PERFORMANCE WORK STATEMENT (PWS)

Power Marketing Analytical Support Services

1. REQUIREMENT OVERVIEW

1.1. Scope

The Western Area Power Administration (WAPA) Sierra Nevada Region (SNR) requires professional consulting services to assist SNR staff with the coordination/research related to the collection, development, and analysis of studies, regulatory and environment decision, OIG reports, and Reclamation Solicitor’s opinions as they relate to Central Valley Project (CVP).

1.2. Background

WAPA’s statutory mission is to market and deliver cost‐based hydroelectric power and related services. WAPA’s wholesale power customers provide service to millions of consumers in 15 western states (Arizona, California, Colorado, Iowa, Kansas, Minnesota, Montana, Nebraska, Nevada, New Mexico, North Dakota, South Dakota, Texas, Utah and Wyoming). WAPA operates and maintains approximately 17,000 miles transmission lines, 300 substations and other related facilities.

SNR is headquartered at 114 Parkshore Drive, Folsom, California, 95630, and is responsible for a geographic service territory that includes Northern California and part of the State of Nevada.

2. PERFORMANCE REQUIREMENTS

2.1 Power Marketing Analytical Support (CVP Operational Support)

The contractor serves as a subject matter expert in the preparation of technical evaluation of Federal and State laws affecting CVP operation; Provide analytical services to the Power Marketing unit as it relates to the design and development of new products and services relating to SNR’s Power Marketing Plan and improving the efficiency and effectiveness of balancing area products and services; Assist in the analysis, coordination, preparation, and review of Reclamation and CA State policies and requirements in support of CVP and SNR Power Marketing activities.

The incumbent must have expert knowledge and experience in Reclamation Law, State Water Resources Control Board, CAISO Regionalization and WAPA power marketing policies; Expert knowledge and specific direct work experience in analyzing CVP Cost Allocation Study, Warren Act Contracts, and Delta Reform Act; Assist in the assessment of benefits derived from market for generation schedules/bids and development of optimal CVP generation resources schedules and bid strategy plans in the weekly, daily, and hourly time horizons, and in consideration of specific seasons and water year types; Assist with forecasting monthly Base Resource volumes in Heavy Load and Light Load periods for median inflow conditions and for 10% and 90% flow cases for up to 60 months; Review Delta Flow Criteria proposals (and San Joaquin and other river proposals) and provide feedback on modeling and impacts.

Contractor shall assist in the analysis of impacts to the power generation, marketing, maintenance, operations, and other mission-related programs/activities as a result of complying with applicable environmental laws, policies, and regulations. Provides specialized technical services, advice, and input into interagency teams and committees to ensure that SNR hydropower operational interests are represented and addressed.

Contractor shall conduct the preparation and evaluation of any business procedures, planning documentation, training, and/or other materials related to all work performed under this PWS and as assigned by the CO/COR/POC.

2.2 Power Marketing Analytical Support (CVP Regulatory Support)

The incumbent shall serve in the role as an expert technical subject matter consultant/advisor to the SNR Power Marketing office and to the SNR Regional Manager office to assist in the coordination/research related to the collection, development, and analysis of studies, regulatory and environment decision, OIG reports, and Reclamation Solicitor’s opinions as they relate to CVP.

As part of the duties, the incumbent shall assist in the analysis, coordination, preparation, and review of Reclamation and CA State policies and requirements in support of CVP and SNR Power Marketing activities. As well as serve as a subject matter expert in the preparation of technical evaluation of Federal and State laws affective CVP.

In addition, the incumbent must provide institutional knowledge and knowledge transfer to the SNR staff on an as needed consultant basis. These knowledge management areas may include but are not necessarily limited to technical analysis of laws affective SNR Power Marketing Organization.

2.3 Other Requirements

2.3.1 The Government requires ten (10) business days for review of each deliverable/submittal.

2.3.2 Safety Plan. The Contractor must submit a Safety Plan to the Government

Contracting Officer (CO) and Contracting Officer’s Representative (COR, if designated) no later than ten (10) calendar days after contract award.

WAPA’s approval of the plan is required prior to work commencement.

2.3.3 List of Employees. The Contractor must furnish names of all personnel performing work on this contract to the CO and COR no later than ten (10) calendar days after contract award. No unidentified or unauthorized personnel will be allowed or permitted on the work site.

2.3.4 Performance Schedule. Contract shall submit a proposed work schedule to the CO and COR no later than ten.

(10) calendar days after contract award. WAPA’s approval of the work schedule is required prior to the commencement of work.

2.4 Government Furnished Property (GFP)

2.4.1 Government Furnished Property (GFP) includes any personal property, real property, equipment, information, materials, utilities, or other supplies owned by the Government and provided for Contractor use in performance of this contract.

2.4.2 The Government will not furnish any property, equipment or materials for use under this contract.

2.4.3 The Contractor shall furnish all materials, equipment, information, supplies, and off-site storage required to complete performance of this contract.

2.4.4 The Government will provide electrical power for Contractor use at sites with existing power outlets for the operation of equipment as necessary to perform services. Contractor shall furnish and provide power for sites without electrical power.

2.4.5 The Government will provide water at sites where it is available from an existing outdoor source. Contractor shall furnish and provide water for those sites without existing water.

3 WAPA REQUIREMENTS

3.2 Pre-Performance Meeting

The CO may determine it is appropriate to hold a Pre-Performance Meeting with the Contractor to discuss contract requirements prior to the start of work. The meeting may be held in person or by teleconference, at the discretion of the CO.

The Contractor may not begin performance until the Pre-Performance Meeting is held or the CO has advised the Contractor that a Pre-Performance Meeting will not be held.

3.3 Contractor Personnel

3.3.1 The Contractor shall have a competent on-site representative authorized to act on behalf of the Contractor, available to the CO or COR to receive instructions or information regarding work under the contract. The on- site representative must be able to fluently speak and understand English.

3.3.2 The Contractor shall furnish adequate supervision at the premises to ensure that work is performed in a satisfactory manner. It is the responsibility of the Contractor to maintain surveillance over personnel employed to perform work on the contract.

3.3.3 No unauthorized personnel are permitted on WAPA premises.

3.4 Contract Work Hours

3.4.1 SNR normal business hours are 7:30 a.m. to 4:30 p.m., Monday through

Friday, excluding Federal holidays. Contractor work may be authorized outside normal business hours on a case-by-case basis with prior approval from the CO and COR.

3.4.2 Federal Holidays: Unless specifically negotiated, the Contractor is not required to provide service on New Year’s Day (1 January), the birthday of Martin Luther King Jr. (3rd Monday in January), Washington’s Birthday (3rd Monday in February), Memorial Day (last Monday in May), Independence Day (4 July), Labor Day1st Monday in September), Columbus Day (2nd Monday in October), Veterans Day (11 November), Thanksgiving Day (4th Thursday in November), or Christmas Day (25 December). If the holiday falls on Saturday, it is observed the preceding Friday. If the holiday falls on a Sunday, it is observed on the subsequent Monday.

3.5 Contractor Equipment, Materials, Supplies, and Storage

3.5.1 The Contractor must provide off-site storage space for all equipment, materials, supplies, etc.; nothing may be stored on WAPA property.

3.5.2 The Government will provide an on-site staging area for the Contractor to store equipment, materials, supplies, etc. The Government is not liable for loss or damage to Contractor property.

3.6 Environmental Requirements

3.6.1 The Contractor shall dispose of or recycle hazardous, universal, and non-hazardous waste material in accordance with all applicable Federal, State and local laws, regulations and ordinances and current policies and procedures identified by WAPA. Wastes shall be reduced by recycling, reusing, or reprocessing to the maximum extent practicable.

3.6.2 Hazardous, Universal, and Non-Hazardous Wastes. The Contractor shall manage hazardous, universal, and non-hazardous wastes in accordance with all applicable State, Federal and Local regulations, and existing policies and procedures identified by WAPA.

3.6.3 Contractor’s Liability for Regulated Material Incidents. The Contractor is solely liable for all expenses related to spills, mishandling, or incidents of regulated material (such as, but not limited to petroleum products and pesticides) attributable to its employees’ actions or the actions of its subcontractors. This includes all response, investigation, cleanup, disposal, permitting, reporting, and requirements from applicable environmental regulation agencies.

3.7 Safety Requirements

3.7.1 The Contractor shall comply with the latest effective standards promulgated by the Department of Labor, Occupational Safety and Health Administration, Safety and Health Standards, 29 CFR 1910 and 29 CFR 1925, and shall comply with all applicable safety and health regulations and requirements, including DOE and WAPA requirements.

3.7.2 The Contractor shall take all reasonable precautions in the performance of the work under this contract to protect the safety and health of employees and members of the public and shall comply with all applicable safety and health regulations and requirements, including DOE and WAPA requirements.

3.7.3 The Contractor shall maintain an accurate record of and shall immediately report to the COR and the CO, all cases of death, occupational disease, or traumatic injury to employees or the public, and any property damage as a result of performance under this contract.

3.7.4 The Contractor shall ensure that its employees are provided with personal protective equipment (PPE) as necessary in accordance with established regulations and procedures. This equipment includes, but is not limited to, occupational foot protection and eye and face protection as required by OSHA Standards, 29 CFR 1910 and as required by WAPA safety standards and directives.

3.7.5 The Contractor shall ensure that its employees have been appropriately instructed and trained in the proper use of any equipment, vehicles, and/or personal protective equipment needed for the performance of their duties. The Contractor shall ensure that its employees comply with all applicable Federal, State, and/or local safety rules and regulations in the performance of their duties.

3.7.6 The Contractor shall report all near misses to the CO, COR within 24 hours of the occurrence. These near- miss reports, identifying the nature of the hazard and the corrective actions which have been implemented to prevent a reoccurrence in the future, may be generic, with no mention of individual employees involved in the incident. Near-miss reports are used as an information tool and are distributed regionally.

3.7.7 The Contractor is required to establish a Safety Plan/Program which includes, in addition to other requirements, a monthly safety meeting for all employees (with the exception of office staff). The Contractor's Safety Plan shall be documented and available for the CO and COR to review at any time.

3.8 Security Requirements

3.8.1 Contractor personnel shall be alert to surroundings and notify the CO, COR, SNR Safety/Security Office, or on-duty Contractor security staff after hours of suspicious activity, including unescorted persons who do not have a visitor’s badge, or known or suspected unauthorized removal of Government property from the facility.

3.8.2 Contractor personnel shall notify the CO, COR and SNR Safety/Security

Office, or on-duty Contractor security staff after hours, if they have any security issues or concerns.

3.8.3 Contractor personnel shall protect identification badges and card keys and notify the SNR Security Manager within 24 hours if card keys or badges are lost. Badges and card keys shall be returned to the SNR Security

Manager when employment is terminated. (Reference clauses WES-H- 1045 and WES-H-1055.)

3.8.4 Contractor personnel shall not prop open doors, and when entering or leaving the complex shall ensure that doors and gates are secure. Contract staff shall notify the SNR Security Manager if they are unable to secure a door or gate.

3.8.5 Contractor personnel shall not allow any person to enter WAPA property without proper clearance from the SNR Security Office.

3.8.6 The Government may require immediate removal of the employee from the contract and the job site for conduct issues deemed by the Government to be serious (for example, violent behavior or comments, theft, misuse of Government equipment, unsafe work practices, fraudulent activity, etc.).

3.9 Quality Control and Quality Assurance

3.9.1 The Contractor is responsible for quality control and shall utilize its own internal quality control processes in the performance of this contract. The Contractor shall develop and maintain a Quality Control Plan (QCP) to ensure all services are performed in accordance with the Government’s performance objectives.

3.9.2 Performance Requirements Summary (PRS). See PWS Attachment 1. The

PRS is a listing of significant performance objectives and standards that will be monitored and inspected by Government personnel. Each performance objective represents a critical function as identified by the Government at the time of contract award. The performance standard represents the minimum acceptable level of Contractor performance. The performance objectives and standards represent only the critical components of this Contract, and do not excuse the Contractor from performance of other responsibilities identified in the PWS. All services described in this PWS are subject to inspection/surveillance by the Government.

3.9.3 Government Surveillance of Contractor Performance. In order to supplement the Contractor’s QCP, WAPA personnel will verify Contractor compliance with essential performance requirements. The Government may use various methods to perform surveillance of Contractor performance, including customer input, random sampling, periodic inspection, Contractor reporting, etc.

3.9.4 Contract Discrepancy Report (CDR). See PWS Attachment 2. A CDR may be initiated by the CO or COR at any time during contract performance if results of WAPA’s quality assurance surveillance show the number of observations of unacceptable performance during the period exceeds the threshold specified in the PRS, and the CO/COR determines that the unacceptable performance was not caused by the Government.
