SBU - CONTRACTING AND ACQUISITIONS
JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN
COMPETITION (OVERSEAS CONTRACTING ACTIVITIES)
1. I recommend that EMBASSY PANAMA CITY use other than full and open competition for the acquisition of SOFTWARE LICENSES FOR A GEOGRAPHIC INFORMATION SYSTEM. The estimated cost is $68,050.00
USD.
2. Nature and/or description of the action being approved.
A sole source request for the acquisition of one (1) license of ArcGIS Desktop Standard, one (1) license of ArcGIS Spatial Analysis, and one (1) license of ArcGIS Online Field Worker, and to use the brand name of “ESRI” “ARCGIS” by vendor
ESRI PANAMA SA.
3. A description of the supplies or services required to meet the agency’s needs.
Three (3) licenses for a five (5) year term of ArcGIS software Training for 5 users 200 hours software support
4. An identification of the statutory authority permitting other than full and open competition.
The statutory authority permitting this procurement action is 41 U.S.C 253 (c) (2), 41 USC 3304 “USE OF NONCOMPETITIVE PROCEDURES” and 6.302-2 “UNUSUAL AND COMPELLING URGENCY (2) Delay in award of a contract will result in serious injury, financial or other to the Government.”
5. A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited (for sole source acquisitions; also required for unusual and compelling urgency where more than one offer will not be solicited).
The Panamanian government currently uses “ArcGIS” throughout the Direccion Nacional de Inteligencia (DNI). The need for standardization and compatibility leads us to acquire the software from its sole source.
6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable. The description should include whether a FedBizOpps notice was or will be publicized, as required by FAR 5.2, and if not, which exception under FAR 5.202 applies (e.g., blanket waiver provided in DOSAR 605.202-70).
An internet search was conducted to try to identify other software with similar capabilities, but both the host government and the manufacturer confirmed the only vendor for these software licenses is ESRI PANAMA SA.
A beta.SAM.gov notice will be posted as per FAR 5.2.
7. A determination by the Contracting Officer that the anticipated cost to the
Government will be fair and reasonable.
The cost is understood to be fair and reasonable, as it has been compared with similar software offered in GSA Advantage.
8. A description of the market survey conducted and the results or a statement of the reasons a market survey was not conducted.
No market research was conducted, as the vendor has confirmed it is the sole source and distributor of the “ARGGIS” software license in the Republic of Panama.
9. Any other facts supporting the use of other than full and open competition.
Not applicable.
10. A listing of sources, if any that expressed, in writing, an interest in the acquisition.
No other sources, expressions, or interests were sought, as the manufacturer confirmed that ESRI PANAMA SA is the only vendor for these software licenses.
11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.
Not at this time.
