LIMITED SOURCES JUSTIFICATION
1. Defense Logistics Agency (DLA) Troop Support, Medical Supply Chain, Capital Equipment Division, is the contracting activity.
2. This justification is for the acquisition of brand name products or features essential to United States Army requirements under the authority of the Electronic Catalog (ECAT) multiple-award schedule program. The acquisition will be of items from Onsite Gas Systems’ ECAT contract number SPE2D1-18-D-0001, which expires October 11, 2022.
3. The US Army Medical Materiel Agency (USAMMA) has a requirement for the following Oxygen Generator Systems. This requirement entails the purchase from the source, and shipment to USAMMA Medical Maintenance Management Directorate (M3D) assembly point at Hill Air Force Base Utah.
Document Number: W25MWY81520066 Item Description: Portable Oxygen Generation System (POGS)
Onsite Gas Systems Part Number (P/N): POGS-33C Quantity: 10 each Unit Price: $38,321.55 Total Estimated Dollar Value: $383,215.50
4. The authority waiving the competition requirements is FAR 8.405-6(a)(1)(i)(B): only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized.
The required POGS-33C are non-developmental items designed to produce medical grade oxygen and treat patients in a deployed environment. The POGS-33C produces 93% United States Pharmacopeia (USP) Medical Grade Oxygen at a rate of 30 liters per minute (1pm).
The POGS- 33C are used to operate field anesthesia devices in the operating room, support patient ventilators in pre- and post-op wards, and fill high pressure D-sized oxygen cylinders (2,200 psi) used in ground and air patient evacuation.
POGS-33C are provisioned with all necessary accessories and supplies, are standard issue to Army Combat Support Hospitals, Forward Surgical Teams, and other Medical Logistics Army Customers, are part of the Army's deployable health care system and are an authorized requirement under Department of the Army approved Table of Organization and Equipment
(TOE).
Following are the POGS minimum requirements that were established by the US Army:
a) The POGS shall produce medical grade oxygen at 93% USP.
b) The POGS shall be U.S. Food and Drug Administration (FDA) approved as a medical device and manufactured consistent with the Quality System Regulation (QSR).
c) The POGS shall have operating pressure able to be regulated between 50 - 60 psi
d) The POGS shall have the capability to fill cylinders to 2,200 psi.
e) The POGS shall operate on alternating current power 220+/- 10% VAC, 60 +/- 2 Hz single phase or 208 to 220+/- 10% VAC 60+/- 2 Hz three phase power.
f) The POGS shall be compact, portable (transportable by field personnel) in size and be able to produce medical grade oxygen at 50 psi at a rate of 30 1pm.
Onsite Gas Systems’ POGS-33C are the only items on ECAT which meet these minimum requirements.
5. DLA Troop Support contracting officer has already determined the prices of supplies under Onsite Gas Systems’
ECAT contract fair and reasonable based upon a Defense Contract Management Agency (DCMA) audit and a DLA Pricing and Strategy Division review of the Onsite Gas System ECAT contract.
A determination has been made by the contracting officer that this order represents the best value to the Government and results in the lowest overall cost alternative (considering price, special features, and administrative cost) consistent with FAR 8.404(d).
6. Market research was performed by a DLA Engineer in ECAT in October 2018. The DLA Engineer found that there are two other potential portable oxygen generation suppliers with ECAT contracts. They are Essex Industries and Pacific Consolidated Industries (PCI).
• Essex Industries manufactures PTLOX, NPTLOX (Portable Therapeutic Liquid Oxygen and
Next Portable Therapeutic Liquid Oxygen) and Oxygen Generator and Liquefier (OGL);
however; the PTLOX and NPTLOX are portable oxygen storage and distribution systems only and they do not produce oxygen. Therefore, the PTLOX and NPTLOX systems do not meet the minimum requirement (a and f) in paragraph (4) above.
The OGL unit is an oxygen generator, liquefies and stores for transfer liquid oxygen (LOX) to portable devices. It weighs 740 lbs. empty and 880 lbs. full and is designed to be moved by a forklift; therefore, it cannot be transported by field personnel and is not portable. The OGL does not meet the minimum requirement (f) in the paragraph (4) above.
• PCI manufacturers a PODS unit is currently available on ECAT that is a portable oxygen distribution system which does not produce oxygen and, therefore, does not meet the minimum requirement (a and f) in paragraph (4) above.
The market research described above indicates that there are no other products currently available on ECAT that can meet the Army's minimum requirements.
7. ECAT vendors have the opportunity to add products that fall within the scope of the ECAT program at any time. Consequently, any ECAT vendor not currently offering a POGS system has the opportunity to add one or other items that meet the Army’s minimum requirements, thereby enhancing competition.
8. DLA Troop Support will attempt to locate other acceptable sources for future requirements as they arise; however, any new item would be required to meet the US Army's rigorous requirements.
9. As the Contracting Officer, I hereby certify that the information contained in this Limited Sources
Justification is accurate and complete to the best of my knowledge and belief.
I hereby certify that the requirements that form the basis of this justification are accurate, that these supplies meet the Government's minimum needs and that this justification is accurate and complete to the best of my knowledge and belief.
I have reviewed this justification and recommend approval.
