RE: Federal Consistency Determination and Water Quality Certificate File No.: 1331-13-0006.1CDT130001 Hurricane and Storm Damage Reduction Project, Shore Protection Component Port Monmouth, Middletown Township, Monmouth County
Dear Mr. Houston:
The New Jersey Department of Environmental Protection, Division of Land Use Regulation, acting under Section 307 of the Federal Coastal Zone Management Act (P.L.
92-583) as amended, agrees with the certification that the above referenced project is consistent with the approved New Jersey Coastal Management Program and authorizes a Section 401 Water Quality Certificate.
The project consists of the restoration of the shoreline in the Port Monmouth, located in Middletown Township, Monmouth County. This letter of concurrence is issued for beach nourishment, the reconstruction of the existing dunes, dune plantings, the construction of two vehicular accessways, two pedestrian crossovers, the construction of a stone terminal groin, and a 10' X 195' fishing pier extension. The sand utilized for this shore protection project will be obtained from the Sea Bright borrow area previously approved by the Department. The Division has determined that the project is consistent with New Jersey's Rules on Coastal Zone Management N.J.A.C. 7:7E-l. l et seq., (as amended on November 5, 2012).
This work is shown on site plans in twenty-one (21) sheets entitled "HURRICANE AND
STORM DAMAGE REDUCTION PROJECT SHORE PROTECTION COMPONENT
MIDDLETOWN TOWSHIP PORT MONMOUTH, NEW JERSEY", dated April 27, 2013, unrevised, and prepared by the US Army Corps of Engineers New York District.
New Jersey is an Equal Opportunity Employer• Printed on Recycled Paper and Recyclable
DLUR File No. 1331-13-0006.1CDT130001 2
This consistency determination is issued subject to compliance with the following conditions.
l. All nourishment materials shall consist of clean sand fill (greater than 90 percent sand) of grain size comparable to the existing beach.
2. If a geodetic reference mark is found within the project area, the permittee must stop work and immediately contact the New Jersey Department of Transportation Geodetic Survey at (609) 530-5641.
3. All dune creation areas must be planted with "Cape" American beachgrass or a species listed in the Standards Applicable to Dune Creation and Maintenance (7:7E-3A.3) within the following planting Season.
4. Upon completion of construction, a sand fence must be erected along the entire perimeter of the dune. A sand fence must be erected along the limits of the beach access ramps to prevent access to the dunes.
5. Authorized work shall cease if the NJDEP Division of Fish and Wildlife - Endangered and Nongame Species Program (ENSP) determines that piping plover (Charadrius melodus), least tern (Sternula antillarumor), or black skimmer (Rynchops niger) territorial or nesting activity is taking place within or adjacent to the proposed project area. Work may not resume until a consultation with the United States Fish and Wildlife Service (USFWS) and ENSP is held and a plan is implemented for the management of those species. If these shorebirds are utilizing the project area, it is recommended that a beach management plan be developed with USFWS for long term protection of endangered shorebirds.
6. The pier shall remain open to the public for in perpetuity, and may not be used for the mooring of vessels.
7. Consistent with Assembly Bill, No. 2804, P.L. 2007, CHAPTER 113 the use of creosote treated material (or other descriptive term from the law) in the construction of the authorized structure( s) is prohibited.
8. All waterfront structures shall be constructed of nonpolluting materials such as plastic, natural cedar or other untreated wood, concrete, or other inert products.
Creosote and CCA-treated lumber (a.k.a. pressure treated or wolmanized lumber) which is susceptible to leaching are considered polluting materials and are not acceptable.
9. Photocell lights and/or reflectors must be placed and maintained along the pier to warn boaters traveling at night or in low light conditions of the pier location. These photocell lights must be installed and operational within 72 hours of completion of construction.
This Federal Consistency is authorized pursuant to all parties following the guidelines set forth, and agreed upon, for the construction of the proposed structures.
DLUR File No. 1331-13-0006.1CDT130001 3
Pursuant to 15 CFR 930.44, the Division reserves the right to object and request remedial action if this proposal is conducted in a manner, or is having an effect on, the coastal zone that is substantially different than originally proposed.
Thank you for your attention to and cooperation with New Jersey's Coastal Zone Management Program. If you have any questions regarding this determination, please do not hesitate to call Kara Turner of our staff at (609) 777-0454.

COMPOSITE GRAIN SIZE DISTRIBUTION CURVES FOR SAND SEDIMENTS AND
GRAIN SIZE SCALES FOR SEDIMENT
The grade scale most commonly used for sediments is the Wentworth (1922) scale which is a logarithmic scale in that each grade limit is twice as large as the next smaller grade limit. The scale starting at 1mm and changing by a fixed ratio of 2 was introduced by J.A. Udden (1898), who also named the sand grades we use today.
However, Udden drew the gravel/sand border at 1 mm and used different terms in the gravel and mud division. For more detailed work, sieves have been constructed at intervals 2 ^(1/2) and 2^(1/14). The Φ (phi) scale, devised by Krumbein, is a much more convenient way of presenting data than if the values are expressed in millimeters, and is used almost entirely in recent work.
