QUALITY ASSURANCE

PERFORMANCE-BASED QUALITY ASSURANCE SURVEILLANCE PLAN

(QASP) FOR

WASHINGTON AQUEDUCT VENTURI FLOWMETER MAINTENANCE

1. INTRODUCTION

This Performance-Based Quality Assurance Surveillance Plan (QASP) has been developed pursuant to the requirements of the Performance Work Statement (PWS). This plan sets forth procedures and guidelines that the USACE will use in evaluating the technical and safety performance of the Contractor. A copy of the Performance Metrics is furnished in the PWS so that the Contractor will be aware of the methods that the Government will employ in evaluating their performance on this contract.

From the PWS: “The Contractor shall furnish all supplies, materials, equipment, facilities, and services required to perform work under this contract. The Contractor shall be responsible for complying with any municipal laws, codes, and regulations applicable to the performance of the work. The Contractor shall be responsible for all materials delivered and work performed until completion and acceptance of the entire work.”

2. PURPOSE OF THE QASP

The QASP is intended to accomplish the following:

a. Define the roles and responsibilities of participating Government officials;

b. Define the types of work to be performed with required end results;

c. Document the evaluation methods that will be employed by the Government in assessing the Contractor’s performance;

d. Provide the Surveillance Activity Checklists and Corrective Action Request

(CAR) forms that will be used by the Government in documenting and evaluating the Contractor’s performance; and

e. Describe the process of performance documentation.

f. Outline quality assurance procedures to be employed by the Government during performance of this task order to confirm that the site characterization is conducted utilizing proper procedures and in accordance with the approved work and safety plans.

3. GOVERNMENT ROLES AND RESPONSIBILITIES

The following personnel shall oversee and coordinate surveillance activities.

a. Contracting Officer (KO) - The KO shall ensure performance of all necessary actions for effective contracting, ensure compliance with the contract terms, and shall safeguard the interests of the United States in the contractual relationship. The KO shall also assure that the contractor receives impartial, fair, and equitable treatment under this contract. The KO is ultimately responsible for the final determination of the adequacy of the contractor’s performance.

Assigned KO:

The contractor shall refer any changes they deem may affect contract price, terms, or conditions to the KO for action.

Assigned COR: Charles Ross Telephone: 202-587-9169 Email: Charles.W.Ross2@usace.army.mil

4. CONTRACTOR REPRESENTATIVES

The following employees of the contractor serve as the contractor’s Task Manager for this contract.

Technician – TBD Telephone: TBD Email: TBD

5. METHODOLOGIES TO BE USED TO MONITOR THE

CONTRACTOR’S PERFORMANCE

Even though the Government, through its CORs located on site with the contractor, will be monitoring the contractor’s performance on a continuing basis, the volume of tasks performed by the contractor makes technical inspections of every task and step impractical. Accordingly, USACE will use the Surveillance Activity Table (Attachment A) as the basis for monitoring the contractor’s performance under this contract. The contractor’s performance will be evaluated by the Contracting Officer using the Performance Metrics listed in CPARS.

Quality Assurance Surveillance Activities In general, the work will be evaluated in terms of how well the requirements of the task order are satisfied, the extent to which the work performed follows the approach found in the contractor’s technical proposal, clarity of documentation, and timeliness of scheduled task accomplishment. At the discretion of the COR or the Contracting Officer or Specialist, other government officials approved by the Contracting Officer or Specialist may be asked to evaluate a particular deliverable or set of deliverables.

QUALITY ASSURANCE SURVEILLANCE TECHNIQUES

1 General. Some contract requirements have a more significant and important impact on the facilities or services provided. 100 percent inspection might be used for “critical” or “important” requirements; planned sampling or random sampling for “less important requirements”; and validated customer complaints or incidental inspection for the ‘least important requirements”. A method of surveillance is chosen for each contract requirement and a variety of surveillance methods are used for the inspection of the contract.

2 Random Sampling. Surveillance based on random sampling evaluates a portion of the work, accurately estimating Contractor performance through the use of statistical theory. Random sampling is most useful on large homogeneous populations where 100% inspection is not required or feasible.

Also, if appropriate provisions are included in the specification and the random sampling is properly conducted, the percentage of defective work items found in the sample, adjusted for inaccuracies, may be extrapolated and deducted from the Contractor’s payment invoice. Random sampling will not be used for any inspections of Grounds Maintenance due to the small size of the Grounds Maintenance populations. Random sampling of small populations approach 100% inspection and are too labor intensive to be economical.

3 Planned Sampling. Planned sampling is similar to random sampling in that it is based on evaluating a portion of the work as the basis for evaluating the Contractor’s performance. Samples are selected based on a subjective rationale and the sample size is arbitrarily determined. Planned sampling is useful when population sizes are not large enough or homogeneous enough to make random sampling practical. Planned sampling will be used to surveille most grounds maintenance requirements.

4 One Hundred Percent Inspection. One hundred percent inspection is generally used for those services which are considered very important, those which have relatively small monthly populations, and those included in the indefinite quantity portion of the contract. 100% inspection will be used for acceptance of all extra work (special projects) including labor and material.

5 Validated Complaints. Validated complaints is a quality assurance method based on customer awareness. Building Residents are made aware of contract requirements and monitor the services provided by the Contractor. Where there is a case of poor performance or nonperformance, the Government (COR) is notified. The COR investigates the report and, if it is found to be valid, documents it. Customer Complaints will be used to supplement other surveillance techniques.

6 Unscheduled Inspection. Unscheduled inspection consists of impromptu evaluation of contract requirements whenever the COR feels there may be a need. This method is used to investigate suspected problems and will be used to support other methods of inspection. Unscheduled inspections are never used as a primary evaluation method of surveillance.

6. QUALITY ASSURANCE REPORTING FORMS

The forms used to document surveillance activities include Contractor’s Progress Report (Appendix F of CENAB Standard 18504.0) and/or Memorandums for Record. Nonconformance will be documented on a Corrective Action Request (CAR), Non-conformances are documented at the discretion of the person conducting the surveillance activity, but should be fair and reasonable. Each CAR will be annotated as a Critical nonconformance, Major nonconformance, or Minor nonconformance. CARs will be provided to the Contracting Officer for distribution to the contractor.

The contractor will be required to correct safety issues immediately. All other CARs will provide a reasonable suspense date for the contractor to review and take appropriate action, usually 10 calendar days. The contractor is required to provide written responses to all CARs.

Completed forms will be consolidated and provided to the Contracting Officer at the end of each month for that month's surveillance activities.

These forms, when completed, will document the contractor's compliance with contract requirements and completion of milestone activities. The Contracting Officer will evaluate contractor performance using the definitions contained in the CPARS and the metrics identified in this PWS.

b. UNACCEPTABLE PERFORMANCE.

Unacceptable performance is defined as the unavailability of technical support, no response to service requests, incomplete work, unavailability of parts, and/or not providing a written service report. Should routine unacceptable performance occur, the COR shall inform the contractor. This will normally be in writing unless circumstances necessitate verbal communication. In any case the COR shall document the discussion and place it in the COR file.

When the COR determines formal written communication is required, the COR shall prepare a Contract Discrepancy Report (CDR), and present it to the contractor's task manager or on-site representative. A CDR template is attached to this QASP.

The contractor shall acknowledge receipt of the CDR in writing. The CDR will specify if the contractor is required to prepare a corrective action plan to document how the contractor shall correct the unacceptable performance and avoid a recurrence. The CDR will also state how long after receipt the contractor has to present this corrective action plan to the COR. The Government shall review the contractor's corrective action plan to determine acceptability.

Any CDRs may become a part of the supporting documentation for contract payment deductions, fixed fee deductions, award fee nonpayment, or other actions deemed necessary by the KO.

10. FREQUENCY OF MEASUREMENT

During contract/order performance, the COR will take measurements of the contractor’s performance during performance of work.

CLAUSES INCORPORATED BY FULL TEXT

52.202-1 DEFINITIONS (JUN 2020)

When a solicitation provision or contract clause uses a word or term that is defined in the Federal Acquisition Regulation (FAR), the word or term has the same meaning as the definition in FAR 2.101 in effect at the time the solicitation was issued, unless--

(a) The solicitation, or amended solicitation, provides a different definition;

(b) The contracting parties agree to a different definition;

(c) The part, subpart, or section of the FAR where the provision or clause is prescribed provides a different meaning;

(d) The word or term is defined in FAR part 31, for use in the cost principles and procedures; or

(e) The word or term defines an acquisition-related threshold, and if the threshold is adjusted for inflation as set forth in FAR 1.109(a), then the changed threshold applies throughout the remaining term of the contract, unless there is a subsequent threshold adjustment; see FAR 1.109(d).

(End of clause)

52.203-7 ANTI-KICKBACK PROCEDURES (JUN 2020)

(a) Definitions.

"Kickback," as used in this clause, means any money, fee, commission, credit, gift, gratuity, thing of value, or compensation of any kind which is provided to any prime Contractor, prime Contractor employee, subcontractor, or subcontractor employee for the purpose of improperly obtaining or rewarding favorable treatment in connection with a prime contract or in connection with a subcontract relating to a prime contract.

"Person," as used in this clause, means a corporation, partnership, business association of any kind, trust, joint-stock company, or individual.

"Prime contract," as used in this clause, means a contract or contractual action entered into by the United States for the purpose of obtaining supplies, materials, equipment, or services of any kind.

"Prime Contractor," as used in this clause, means a person who has entered into a prime contract with the United States.

"Prime Contractor employee," as used in this clause, means any officer, partner, employee, or agent of a prime Contractor.

"Subcontract," as used in this clause, means a contract or contractual action entered into by a prime Contractor or subcontractor for the purpose of obtaining supplies, materials, equipment, or services of any kind under a prime contract.

"Subcontractor," as used in this clause, (1) means any person, other than the prime Contractor, who offers to furnish or furnishes any supplies, materials, equipment, or services of any kind under a prime contract or a subcontract entered into in connection with such prime contract, and (2) includes any person who offers to furnish or furnishes general supplies to the prime Contractor or a higher tier subcontractor.

"Subcontractor employee," as used in this clause, means any officer, partner, employee, or agent of a subcontractor.

(b) 41 U.S.C. chapter 87, Kickbacks, prohibits any person from--

(1) Providing or attempting to provide or offering to provide any kickback;

(2) Soliciting, accepting, or attempting to accept any kickback; or

(3) Including, directly or indirectly, the amount of any kickback in the contract price charged by a prime Contractor to the United States or in the contract price charged by a subcontractor to a prime Contractor or higher tier subcontractor.

(c)(1) The Contractor shall have in place and follow reasonable procedures designed to prevent and detect possible violations described in paragraph (b) of this clause in its own operations and direct business relationships.

(2) When the Contractor has reasonable grounds to believe that a violation described in paragraph (b) of this clause may have occurred, the Contractor shall promptly report in writing the possible violation. Such reports shall be made to the inspector general of the contracting agency, the head of the contracting agency if the agency does not have an inspector general, or the Attorney General.

(3) The Contractor shall cooperate fully with any Federal agency investigating a possible violation described in paragraph (b) of this clause.

(4) The Contracting Officer may (i) offset the amount of the kickback against any monies owed by the United States under the prime contract and/or (ii) direct that the Prime Contractor withhold, from sums owed a subcontractor under the prime contract, the amount of any kickback. The Contracting Officer may order the monies withheld under subdivision (c)(4)(ii) of this clause be paid over to the Government unless the Government has already offset those monies under subdivision (c)(4)(i) of this clause. In either case, the Prime Contractor shall notify the Contracting Officer when the monies are withheld.

(5) The Contractor agrees to incorporate the substance of this clause, including this paragraph (c)(5) but excepting paragraph (c)(1) of this clause, in all subcontracts under this contract that exceed the threshold specified in Federal Acquisition Regulation 3.502-2(i) on the date of subcontract award.

(End of Clause)

The Offeror also shall enter its EFT indicator, if applicable. The unique entity identifier will be used by the Contracting Officer to verify that the Offeror is registered in SAM.
