Processes for Privileging Telemedicine Services:

Clinical privileges may be granted for individuals providing services exclusively via telemedicine. These privileges do not extend to care delivered in-person and on-site in IHS facilities. These privileges also do not require appointment to the IHS facility medical staff. (As per a final ruling from CMS released May 5, 2011, the governing body of a hospital or critical access hospital must ensure that a physician or licensed independent practitioner providing telemedicine services from a distant-site telemedicine hospital or entity does so in a manner that enables the hospital receiving the services to comply with all the applicable conditions of participation (CoP) and standards relevant for those services. Compliance with CMS CoP requires that all telemedicine practitioners receive privileges at IHS hospitals prior to delivering telemedicine services. In accordance with CMS regulations at 42 CFR 482.22(a)( 4), the hospital will also rely on the credentialing and privileging decisions of non-hospital entities providing telemedicine services under contract, known as "distant-site telemedicine entities", if the the hospital's governing body ensures, through its written agreement with the distant-site telemedicine entity, that all of the following provisions are met:

1. The distant-site telemedicine entity's medical staff credentialing and privileging process and standards conform with CMS standards §482.12(a)(l) through (a)(7) and §482.22(a)(l) through (a)(2);

2. The practitioner at the distant-site telemedicine entity is privileged at the distant site telemedicine entity;

3. The distant-site telemedicine entity provides a current list of the distant-site telemedicine entity's practitioner's privileges;

4. The practitioner at the distant-site telemedicine entity holds a valid, umestricted license in a U.S. state, territory, or commonwealth of the U.S;

5. The IHS hospital has an internal review of the distant-site telemedicine entity's practitioner's performance and provides this information to the distant-site telemedicine entity. Information sent from the IHS hospital to the distant-site telemedicine entity must include, at a minimum, all adverse events and complaints regarding telemedicine services provided by the distant-site telemedicine entity practitioner to the IHS hospital.

6. The above information is specified in a written agreement between the IHS hospital and the distant-site telemedicine entity. The distant-site telemedicine entity must furnish the contracted telemedicine services in a manner that permits the hospital to comply with all applicable CMS conditions of participation for the contracted services.)
