About this file

This document contains a justification and approval for other than full and open competition for a federal contract award. The Southern Arizona VA Health Care System required a replacement cardiology picture archiving and communication system with virtual servers, as their existing system was declared end of life and no longer serviceable. The sole source award was made to Siemens Medical Solutions USA, Inc. for over $328,993 to provide a Syngo Dynamics VA40 EL platform with proprietary software, implementation services, training, and support. This non-competitive award was justified as Siemens is the original manufacturer of the required Syngo software and only authorized distributor, and their system offers the best integration with the VA's upcoming Cerner electronic health record modernization project through a Cerner preferred partnership.

Justification and Approval (J&A) For

Other Than Full and Open Competition (>SAT)

Acquisition Plan Action ID: 36C25820AP0987

Contracting Activity:

Department of Veterans Affairs, Network Contracting Office NCO 22-Gilbert.

Southern AZ VA Health Care System. 2237# 678-20-3-071-0077

Nature and/or Description of the Action Being Processed:

This requirement is for the Medicine Service Line of the Southern AZ VA Health Care System (SAVAHCS) located 3601 S. 6th Avenue, Tucson, Arizona who need to procure a replacement Cardiology Picture Archiving and Communication System (PACS) with virtual servers which was declared end of life as of March 31, 2019. The Cardiology PACS in place is currently running unsupported as the existing service contract for SAVAHCS VA797H-17-D0024 36C25820F0013 System ID IV511020 expired r 31, 20 . At this time if an error or malfunction were to occur with the current Cardiology PACS, the system would not be serviceable. If the extent of damage/malfunction were severe, the Cardiologists would be unable to view from any reading station and would require manual dictation of reports directly into the patient record affecting the quality of medical service, time requirement of providers, and documentation accuracy.

Description of Supplies/Services Required to Meet the Agency’s Needs:

This requirement is for the Medicine Service Line of the Southern AZ VA Health Care System (SAVAHCS). This procurement for a replacement Cardiology PACS requires appropriately trained and certified technicians for a successful and smooth implementation to fulfill the technical requirements. Siemens Medical is the sole provider capable of performing the required Cardiology PACS requirements, services, and proprietary software updates or upgrades. Furthermore, they are the only authorized support vendor for Syngos Dynamics platforms which includes the Cardiology package that is embedded with the upcoming EHRM implementation Cerner Project.

( ) (7) Public Interest per 41 USC §3304(a)(7) as implemented by FAR 6.302-7;

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):

Siemens Medical is the original software manufacturer and the only authorized distributor of the Siemens Syngo Dynamics software not sold as an inherent component of Cerner powerchart.

Siemens is uniquely qualified to provide a Cardiology PACS option that is the most compatible with the upcoming EHRM project because it is a Cerner Preferred Partner for Cardiology PACS to EMR integration. Further, the Cerner Cardiology package that is included with the upcoming EHRM implementation was built from a Syngo platform and is the VA30 which not only falls in line with EHRM requirements but also VA Directives. Syngo platform VA40 is the technical equivalency of upcoming EHRM-Cerner Cardiology package and will ultimately decrease the learning curve for clinical staff and provide the leanest transition. Siemens Syngo Dynamics V40 software Graphic User Interface (GUI) is the same GUI as the Cerner Cardiology package (VA30) that is part of the VA Electronic Health Record Modernization (EHRM) roll-out. Additionally, the Syngo Dynamics image review and common reporting components are integrated with the Cerner Cardiovascular Imaging Management package. Finally, the Siemens Syngo Dynamics Platform has been approved through the Enterprise Risk Analysis (ERA) portal reference RA-504, required for specialized networked medical devices.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:

The four vendors appeared to be possibly qualified and interested to fulfill this requirement were AGFA, Philips, GE, and Siemens. However, due to the upcoming Electronic Health Record Modernization project, preference is given to systems with Cerner compatibility and incorporation.

Siemens Syngo Dynamics image review and common reporting components are integrated with Cerner Cardiovascular Imaging Management powered by Syngo Dynamics platform (CVIM). This

EHR system is part of the Cerner Cardiology package embedded in the VA's upcoming EHRM project and will therefore provide the best integration with future efforts.

Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable:

Pricing is determined fair and reasonable based on historical pricing consistent with the rates quoted by previous vendors. Additionally, the requesting Service believes that it would be the most efficient use of funds to procure the Siemens Syngo Dynamics V40 platform with virtual servers due to the ease in upgradability to the VA30 platform with the Cerner Implementation. This is evidenced in the cumulative cost savings of over , as the training and template costs would be a initial one-time cost and the licensing fees would be at cost at the time of Cerner implementation, given retention of an active support contract.

If awarded to another vendor, there will not only be the additional costs of retraining staff and licensing costs for Cerner implementation but also additional costs for template building, layouts, and interfaces that would need to be re-done from another vendor environment to convert to the necessary Cerner environment.

Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted:

vendors were reviewed by the requesting ervice AGFA, Philips, and Siemens. The review included demonstration, quotes, and product options. Additionally, an RFI was posted on Beta.sam on 05/15/2020 that closed 05/20/2020 to help determine what type of set aside to use. Four responses were received- two SDVOSB concerns and two large business concerns expressed interest in the Sources Sought notice 36C25820Q0195.

However, Siemens Medical is the only contractor capable of providing Syngo Dynamic original software items. Siemens is the only authorized support vendor for Syngo Dynamic software systems.

They are the only vendor certified to provide proprietary software updates and upgrades to this software system.

Any Other Facts Supporting the Use of Other than Full and Open Competition:

The procurement of the Siemens Syngo Dynamics V40 platform would be the easiest conversion to the Cerner VA30 platform and in the best interest of the government. If the award was made to another vendor, the facility staff would have to learn reporting workflow and administrative systems in another vendor environment then be trained to learn these functionalities in another environment once the Cerner platform is implemented. The Syngos Dynamic one-time report design course is a 4-day class which if would need to be duplicated if awarded to another vendor – taking away vital staff time from patient care.

There would also be additional time savings in effort required to recreate templates to meet the Cerner implementation requirements as well as time saved in data migration effort. Although there is still a need for two migrations, the second would be a smaller effort required if implementing V40 versus another market option.

Listing of Sources that Expressed, in Writing, an Interest in the Acquisition:

Along with the three vendors reviewed by the facility, the following business concerns expressed interest in the Sources Sought notice 36C25820Q0195 that closed 05/20/2020.
