About this file
This document contains a sole source justification memorandum and related solicitation for the evaluation, repair or refurbishment of one Cone Drive gearbox. The Naval Surface Warfare Center Carderock Division seeks to solicit only Cone Drive Operations, Inc. to evaluate, repair or refurbish a 30-year old custom gearbox used to deploy test vehicles for Navy underwater research programs. The justification memorandum cites the gearbox's unique performance requirements in a marine environment, proprietary design by the original equipment manufacturer, and need for specialized expertise as reasons only Cone Drive can complete the work within the required timeframe and at less expense than reverse engineering the design. Interested parties may submit capability statements by March 13, 2024 for consideration, though the solicitation will only be issued to Cone Drive. The solicitation incorporates standard clauses and provisions.

NSWCCD Sole Source/Brand Name Justification Under SAT Rev 3 Effective February 2023
USE OF OTHER THAN FULL AND OPEN COMPETITION LESS THAN
SIMPLIFIED ACQUISITION THRESHOLD MEMO
FROM:
CODE: 7280
TO: Code 02 SUBJECT: Sole Source Justification for Use of Other than Full & Open Competition for an Acquisition under the Simplified Acquisition Threshold (SAT)
I. BACKGROUND
1. FAR 13.106-1(b)(1)(i) states for purchases not exceeding the simplified acquisition threshold, Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available.
2. As required by FAR 13.106-3(b)(3)(i), this memorandum explains the absence of competition for this acquisition, as only one source will be solicited for this requirement (or for a portion of the requirement) and the requirement is not expected to exceed the simplified acquisition threshold.
3. This memorandum is derived from Enclosure 3, Department of Navy Simplified Acquisition Procedures Guide (April 2018) and is only applicable to acquisitions under the SAT.
II. DESCRIPTION OF ITEM OR SERVICE
NSWCCD Acoustic Research Detachment (ARD) in Bayview, Idaho has a requirement to repair and service a damaged Cone Drive gearbox (model number: MUO55648-A2, serial no. 94201725-100-1) that is used to deploy and manipulate multimillion-dollar test vehicles for Navy underwater RDT&E programs. The gearbox is a high precision and custom-engineered product that was specifically designed for operation in a deep-water marine environment. This gearbox has been in service for 30 years and shows wear that should be serviced to ensure longevity of the equipment. The work to be performed shall consist of furnishing all necessary labor, tools, supplies, and equipment required to diagnose the scope of work, complete repairs of the gearbox, and provide any additional servicing needed. Additionally, the contractor shall perform an acceptance test to ensure proper functionality of the gearbox upon completion of the repairs and submit documentation showing objective quality evidence that this test was satisfactorily performed. The estimated cost of this service is

III. BASIS FOR DETERMINATION FOR USE OF OTHER THAN FULL & OPEN COMPETITION
A. BRAND NAME:
Item required must be a brand name product, or feature of a product, particular to one manufacturer.
NSWCCD Sole Source/Brand Name Justification Under SAT Rev 3 Effective February 2023
1. Restrictive Rights: The source has established proprietary rights, limited rights in data, patent rights, copyrights, or secret processes in the item or service required.
2. Exclusive Licensing Agreements: The item or service is only available from the Original Equipment Manufacturer (OEM).
3. Other Reasons:
B. SOLE SOURCE (select all that apply)
1. Restrictive Rights: The source has established proprietary rights, limited rights in data, patent rights, copyrights, or secret processes in the item or service required.
The Cone Drive gearbox (model number: MUO55648-A2, serial no. 94201725-100-1) is a critical component that enables the ARD to conduct testing for Navy underwater RTD&E programs. Testing cannot be performed without the gearbox installed and fully functional. The gearbox is unique in that it must meet exact performance requirements (e.g. load rating, gear ratio, input & output speeds, etc.) with the added requirement to operate under high external hydrostatic pressures. The casing is distinct in that it is engineered to balance high hydrostatic pressures via a pressure compensation system in a marine environment and seal the gear internals from external leaks. The gear internal components consist of high precision machined gears, bearings, shafts, spacers, seals, and other components that are aligned and assembled to a high level of precision that enable the gearbox to perform as required. Even slight misalignments during assembly or out of tolerance components would be enough to degrade the gearbox integrity.
Given the age and complexity of the gearbox it is determined to be in the best interest of the Government for the work to be performed only by the OEM.
Cone Drive is the original equipment manufacturer and possesses the design and fabrication details for this custom gearbox, therefore it is required to use them for the evaluation and repair. This work performed by other than the OEM would require time for evaluation and reverse-engineering the existing design. This would result in an undue burden of time and cost to the Government in excess of
