Statement of Work (SOW) U.S. Border Patrol Yuma Sector Light Tower Refueling Service

Aug 12, 2016

I. BACKGROUND:

Requirement to refuel the light towers is essential to maintain and enhance border operations at a high level and satisfy DHS and CBP objectives:

· DHS Objective 1.1: Achieve effective control of our borders.

· CBP Objective 1.1: Establish and maintain effective control of air, land, and maritime borders through the use of the appropriate mix of infrastructure, technology, and personnel.

II. SCOPE:

Fulfil a service contract to refuel 21 light towers strategically deployed adjacent to the international boundary within Arizona and California.

· Fifteen (15) light towers are situated within approximately a 3-mile radius of the San Luis Port of Entry within San Luis, Arizona. Hereinafter this area, and the light towers within it, will be referred to as the San Luis Port of Entry Area.

· Six (6) light towers are situated within approximately a 2-mile radius of the Andrade Port of Entry within Winterhaven, California. Hereinafter this area, and the light towers within it, will be referred to as the Andrade Port of Entry Area.

· The government may periodically move light towers within the San Luis Port of Entry Area and the Andrade Port of Entry Area as operations dictate. The number of light towers will remain at twenty-one (21) and will not be increased.

During the months of April through October, hereinafter referred to and designated as “Summer Months,” contractor will refuel all light towers two (2) times per week. The refueling of light towers will consist of filling each fuel tank to full capacity.

During the months of November through March, hereinafter referred to and designated as “Winter Months,” contractor will refuel all light towers three (3) times per week. The refueling of light towers will consist of filling each fuel tank to full capacity.

Diesel fuel will be provided by government for the light tower generators and is located at the Yuma Sector Border Patrol Headquarters within Yuma, Arizona. No government fuel may be used by the contractor for other uses, contractor vehicles, etc.

Contractor will provide a fixed price per month for each of the two seasonal time periods consisting of Summer Months and Winter Months, and for each area consisting of the San Luis Port of Entry Area and Andrade Port of Entry Area. The contractor will submit this pricing data utilizing the following template:

THIS PRICING WILL BE FIRM FIXED PRICE FOR THE LIFE OF THE CONTRACT.

III. SPECIFIC TASKS:

The contractor will

· Conduct all operations in accordance with all local, state and federal rules, regulations and laws.

· Obtain diesel fuel from U.S. Border Patrol Yuma Sector Headquarters, 4035 S. Ave A, Yuma, AZ at no cost to the contractor, between the hours of 0600-1400 (local time) Monday through Friday (excluding Federal holidays).

· Maintain and furnish monthly reports to Yuma Sector Border Patrol Fleet Office, detailed records of the date and the amount of fuel acquired; the date and amount of fuel dispensed to each light tower.

· Maintain operational fuel levels in each light tower as described in “Scope” above.

· All light towers operate from sunset to sunrise 365 days per year;

· All towers are of the portable/mobile, diesel fuel type consisting of various manufactures to include Magnum, Pow’r Gard Corp., Allmand, and Mobi Light;

· Each light tower fuel tank capacity is 30 gallons (113.5 liters)

· Each fuel tank opening is approximately 1 5/8 inches in diameter (41.3mm).

Review attached documents with aerial view maps and Global Positioning Satellite locations of light towers.

A pre-award site visit will be conducted: Aug 18, 2016, 10am - AZ standard time: You must coordinate, PRIOR to Aug 17th, with: SOS John Fountain; PH: 928-341-6634; Email: John.H.Fountain@cbp.dhs.gov. Location: 4035 S Ave ‘A’, Yuma, AZ 85365. Yuma Sector HQ building. You must have photo ID and your own water supply to take with you. Site visit will take approximately 3 hours.

IV. DELIVERABLES AND DELIVERY SCHEDULE:

The contractor is required to maintain operational fuel levels in each deployed light tower 365 days per year, provide an invoice which includes; date of the service, amount of diesel fuel acquired from the U.S. Border Patrol and the amount of diesel fuel dispensed to each individual light tower.

V. GOVERNMENT-FURNISHED EQUIPMENT AND INFORMATION:

The Yuma Sector Border Patrol will provide the diesel fuel for the refueling of each light tower. Fuel will be drawn from the Yuma Sector Border Patrol bulk fuel tanks.

VI. PLACE OF PERFORMANCE:

Performance will take place within Yuma, Arizona, San Luis, Arizona and Winterhaven, California.

· Diesel fuel will be drawn from the bulk fuel tanks located at Yuma Sector Border Patrol Headquarters, 4035 S Ave ‘A’, Yuma, AZ 85365.

· Refueling of light towers will be performed in the San Luis Port of Entry Area within San Luis, Arizona and the Andrade Port of Entry Area within Winterhaven, California.

VII. PERIOD OF PERFORMANCE:

The period of performance will be one year from date the contract is awarded. Base year and four possible option years.

VIII. SECURITY:

There are no specific security classification level requirements associated with this procurement action. All vendor employees must show proof of Legal U.S. Residence and will be required to have a criminal history background investigation completed by the Border Patrol. Information is deemed unclassified.

All employees must have some type of contractor ID. Name badge with photo, or at a minimum, clothing with the persons and company name permanently applied to the garment. (such as shirts, coat). Contractor will be granted access to the Yuma Sector Border Patrol fuel tanks and the light towers located within fenced in areas. The contractor is responsible for securing contractor’s delivery vehicle(s) while on Government property. The contractor is required to maintain all required insurance and assumes all liability for any and all damages that occur to contractor’s delivery vehicle(s) or U.S. Border Patrol property or any third party property while in contractor’s control on Government property.

IX. Special Considerations Changes to the SOW:

No changes to this SOW, alterations to the order amount, or terms and conditions will be incurred without prior written approval of the Contracting Officer. Any changes to the contract will only be through the execution of a written modification as determined by the Contracting Officer. Administrative clarifications will be made thru the Government Authorized Rep (GAR) or Contracting Officers Rep (COR).

X. Travel:

Travel is required from Yuma Sector Headquarters to the light tower locations to support the requirements identified in this SOW.

XI: ENVIROMENTAL REQUIREMENTS:

The contractor is required to comply with all applicable Federal, State and Local environmental, transportation, and safety laws and regulations. The contractor will undertake all necessary precautions to avoid a fuel spill. The contractor will assume sole responsibility should a fuel spill occur and perform appropriate cleanup procedures and notifications in accordance with applicable local, state, and federal environmental laws, regulations, and CBP and DHS environmental policies. The contractor will transport with them appropriate materials to contain and cleanup fuel spills in accordance with applicable local, state, and federal environmental laws, regulations, and CBP and DHS environmental policies.

Contractor must be registered in the SAM,gov and IPP.gov database/websites and maintain current status in both databases for the life of the contract. Both require yearly updating.
