The Naval Medical Research Command (NMRC) intends to award a sole source contract to Nuvair to provide the required analyzers, which can measure oxygen, carbon dioxide, carbon monoxide, volatile organic compounds, and relative humidity in real-time with data logging and printing capabilities. NMRC has determined that Nuvair is the only responsible source that can meet the Government's requirements, as this is a novel and unique device not widely available on the open market. The anticipated cost to the Government is fair and reasonable, and NMRC has no plans to compete future contracts for these types of supplies and services at this time.

JUSTIFICATION AND APPROVAL

OTHER THAN FULL AND OPEN COMPETITION

1. Identification of the agency and the contracting activity.

This justification is executed by the Naval Medical Research Command (NMRC), Silver Spring, MD, on behalf of the Navy to meet the Naval Medical Research and Development mission.

2. Nature and/or description of the action.

The contract is to procure two TEMC DE-OX-Sub Multigas Color Hyperbaric Chamber Gas Analyzers by Nuvair to allow for detailed analysis of chamber gas during hyperbaric exposures.

3. Description of Supplies or Services:

The vendor will provide two (2) TEMC DE-OX-Sub Multigas Color Hyperbaric Chamber Gas

Analyzers by Nuvair. Each unit will read current levels of Oxygen, Carbon Dioxide, Carbon

Monoxide, Volatile Organic Compounds, and Relative Humidity. The reading shall display in real time, allow data output via RS-232 interface or logged for later analysis. Each unit will also contain a built-in printer allowing print out of readings at anytime providing Objective Quality Evidence of results.

NISE management support funds in the amount of $XX,XXX.XX will be used to procure the analyzers.

4. Identification of the statutory exceptions permitting other than full and open competition.

The statutory exception permitting other than full and open competition for this acquisition is 10 U.S.C.

2304(c)(1) and FAR 6.302-1 sole source (including brand name) acquisitions OR FAR 13.106-1(b)(1) soliciting from a single source.

Use the following: 10 U.S.C. 2304(c)(1), Only one responsible source. This is novel, new device and the vendor is the only party to offer this equipment.

5. Demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited.

There are very few purpose built gas analyzers gear toward hyperbaric chamber operations on the open market. The TEMC DE-OX-Sub Multigas Color Analyzer by Nuvair is a unique and novel device that combines all the required gases, plus relative humidity in one portable device. Given the additional features of both real-time data output and data logging, as well as full display and printing capability, this is the only device combining all these features into a single compact portable unit.

6. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.

An Internet market search was performed, the results of which yielded few vendors that produce very specialized hyperbaric chamber analyzers. Of those vendors identified only TEMC DE-OX-Sub Multigas

Color Analyzer by Nuvair offered a meeting the Government requirements.

7. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

The Contracting Officer shall determine the anticipated cost to the Government of the supplies/services covered by this Justification and Approval will be fair and reasonable by conducting a price analysis before an award is made. In addition, the Government anticipates that the negotiated contract price is determined to be fair and reasonable.

There is no additional cost to the government resulting from sole source award.

8. Description of the market survey conducted and the results, or a statement of the reasons a market survey was not conducted.

A Market Survey was completed in FY23. At that time, Nuvair was the only vendor that could meet the requirement. Two Nuvair Analyzers were procured in FY23 and have demonstrated outstanding results on UMD chamber systems. New units are being procured to expand UMD capabilities and assure data consistency amoung systems.

9. Other facts supporting the use of other than full and open competition.

See Item 6. Additionally, 2 of these units were purchased in FY23. They have proven to fit UMD needs. The

2 additional unit will assure compatibility and data consistency.

10. Listing of Sources, if any, which expressed, in writing, an interest in the acquisition.

Not applicable

11. Statement of actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.

Future requirements will be synopsized in accordance with FAR 5.203.

For the reasons set forth in Paragraph 5, (contracting activity) has no plans at this time to compete future contacts for the types of supplies/services covered by this document. If another potential source emerges, (NMRC) will assess whether competition for future requirements is feasible.
