4. Identification of Statutory Authority Permitting Other Than Full and Open Competition.
The statutory authority permitting the award of this task order without providing for a fair opportunity to be considered competition is FAR subpart 16.505(b)(v)(2)(i)(B). This task order must be issued on a sole-source basis because CACI, Inc. Federal Is the only vendor that possesses the knowledgeable resources with the required security clearances and comprehensive understanding of these services to continue to perform these mission critical services by the end date of the current task order (June 27, 2015) without a break in services.
This Task Order with CACI, Inc. Federal will serve to ensure continuity of these mission critical services.
CBP currently has in place a task order (HSBP101OJ00855), issued under the Enterprise Acquisition Gateway for Leading-Edge Solutions (EAGLE) I contract with CACI. Inc. Federal to provide services to support the organizational processes that provide for internal controls, management oversight, and technical support for Project Support and Information Systems Security in support of the Passenger Systems Program Directorate (PSPD).
The current task order will expire on June 27, 2015.
CACI, Inc. Federal, as the incumbent contractor, is the only vendor that possesses the knowledgeable resources with the required security clearances and comprehensive understanding of these services to continue to perform these mission critical services by the end date of the current task order (June 27, 2015) without a break In services. This makes the incumbent uniquely situated to continue to provide these services until a new task order can be awarded for these services
5. A Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable
The contracting officer anticipates that the cost for .these services will be fair and reasonable. These services are currently being provided by CACI under the CBP contract HSBP101OJ00855. The labor rates charged by CACI under the current task order are contained in their EAGLE I contract and as such, have already been determined to be fair and reasonable. This task order will be placed against the CACI EAGLE II contract and as such, will contain EAGLE II labor rates which have already been determined to be fair and reasonable. The Contracting Officer will use the task order historical information and an Independent Government Cost Estimate to determine that the anticipated cost will be fair and reasonable.
6. Any Other Facts Supporting the Justification.
In anticipation of the expiring contract held by CACI, Inc. Federal, CBP has taken the appropriate steps to replace the expiring contract in a timely manner. The Government is in the process of recompeting this acquisition for services using the Department of Homeland Security (OHS) EAGLE II indefinite delivery indefinite quantity (IDIQ) contracts, Functional Category 1- Service Delivery, including Integration, Software Design/Development, and Operations & Maintenance. EAGLE II is a multiple-award I D I Q contract, specifically designed as the required source of information technology (IT) services for DHS's enterprise infrastructure and initiatives. The task order Request for Proposals for the recompetition is expected to be released in April 2015with proposals expected to be received in May 2015. Award of the new contract is expected by October 2015.
This Task Order will allow for the continuation of services until a new award is finalized. Failure to continue work under the task order expiring on June 27, 2015 poses an unacceptable risk to PSPD projects and programs. The services provided under this task order are an integral part of all PSPD projects/programs. Not only is it vital to guarantee that Federal and departmental regulations and best practices are correctly implemented to ensure the confidentiality, integrity, and availability of information, but compliance with Federal Information Security Management Act (FISMA) legislation requires that all phases of information security be meticulously documented and reported on a regular basis. This is an organizational program support function, as well as a specific element of each project and system.
7. A Statement of the Actions, if any, the Agency May Take to Remove or
Overcome any Barriers that Led to the Exception to Fair Opportunity Before any Subsequent Acquisition for the Supplies or Services is Made
As previously noted, CBP is conducting an EAGLE II competition for these services. It is anticipated that a task order will be awarded prior to December 2015.
