records Administration (NARA). All files associated with the study will be the property of the Commission and are to be delivered to the Commission’s Contracting Officer Technical Representative (COTR) upon completion of the project. This includes, but is not limited to, all templates, images, HTML, PHP, JavaScript, CSS, Microsoft Word, PDF, Photoshop, TIFF, JPEG, BITMAP, and Flash.
SECTION 4: RFP SUBMISSION REQUIREMENTS
4.1 RFP SUBMISSION REQUIREMENTS
All proposals must be signed by an official agent or representative of the company submitting the proposal. If the organization submitting a proposal must outsource or contract any work to meet the requirements contained herein, this must be clearly stated in the proposal. Additionally, all costs included in proposals must include any cost associated with outsourced or contracted work. Any proposals which call for outsourcing or contracting work must include a name and description of the organizations being contracted. If an offeror does not comply with the instructions set forth herein, the Contracting Officer may eliminate the proposal from further consideration; or, the Contracting Officer may down-grade the proposal and it will not receive full credit under the applicable evaluation criteria.
All costs must be itemized to include an explanation of all fees and costs.
Accurate and Complete Information:
Offerors must set forth accurate and complete information as required by this solicitation. 18 U.S.C. § 1001 prescribes the penalty for making false statements to the Government.
4.2 REQUIRED FORMAT FOR PROPOSAL
1. Technical Approach section must be no longer than 10 pages (excluding required documents)
2. Minimum font size: 12
3. Pricing Proposal must be no longer than 2 pages excluding notes (if applicable)
4. For this RFP, all materials including your proposal and supporting materials for any presentation or sessions with the Commission must be submitted electronically in PDF unprotected format. The Commission will not accept electronic versions in a format other than unprotected PDF.
Failure to Adhere to Instructions:
Offerors must carefully and fully adhere to this section. If an offeror does not comply with the instructions set forth herein, the Contracting Officer may eliminate the proposal from further consideration; or, the Contracting Officer may down-grade the proposal and it will not receive full credit under the applicable evaluation criteria. The Commission may determine an offer unacceptable if the offer does not comply with all of the terms and conditions contained in the solicitation.
4.3 RFP QUESTION SUBMISSIONS
Questions to the RFP must be submitted via email to accounting@prc.gov no later than October 5, 2022 at 5:00PM.
Please include the RFQ number in the subject line of the email in the following format: PRC-RFP-2023-0001 – (Company Name) for submitted questions.
4.4 RFP SUBMISSIONS
Proposals must be submitted electronically via email to accounting@prc.gov on or before the RFP closing date of October 19, 2022 at 5:00PM Eastern Standard Time. Please include the RFQ number in the subject line of the email in the following format: PRC-RFP-2023-0001 – (Company Name) for final proposal submission.
4.5 DOCUMENTS REQUIRED WITH PROPOSAL

VOLUME 1: TECHNICAL PROPOSAL
Transmittal/Cover Letter The Bidders’ Transmittal/Cover Letter for the proposal must contain the name, phone number, and e-mail address of the person to be contacted concerning any matter related to the solicitation. The Commission may contact that individual to provide any notifications or updates pertaining to the solicitation. The Transmittal/Cover Letter should not exceed more than one (1) page.
At a minimum, the following information much be included in the transmittal/cover letter:
1. DUNS number and TIN;
2. Company or Institution Name and Mailing Address;
3. Date submitted and proposal expiration date;
4. Type of Company or Institution (i.e. Small Business, 8(a), Woman-owned, Veterans-preference, etc.)
Executive Summary The Bidder shall provide an Executive Summary for the Technical Proposal. The Executive Summary must highlight the significant factors of the Technical Proposal and must not exceed two (2) pages.
Section 1 – Technical Approach The Bidder shall provide a detailed description of the technical capabilities of the contractor and the technical approach proposed. At a minimum, this section should address:
1. Outline of Methodology and Approach for Report
2. Work Breakdown Structure / Roadmap, including detailed descriptions of the activities to be conducted by the contractor to complete the work.
Section 2 – Key Personnel Qualifications The Bidder shall provide resumes for all Key Personnel tasked with delivering the services specified in the Period of Performance. Please include resumes for key personnel which provide descriptions of the applicable experience or knowledge that addresses the key requirements. Proposed resumes for Key Personnel must not exceed three (3) pages each. Please include any pertinent information regarding your organization to include descriptions of training, skills, and certifications, if applicable. The desired Contractor must demonstrate advanced economic, econometric, or modeling capabilities, and proficiency to conduct economic analysis as described; attention to detail and accuracy;
and ability to meet deadlines and budget constraints.
Section 3 – Past Performance The Bidder shall identify three (3) Contracts or similar agreements with other Federal Government agencies of similar size as the Commission that demonstrate its recent and relevant past performances. Recent work must be within the last five (5) years and relevant is defined as work similar in complexity and magnitude of the work described in the Scope section. Each Past Performance must summarize the work conducted and not exceed three (3) pages for a total of nine (9) pages for this Section.
Bidder shall identify three (3) client references and include information regarding each reference should include the individuals’ name, address, phone number and email address.
VOLUME 2: PRICING PROPOSAL
The Bidder shall provide a separate volume from the Technical Proposal to include the Firm Fixed Price (FFP) of the proposed work, in US Dollars, exempt from all Federal, State, and Local Taxes. A detailed breakdown of applicable deliverables and/or milestones may be provided; however, a final Fixed-Price total of all associated costs must be provided. Travel costs should not be included in the pricing proposal as travel costs will not be reimbursed for any of the proposed work.
4.6 PROPOSAL EVALUATION CRITERIA
The Commission will evaluate all proposals based on the following criteria. To ensure consideration for this RFP, proposals should be complete and include all the following criteria:

Bidders must provide descriptions and documentation of staff approach, technical expertise, and experience.
Proposals must clearly explain the proposed methodology and approach for the report, as well as provide a work plan for a timely and complete report.

Bidders will be evaluated on successful examples of their work pertaining to implementing similar work, as well as client testimonials and references. The desired Contractor must demonstrate advanced economic, econometric or modeling capabilities and proficiency to conduct economic analysis as described; attention to detail and accuracy; and ability to meet deadlines and budget constraints. The Commission will look favorably upon operations expertise and experience, particularly expertise and experience related to postal networks and other networks.
Value and Cost Cost will be evaluated separately and based on suitability of the Technical Proposal. The Pricing Proposal must be submitted separately from the Technical Proposal, as noted in Section 4.5.
