About this file

This document is a Project Labor Agreement (PLA) Survey for an environmental remediation project at the Raritan Bay Slag Superfund Site in New Jersey. The U.S. Army Corps of Engineers, Kansas City District is seeking input from the construction community on implementing a Project Labor Agreement for a large-scale construction project with an estimated value between $25 million and $100 million. The project involves environmental remediation activities including excavation and removal of slag, battery casings, contaminated soils, and sediments, along with installing and removing approximately 3,700 feet of sheet pile wall, dewatering, water treatment, and site restoration.

The survey includes a detailed questionnaire for potential contractors, requesting information on local PLA experience, skilled labor availability, project scheduling, potential impacts on project costs and small business participation, and perspectives on how a PLA might affect the project's economy and efficiency. Responses must be submitted via email to specified USACE contacts by 2:00 p.m. CDT on July 21, 2025, using a specific email subject line format. The survey is for planning purposes only and is not a solicitation or contract commitment, with all submitted information to be kept confidential.

Project Labor Agreement (PLA) Survey for

Environmental Remediation at the Raritan Bay Slag Superfund Site, Operable Unit 1 (OU1) – Seawall Sector, Old Bridge Township and Sayreville, Middlesex County, New Jersey.

The U.S Army Corps of Engineers (USACE), Kansas City District (NWK) is soliciting comments from the construction community addressing the potential use of Project Labor Agreements (PLA) for a large-scale construction project located at the Raritan Bay Slag Superfund Site, Operable Unit 1 (OU1) – Seawall Sector, Old Bridge Township and Sayreville, Middlesex County, New Jersey.

Disclosure of the magnitude of construction, as prescribed in FAR 36.204 and DFARS 236.204, is between $25,000,000 and $100,000,000.

Environmental Remediation activities will involve excavation and removal slag, battery casings and associated waste (including miscellaneous demolition debris in the form of concrete and various bricks), and excavation and removal of soils and sediment above the lead remediation cleanup level of 400-mg/kg. The work will also require the design, installation and removal of approximately 3,700-feet of sheet pile wall, dewatering to facilitate “in-dry” excavations, temporary water treatment system design, installation and start-up, backfill and grading, site restoration including coastal wetland restoration, and reconstruction of the seawall. The North American Industry Classification System (NAICS) Code for this requirement will be 562910 – Environmental Remediation Services. Major components of the work activities may include, but is not limited to the following:

• Preparation of Remedial Action Workplans in accordance with CERCLA and the CERCLA Record of Decision requirements. These include preparation of UFP-QAPPs for hazardous chemical sampling/waste management and Accident Prevention Plan/Site Safety and Health Plan (APP/SSHP) as required by EM 385-1-1.

• Community Relations support for public communication and public outreach related to the Superfund remediation activities.

• Excavation and removal of source materials (i.e., pieces of slag comingled with crushed battery casing materials and associated wastes that act as sources of contamination) and contaminated soil/sediment from the areas located in the Seawall Sector.

• Design, installation, and removal of an excavation dewatering system using sheet pile wall, collection trench, and/or well point dewatering systems to facilitate dry excavations

• Temporary water treatment

• Removal, decontamination, and reuse of riprap.

• Restoration of the site, including the construction of a new revetment, wetland areas, and restoration of active work areas.

A Project Labor Agreement is defined as a pre-hire collective bargaining agreement with one or more labor organization that establishes the terms and conditions of employment for a specific construction project and is an agreement described in 29 U.S.C. § 158(f). Federal Acquisition Regulation (FAR) policy states: Executive Order (E.O.) 14063, Use of Project Labor Agreements for Federal Construction Projects, requires agencies to use PLAs in large-scale construction projects (defined as a construction project with a total estimated cost at or above $35M) to promote economy and efficiency in the administration and completion of Federal construction projects.

When awarding a contract in connection with a large-scale construction project, agencies shall require use of a PLA for contractors and subcontractors engaged in construction on the project, unless an exception(s) at FAR 22.504(d) applies. Reference is made to: FAR Subpart 22.5 Use of Project Labor Agreements for Federal Construction Projects; FAR 52.222-33 Notice of Requirement for Project Labor Agreement; and FAR 52.222-34 Project Labor Agreement.

It is anticipated that manufacturing workforces and other non-construction workforces such as specialty non-construction related subcontractors (e.g. archeological firms, surveying firms, etc.) will be exempt from a PLA (if utilized).

In consideration of the above factors, the public is invited to provide responses on the use of a PLA for this construction project utilizing the attached PLA Questionnaire.

Submission Instructions: Responses shall be submitted on the attached PLA Questionnaire via email to christopher.d.lewis3@usace.army.mil and michael.s.dolly@usace.army.mil no later than 2:00 p.m.

CDT, July 21, 2025.
