Project Labor Agreement (PLA) Survey for
Remedial Action at the Roebling Steel Superfund Site, Village of Roebling, Florence Township, Burlington County, New Jersey.
The U.S Army Corps of Engineers (USACE), Kansas City District (NWK) is soliciting comments from the construction community addressing the potential use of Project Labor Agreements (PLA) for a large-scale construction project located at the Roebling Steel Superfund Site, Village of Roebling, Florence Township, Burlington County, New Jersey.
Disclosure of the magnitude of construction, as prescribed in FAR 36.204 and DFARS 236.204, is between $25,000,000 and $100,000,000.
Remedial action activities will consist of installation of a soil cap, building demolition, artifact restoration, building restoration, and construction of a new building. The North American Industry Classification System (NAICS) Code for this requirement will be 562910 – Environmental Remediation Services. Construction may include, but is not limited to the following:
• Preparation of work plans and preconstruction documents
• Obtain necessary permits and approvals from applicable federal, state, and local regulatory agencies
• Capping of contaminated soil
• Implementation of a long-term groundwater sampling and analysis program to monitor the contaminant concentrations in the groundwater at the site, to assess the migration and attenuation of these contaminants in the groundwater over time; and,
• Institutional controls in the form of a Classification Exception Area (CEA) to restrict the installation of wells and the use of contaminated groundwater in the vicinity of the site.
• Primary (gross) decontamination, demolition, and on-site management of selected demolition debris for contaminated buildings.
• Removal and off-site disposal of contaminated process dust, and liquid and solid wastes from the equipment, aboveground tanks, pits, and sumps. Removal and decontamination of equipment, tanks, and scrap metal prior to recycling.
• Abatement of friable asbestos in all buildings.
• Closure of contaminated underground storage tanks and drainage of underground piping systems.
• Historic preservation mitigation measures for the buildings, machinery, artifacts, and curation of archives.
• Implementation of institutional controls to ensure the effectiveness of the remedy, such as deed restrictions to limit future uses of the buildings that remain.
• Construction of a new building within the Roebling Museum property to display historically significant artifacts.
A Project Labor Agreement is defined as a pre-hire collective bargaining agreement with one or more labor organization that establishes the terms and conditions of employment for a specific construction project and is an agreement described in 29 U.S.C. § 158(f). Federal Acquisition Regulation (FAR) policy states: Executive Order (E.O.) 14063, Use of Project Labor Agreements for Federal Construction Projects, requires agencies to use PLAs in large-scale construction projects (defined as a construction project with a total estimated cost at or above $35M) to promote economy and efficiency in the administration and completion of Federal construction projects. When awarding a contract in connection with a large-scale construction project, agencies shall require use of a PLA for contractors and subcontractors engaged in construction on the project, unless an exception(s) at FAR 22.504(d) applies.
Reference is made to: FAR Subpart 22.5 Use of Project Labor Agreements for Federal Construction Projects; FAR 52.222-33 Notice of Requirement for Project Labor Agreement; and FAR 52.222-34 Project Labor Agreement.
It is anticipated that manufacturing workforces and other non-construction workforces such as specialty non-construction related subcontractors (e.g. archeological firms, surveying firms, etc.) will be exempt from a PLA (if utilized).
In consideration of the above factors, the public is invited to provide responses on the use of a PLA for this construction project utilizing the attached PLA Questionnaire.
Submission Instructions: Responses shall be submitted on the attached PLA Questionnaire via email to heather.a.scott@usace.army.mil and justin.k.bennett@usace.army.mil no later than 2:00 p.m. CST, January 20, 2025.
