About this file

This document is a Determination to Solicit from a Single Source for the U.S. Department of the Interior, Bureau of Reclamation, Missouri Basin Regional Office. The procurement is for non-monetary recognition items to be distributed to staff, supporting employee engagement and team identity. The document justifies sole-source procurement from Exousia Marketing Group and Ad-Wares, as they are the only vendors authorized to use the Bureau of Reclamation logo after completing a detailed approval process.

The sole-source determination is based on the unique branding requirements, which include strict standards for logo placement, color accuracy, and usage. The price is determined to be fair and reasonable through publicly available catalog pricing from Exousia. The contracting officer, Brandon Collins, signed the document on 9/17/2025, confirming that no other vendors can meet the requirements without causing significant project delays or violating the agency's intellectual property guidelines.

DETERMINATION TO SOLICIT FROM A SINGLE SOURCE

Pursuant to Federal Acquisition Regulation (FAR) 13.106-1(b)(1)(i), for purchases not exceeding the Simplified Acquisition Threshold (SAT) Contracting Officers may solicit from only one source if the circumstances of the contract action deem only one source is reasonably available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization).

Pursuant to FAR 13.106-1(b)(1)(ii), when a single source is identified to provide a portion of the purchase as a Brand-Name, the documentation in paragraph 3 must state that this determination is only for a portion of the requirement.

1. Agency and Contracting Activity. U.S. Department of the Interior, Bureau of Reclamation, Missouri Basin Regional Office.

2. Name and Address of Single Source. Exousia Marketing Group, 1946 Shoreline DR Grovetown, Georgia 30813

3. Description of Supplies/Services and Estimated Cost. This procurement is for the purchase of various non-monetary recognition items to be distributed to staff. These items are intended to support employee engagement and team identity across the organization.

4. Description of Circumstances, including why only one source is reasonably available.

In accordance with FAR 13.106-1(b)(1)(ii), the unique circumstances surrounding the use of the Bureau of Reclamation logo justify limiting this procurement to Ad-Wares and Exousia.

These vendors have been authorized to use the logo after undergoing the following steps:

• Approval Process for Logo Use: The use of the Bureau of Reclamation logo is subject to a detailed and lengthy approval process. Vendors must submit samples of their products featuring the logo for approval, ensuring compliance with strict branding standards and legal requirements.

• Exclusivity of Branding Approval: Ad-Wares and Exousia have already undergone this approval process, which is time-consuming and resource-intensive. Given the requirement to adhere to agency-specific branding guidelines, only these vendors are authorized to use the logo on the requested items without additional delays.

• Unique Branding Requirements: The specific items in question (e.g., branded merchandise, promotional items) must meet exacting standards for logo placement, color accuracy, and usage that are defined by the agency. These standards ensure that the brand integrity of Bureau of Reclamation is maintained and protected in all public-facing materials.

• Proprietary Nature of Approval: The process for logo approval is proprietary and tightly controlled by the agency’s legal and branding teams. As such, only Ad-Wares and

Exousia, who have already been vetted and authorized, are able to continue with the required work.

Due to these unique factors, Ad-Wares and Exousia are the only sources that can furnish the requested products with the Bureau of Reclamation logo, as no other vendors have been approved or have gone through the extensive approval process necessary to use the logo. An email went out to both contractors and Ad-Wares stated that they would not be able to get a quote back to reclamation within the timeframe required.

5. Determination of Fair and Reasonable Price. The price determination for this procurement is based on publicly available catalog pricing from Exousia, which is accessible to the public and provides transparent, market-based pricing for the items being procured. In accordance with FAR 13.106-3(a)(2)(ii), a fair and reasonable price was determined by comparison of the proposed prices with published catalog or market prices of items sold in substantial quantities to the public. The Exousia catalog reflects current commercial pricing for the specific items being procured with options for branding and customization.

The catalog serves as a reliable basis for comparison, demonstrating consistency with market rates for similar quality and type of goods. Given the transparency, commercial availability, and competitive nature of the catalog pricing, the contracting officer has determined that the prices offered are fair and reasonable.

6. Description of Market Research. While other vendors may exist that could produce similar items, none are authorized to use the Bureau of Reclamation logo without undergoing the lengthy approval process that Ad-Wares and Exousia have already completed. As such, no other vendors can meet the requirements without causing significant delays in the project timeline and violating the agency's intellectual property guidelines.
