Department of State US Embassy London
About this file
This document is a justification for other than full and open competition for vehicle services in support of a VIP visit to Belfast, Northern Ireland. The Department of State US Embassy London awarded a sole source contract to Enterprise Taxis Limited doing business as David Andrews for vehicle services including 35 sedans, 7 seven-passenger vans, 11 sixteen-passenger buses, and 6 fifty-passenger buses from April 28-30, 2023. The estimated cost of the contract is GBP 351,530.00 or approximately $428,866.60. An unusual and compelling urgency justification was used based on the Embassy receiving last minute notification of visit dates, which did not allow enough time for full and open competition or security clearance of new drivers.

JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION
(OVERSEAS CONTRACTING ACTIVITIES)
1. I recommend that Embassy London use other than full and open competition for the acquisition of the services of Enterprise Taxis Limited d/b/a David Andrews. The estimated cost is GBP £351,530.00/$428,866.60 (RoE 1.22).
2. Nature and/or description of the action being approved.
Chauffeur services for Belfast, Northern Ireland, UK to support VVIP visit for the Anniversary of the Good Friday Agreement.
3. A description of the supplies or services required to meet the requirements.
35x sedans for a total of 313 services 7x 7 passenger vans for a total of 171 services 11x 16 passenger bus for a total of 41 services 6x 50 passenger bus for a total of 6 services
4. An identification of the statutory authority permitting other than full and open competition.
41 U.S.C. 253 (c) (2), FAR 6.302-2; Unusual and Compelling Urgency; (Based on the available time and urgency of the requirement as detailed below)
The last-minute notification of the actual dates of this visit meant there was an extreme lack of notice in this case, creating an urgent and compelling need. David Andrews dba Enterprise Taxis Limited is the only vendor available to provide service in Belfast which not only has the resources available to accommodate the entire requirement at short notice, but has also done prior work for the Embassy and therefore has drivers currently cleared by Embassy Security.
5. A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited (for sole source acquisitions;
also required for unusual and compelling urgency where more than one offer will not be solicited).
The VVIP visit is taking place in Belfast which is too far away to utilize the London IDIQ contract. Because information was not available in sufficient time, there is now an urgent and compelling need with not enough time to advertise vehicle requirements and to then have drivers cleared by Embassy Security.
6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable. The description should include whether a SAM notice was or will be publicized, as required by FAR 5.2, and if not, which exception under FAR 5.202 applies (e.g., blanket waiver provided in DOSAR 605.202-70).
CBD Notice not published as per blanket waiver in DOSAR 605.202-70.
7. A determination by the Contracting Officer that the anticipated cost to the
Government will be fair and reasonable.
When taking the current rate of high inflation in the UK into account, the offered rates are similar to which this vendor has received previously, and so therefore are determined to be fair and reasonable.
8. A description of the market survey conducted and the results or a statement of the reasons a market survey was not conducted.
No market survey was conducted as there was not enough time to advertise requirements or to get drivers cleared after award.
9. Any other facts supporting the use of other than full and open competition.
None.
10. A listing of sources, if any that expressed, in writing, an interest in the acquisition.
None.
11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.
The Embassy will consider if there is sufficient requirement in this area of the United Kingdom to advertise for and award IDIQ contracts for this service.
