About this file

This is an Acquisition Alert (25-07) from February 2025 that introduces a new contractor certification requirement related to Executive Order 14173 "Ending Illegal Discrimination and Restoring Merit-Based Opportunity." The alert outlines a mandatory certification that contractors and prospective offerors must complete regarding compliance with federal anti-discrimination laws.

The certification requires contractors to affirm two key points: 1) they are in compliance with all applicable federal anti-discrimination laws, which is material to government payment decisions under the False Claims Act, and 2) they do not operate any Diversity, Equity, and Inclusion (DEI) programs that violate federal anti-discrimination laws. The document notes that this Executive Order revokes previous EOs related to DEI, affirmative action, and equal opportunity programs, including EO 11246 which had mandated non-discrimination in employment by government contractors and subcontractors. The certification includes fields for the contractor's company name, authorized representative details, signature, and date.
