About this file

This Single Source Justification document from the Department of State, Overseas Post-Nouakchott, seeks approval to award a sole-source contract to "Autorité de Regulation" for leasing dedicated UHF, VHF, and HF frequencies at the U.S. Embassy Compound and CMR in Nouakchott. The contract has an estimated value of $17,372.00 for a 12-month period of performance. The justification is based on the vendor being the only entity authorized by the host government to provide these frequencies, which are critical for the Embassy's secure communications, emergency response, and evacuation protocols. The sole-source procurement is necessitated by the host government's exclusive control over frequency allocation, with no alternative vendors available in the local market due to legal and regulatory constraints.

SECTION 2: NATURE AND/OR DESCRIPTION OF THE ACTION BEING APPROVED

Approval is requested to award a sole-source contract to "Autorité de Regulation," the only authorized service provider by the local Government in Nouakchott for leasing a dedicated UHF, VHF, and HF frequencies at US

Embassy Compound and CMR.

SECTION 3: DESCRIPTION OF SUPPLIES/SERVICES REQUIRED TO MEET THE AGENCY’S NEEDS

The Office of Diplomatic Technology requires the leasing of dedicated UHF, VHF, and HF frequencies to support critical communications operations at the U.S. Embassy Compound and CMR. These frequencies are essential for ensuring secure, reliable, and uninterrupted communication capabilities, which are integral to the Embassy’s mission and emergency response readiness.

The vendor, "Autorité de Regulation," is the only entity authorized by the host government to provide these frequencies. This exclusivity is mandated by local regulatory frameworks governing frequency allocation and usage, which fall under the jurisdiction of the host government. As such, no other vendor is legally permitted to provide this service, making "Autorité de Regulation" the sole source for this requirement.

SECTION 4: IDENTIFICATION OF THE STATUTORY AUTHORITY PERMITTING OTHER THAN

FULL AND OPEN COMPETITION

In accordance with Federal Acquisition Regulation (FAR) 13.106-1(b)(1), the Contracting Officer has deemed only one source reasonably available based on the following:

☐ Urgency

☒ Exclusive licensing agreements

☐ Brand-name

☐ Industrial mobilization

☐ Other

SECTION 5: DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE

QUALIFICATIONS OR THE NATURE OF THE ACQUISITION REQUIRES USE OF THE AUTHORITY

CITED

The use of other than full and open competition is justified under the following conditions:

1. Host-Government Authorization:

The host government has exclusive control over the allocation and regulation of UHF, VHF, and HF frequencies. Per Article 27 of the Vienna Convention on Diplomatic Relations, the receiving state must permit and protect free communication for official purposes, but the installation and use of wireless transmitters require host-government consent. "Autorité de Regulation" is the only entity authorized to allocate and lease these frequencies, as confirmed by the host government.

2. Operational Necessity:

The dedicated frequencies are critical to the Embassy’s operational continuity, including secure communications, emergency response, and evacuation protocols. The inability to lease these frequencies would severely compromise the Embassy’s ability to fulfill its mission and ensure the safety of personnel and assets.

3. Market Conditions:

Due to the regulatory environment, no alternative vendors exist in the local market. The sole-source nature of this procurement is not a result of preference but of legal and operational constraints imposed by the host government.

4. Cost Reasonableness:

The estimated value of $17,372.00 for a 12-month period of performance has been reviewed and determined to be fair and reasonable based on market research and historical pricing for similar services.

SECTION 6. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST

TO THE GOVERNMENT IS FAIR AND REASONABLE

By signing the justification, the Contracting Officer makes a determination that the price to the Government is anticipated to be fair and reasonable.

SECTION 7. CERTIFICATIONS
