About this file

This special notice document requests industry comments on the potential use of a Project Labor Agreement (PLA) for the construction of a consolidated Parachute Rigging Facility at Joint Base Lewis-McChord in Washington state. The project scope includes construction of a concrete foundation and metal structure building totaling between $25-100 million. The facility would include a parachute drying tower, packing lanes, repair rooms, storage areas, classrooms, and built-in systems for fire protection, energy management, security, and communications networks.

The document poses a series of questions for industry to consider regarding the use of a PLA on this project. Respondents are asked to provide any evidence of previous PLAs used locally on similar projects, documentation of skilled labor shortages in required crafts, or time sensitive scheduling needs. They are also asked to detail reasons why a PLA would or would not advance the Federal Government's interests in economy, efficiency and regulatory compliance. No proposals, bids or quotes are being requested at this time. Responses will be used to inform the Government's acquisition decisions.

WILL NOT BE A SOLICITATION, SPECIFICATIONS OR DRAWINGS AVAILABLE AT

THIS TIME.

This is a SPECIAL NOTICE. No proposals are being requested or accepted with this notice. The Corps of Engineers Seattle District is soliciting comments from the construction community addressing the potential use of PLA for large scale construction projects (exceeding $35 million) within Joint Base Lewis Mc-Chord (JBLM), Washington.

DESCRIPTION OF WORK:

The U.S. Army Corps of Engineers (USACE) Seattle District has a construction requirement for a consolidated Parachute Rigging Facility located at Joint Base Lewis- McCord (JBLM), Washington. The project includes parachute drying tower, packing lanes, parachute repair room, supply rooms, storage areas, oxygen systems maintenance room, and a classroom. Construction consists of concrete foundation and floor slab with metal frame structure. Built-in building systems will include fire alarm/mass notification, fire suppression, energy management control, telephone and advanced unclassified and classified communications networks, cable TV, intrusion detection, closed circuit surveillance, electronic access control systems, a hardened protected distribution system, built-in automated parachute storage and retrieval system, and cyber security measures. Department of Defense (DoD) principles for high performance and sustainable building requirements will be included in the design of the project in accordance with federal laws and Executive Orders. Low Impact Development features will be included in the design and construction of this project as appropriate. Supporting facilities include site preparation, utilities (electrical, water, gas, sanitary sewer, chilled water, and information systems distribution), lighting, vehicle parking, access drives, curb and gutter, sidewalks, storm drainage, landscaping, roads, and other site improvements. Cybersecurity measures will be applied to the facility-related control systems in accordance with current DoD criteria. Access for persons with disabilities will be provided. Comprehensive interior design and audio-visual services are included. Project will provide Anti- Terrorism/Force Protection (AT/FP) features and comply with AT/FP regulations and physical security mitigation in accordance with DoD Minimum Anti-Terrorism Standards for Buildings.

MAGNITUDE:

In accordance with DFARS 236.204, the magnitude of the estimated cost of construction (ECC) range for this project is between $25,000,000 and $100,000,000.

FACTORS TO BE CONSIDERED:

Some of the factors that may be considered regarding PLA use are:

1. The project will require multiple construction contractors and/or subcontractors employing workers in multiple crafts or trades.

2. There is a shortage of skilled labor in the region in which the construction project will be sited.

3. Completion of the project will require an extended period of time.

4. PLAs have been used on comparable projects undertaken by Federal, State, municipal, or private entities in the geographic area of the project.

5. A PLA will promote the agency’s long term program interests, such as facilitating the training of a skilled workforce to meet the agency’s future construction needs.

6. Any other factors that the agency decides are appropriate.

FEDERAL ACQUISITION REGUATIONS (FAR) 22.502 DEFINITIONS:

Project labor agreement means a pre-hire collective bargaining agreement with one or more labor organizations that establishes the terms and conditions of employment for a specific construction project and is an agreement described in 29 U. S.C. 158(f).

FAR 22.503 – POLICY:

a. PLA are a tool that agencies may use to promote economy and efficiency in Federal procurement. Pursuant to Executive Order 13502, agencies are encouraged to consider requiring the use of PLAs in connection with large-scale construction projects.

b. An agency may, if appropriate, require that every contractor and subcontractor engaged in construction on the project agree, for that project, to negotiate or become a party to a PLA with one or more labor organizations if the agency decides that the use of PLAs will:

1. Advance the Federal Governments interest in achieving economy and efficiency in

Federal procurement, producing labor-management stability, and ensuring compliance with laws and regulations governing safety and health, equal employment opportunity, labor and employment standards, and other matters;

2. Be consistent with law. (Refer also to FAR 52.222-33 Notice of Requirement for PLA and FAR 52.222-34 PLA).

INDUSTRY COMMENTS:

The construction community is invited to comment on the use of PLAs using the following questions:

1) Do you have knowledge that a PLA has been used in the local area on projects of this kind?

If so, please provide supporting documentation.

2) Are you aware of skilled labor shortages in the area for those crafts that will be needed to complete the referenced project? If so, please elaborate and provide supporting documentation where possible.

3) Are you aware of time sensitive issues/scheduling requirements that would affect the rate at which the referenced project should be completed? If so, please elaborate and provide supporting documentation where possible.

4) Identify specific reasons why or how you believe a PLA would advance the Federal

Governments interest in achieving economy and efficiency in federal procurement.

5) Identify specific reasons why you do not believe a PLA would advance the Federal

Governments interest in achieving economy and efficiency in federal procurement.

6) Identify any additional information you believe should be considered on the use of a PLA on the referenced project.

7) Identify any additional information you believe should be considered on the non-use of a PLA on the referenced project.

Please provide a list of recent (2-5 years) construction projects in the local labor market of the project under consideration. The information gathered in this exercise should include the following information:

a) Project Name and Location

b) Detailed Project Description

c) Initial Cost Estimate vs. Actual Final Cost

d) Was the project completed on time?

e) Number of craft trades present on the project

f) Was a PLA used?

g) Were there any challenges experienced during the project?

THIS IS NOT A SOLICITATION FOR PROPOSALS AND DOES NOT CONSTITUTE ANY

COMMITMENT BY THE GOVERNMENT. Responses to this PLA market survey will be used by the Government to make appropriate acquisition decisions. All interested sources must respond to future solicitations announcements separately from responses to this market survey.
