About this file

This document is a Determination of Commerciality template (PR-TMP-09) used to evaluate whether products or services being procured under a federal contract meet the FAR 2.101 definition of commercial products and/or commercial services.

The template provides a series of questions to assess the commerciality of the products or services, covering factors such as whether the items are customarily used by the general public, have been sold or offered for sale commercially, have evolved from commercial products, or are nondevelopmental items sold competitively to multiple governments. For commercial services, the template examines whether the services are in support of commercial products or are standalone commercial services based on catalog or market pricing. The template requires the procurement professional to document their rationale and determination that the items are commercial. Supporting documentation such as product descriptions, pricing information, and market research is required.
