About this file
This is a Sole Source Justification (SSJ) for an 8(a) GSA Multiple Award Schedule order issued by the Department of Health and Human Services, Office of Mission Acquisition Solutions (OMAS).
OMAS is procuring workforce competency assessment services for approximately 200 employees through a sole-source award to MMC Investments I, LLC dba MMC Government Solutions, located at 8201 Corporate Drive, Suite 120-D, Landover, MD 20785. The order will be placed against GSA MAS contract 47QRAA25D00CB under SINs 541611 and 611430. The estimated total contract value is $750,000, consisting of a base year (12 months) and one option year (12 months), with award projected for 2026 using fiscal year 2026 funds. The contractor will provide a workforce competency assessment program grounded in the National Contract Management Association's Contract Management Standard (CMS), producing individual assessment reports and enterprise-level workforce analytics incorporating self-assessments, workforce attributes, and operational performance data. All work must comply with federal data security and privacy requirements. The sole-source justification is authorized under FAR 8.401 and GSAM/R 538.7104-3(b)(1)(v), utilizing the Small Business Act Section 8(a) Program authority. Market research determined no SBA-approved government-wide contract vehicles were available that would permit competitive 8(a) ordering at this dollar value with the specialized scope required. SBA provided acceptance of the requirement via acceptance letter dated May 1, 2026 (SBA requirement number 92158). Price reasonableness will be determined through comparison to an Independent Government Cost Estimate, evaluation of labor mix and level of effort, and the contractor's existing GSA MAS ceiling rates, with the Contracting Officer requesting discounts in the price quote.

PACT and OMAS are designed to enable:
• Coordinated purchasing strategies to achieve better value
• Consolidation and alignment of acquisition systems and processes
• Increased transparency and accountability across procurement activities
• Adoption of modern technologies, including AI-enabled tools, to support acquisition decision-making
OMAS is streamlining the procurement of common professional services and IT goods and services within a centralized office staffed by approximately 200 acquisition professionals. This team was assembled from across the Department into a newly structured organization with evolving roles, responsibilities, work assignments, and performance expectations. This reorganization created an immediate need for evidence-based workforce insight. HHS is simultaneously operating under compressed timelines to fill critical workforce vacancies and onboard new personnel.
OMAS does not currently possess an integrated, acquisition-specific capability for ingesting and translating workforce skill maturity data, job task confidence, operational metrics, and performance indicators into actionable decision intelligence. Without this capability, particularly during a period of significant organizational transition, the Department faces increased risk of workforce misalignment, inefficient training investments, reduced onboarding effectiveness, and diminished long-term retention.
OMAS is seeking contractor support to provide a workforce competency assessment program for up to 200 employees. The program shall be grounded in the National Contract Management Association’s (NCMA) Contract Management Standard™ (CMS) and shall produce individual assessment reports and an enterprise-level workforce overview supported by advanced analytics. The program shall incorporate multiple data sources, including self-assessment, workforce attributes, and available operational performance data. All work shall be performed in accordance with applicable federal data security and privacy requirements.
4. Authority Cited and Rationale: Authority of the FSS Program, Title III of the Federal Property and Administrative Services Act of 1949 (41 U.S.C. 251, et seq.); Title 40 U.S.C. 501, Services for Executive Agencies, as implemented at FAR 8.401 and GSAM/R 538.7104-3(b)(1)(v).
GSAM/R 538.7104-3(b)(1)(v)- A law expressly authorizes or requires that the purchase be made from a specified source.
The proposed order will be awarded as a sole-source acquisition under the SBA 8(a) Business Development Program pursuant to section 8(a) of the Small Business Act, 15 U.S.C. § 637(a).
Section 8(a) of the Small Business Act authorizes SBA to enter into procurement contracts with Federal agencies and to arrange for performance of those requirements by eligible 8(a) Program participants. The statute therefore provides authority for qualifying acquisitions to be awarded through the 8(a) Program without competition when the applicable statutory, regulatory, SBA, and agency requirements for a sole-source 8(a) acquisition are satisfied.
The Government intends to use the statutory authority of the 8(a) Business Development Program to make a permissible sole-source award to an eligible 8(a) participant.
Because this order exceeds the simplified acquisition threshold and will be awarded on a sole-source basis under the FSS Program, this written justification is prepared pursuant to GSAR 538.7104-3(b). The applicable FSS statutory exception is GSAR 538.7104-3(b)(1)(v).
5. Market Research: In accordance with FAR 19.108-7(d)(1), the Contracting Officer reviewed available government-wide multiple-award contract vehicles to determine whether an SBA-approved vehicle was available that would permit competition of this requirement exclusively among eligible 8(a) contract holders.
Based on market research, no SBA-approved government-wide contract was identified that both permitted a competitive 8(a) order at this dollar value and provided contract scope and eligible 8(a) contract holders capable of addressing the specialized workforce competency assessment, acquisition-workforce analytics, organizational decision-support, and related implementation services required by OMAS. The Contracting Officer therefore was unable to identify an available SBA-approved government-wide contract under which a meaningful competitive 8(a) order could be conducted for this requirement.
Accordingly, the Contracting Officer determined that an appropriate SBA-approved government-wide contract was not available for this specialized requirement. The Government may therefore proceed with consideration of a sole-source 8(a) award, subject to verification of the proposed participant’s eligibility and SBA’s acceptance of the specific requirement into the 8(a) Program.
6. Procurement history: N/A. This is a new requirement with no procurement history.
7. Actions to Foster Competition for Future, Similar Requirements: The Government will continue to assess the marketplace and available acquisition vehicles as this requirement matures. For future similar or successor requirements, the Contracting Officer will conduct market research to determine whether additional qualified sources have entered the market and whether an SBA-approved government-wide contract is available that would permit competition among eligible 8(a) contract holders for the required specialized services.
The Government will also evaluate whether the requirement can be structured to support broader competition, including competition among eligible 8(a) participants, competition under the Federal Supply Schedule Program, or other competitive acquisition approaches consistent with the Government’s requirements and applicable acquisition regulations.
8. Additional Information or Other Facts: A sole-source order through the MAS 8(a) Pool requires order-level offer and acceptance by SBA before award.
The Contracting Officer received SBA’s acceptance letter dated May 1, 2026.
SBA requirement number: 92158
9. Technical or Requirements Program Management Certification: I certify that the supporting data under my cognizance which are included in the justification are accurate and complete to the best of my knowledge and belief.

10. Best Value Determination: As the contracting officer, I hereby determine that the anticipated price to the Government for this contract action represents the best value for the Government.
The Contracting Officer will determine price reasonableness through comparison to the Independent Government Cost Estimate (IGCE), evaluation of labor mix and level of effort, and the vendor’s awarded pricing available under its GSA MAS contract. MMC Investments I, LLC holds active MAS contract 47QRAA25D00CB under SINs 541611 and 611430, which establishes ceiling rates and awarded schedule terms for the categories of services relevant to this requirement.
MMC Government Solutions’ proposed pricing will be based on its awarded GSA MAS contract rates, which have already been determined fair and reasonable under FAR Subpart 8.4.
The Contracting Officer will request discounts in the price quote.
11. Contracting Officer (CO) Certification and Approval: I hereby certify that this justification is accurate and complete to the best of my knowledge. [Always required; CO approval authority is limited to $900 thousand.]
