Justification and Approval for Other Than Full and Open Competition

This is a Justification and Approval (J&A) document for a sole-source procurement by the Department of Veterans Affairs, VISN 04, supporting the Philadelphia VA Medical Center located in Philadelphia, Pennsylvania. The acquisition seeks one (1) TIMS 2000 FEES-L medical video imaging and recording system as a replacement for an existing device that has reached the end of its operational life. The requirement includes a trade-in discount for the legacy equipment being replaced. The acquisition plan action ID is 36C244-26-AP-1496, and the estimated contract value is redacted in the document.

The procurement is justified under 41 USC §3304(a)(1) as a sole-source acquisition where only one responsible source exists. The TIMS 2000 FEES-L is a specialized FDA-cleared Class II medical device manufactured exclusively by Foresight Imaging, LLC d/b/a TIMS Medical, used specifically for Fiberoptic Endoscopic Evaluation of Swallowing (FEES) studies with proprietary DICOM integration and PACS compatibility capabilities that no competing product provides in equivalent combination. Market research was conducted and documented by the Contract Specialist, with searches performed across SAM, FPDS, SCMC, GSA Advantage, and the SBA Small Business Search. A Notice of Intent to Sole Source (PIID: 36C24426Q0265) was posted to the GPE on February 4, 2026, closing February 9, 2026; one response was received from SDVOSB Trillamed, though market research confirmed they are not authorized to distribute the required SKUs. The Contracting Officer determined the anticipated cost to be fair and reasonable based on government pricing discounts and the trade-in credit. The justification was signed by Tommy Moody (Facility) on February 12, 2026, and approved by Amanda Saunders (NCO 4 Contracting Officer) on the same date.

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):

This requirement is to procure the TIMS 2000 FEES-L medical imaging/video capture system for use in clinical imaging and documentation of Fiberoptic Endoscopic Evaluation of Swallowing (FEES) studies. The TIMS 2000 FEES-L Medical Imaging System is a highly specialized device providing proprietary video capture, processing, and DICOM integration for endoscopic swallowing evaluations.

This functionality is required for accurate clinical documentation, diagnostic interpretation, and integration with the facility’s Picture Archiving and Communication System (PACS) and electronic medical records system.

This system is designed, manufactured, and supported solely by Foresight Imaging, LLC d/b/a TIMS Medical. It has unique proprietary hardware and software interfaces not manufactured or licensed by any other vendor. No other known product on the market offers the exact combination of FEES-specific video capture workflow, DICOM-compliant imaging integration, and compatibility with the system presently in operation. Competing systems lack either full DICOM/PACS integration or FEES-specific workflow features and therefore cannot meet requirements without additional software or configuration changes.

This product is an FDA-cleared Class II medical imaging device, ensuring safety and clinical reliability.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as possible (including whether a notice was or will be publicized as required by RFO Part 5 and, if not, which exception under RFO Part 5 applies):

A Notice of Intent to Sole Source, PIID: 36C24426Q0265, was posted to the GPE on 4 February 2026, closing on 9 February 2026. This Notice offered vendors an opportunity to express interest and advocate their capability to satisfy the hospital’s need by emailing the Contract Specialist at the email provided. One response was received by SDVOSB Trillamed identifying themselves as authorized distributors of the required items. However, market research disclosed that Trillamed is not authorized to distribute the SKUs required. Contract Specialist responded to Trillamed inquiring whether they are capable of distributing the SKUs required, to which they did not respond by the time this justification was signed.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable:

Despite this being a sole source, the anticipated cost is determined to be fair and reasonable. The vendor has provided government pricing consistent with prior federal acquisitions of the same or similar equipment. As a government entity, the agency receives pricing that is discounted from standard commercial market rates.

Additionally, the anticipated price reflects a trade-in credit for the existing legacy device, further reducing the overall cost to the Government. Based on

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted:

An in-depth market research report conducted by the Contract Specialist, and signed by the Contracting Officer, can be found in the contract file. A summary of Contract Specialist’s research is as follows:

The Original Equipment Manufacturer, Small Business Foresight Imaging d/b/a TIMS Medical, is the sole distributor of the required items. A sole source letter on company letterhead was provided validating this claim; this letter is in the contract file. TIMS Medical has identified an authorized distributor in Service-Disabled Veteran Owned Small Business Trillamed; however, TIMS Medical indicated this distributer is not authorized to supply the items/SKUs required. This requirement is under the Simplified Acquisition Threshold and is using Simplified Acquisition Procedures. There is no applicable waiver for the selected NAICS code. SAM, FPDS, SCMC, GSA Advantage, and the SBA Small Business Search were searched. A Notice of Intent to Sole Source was posted to the GPE for 5 days. The Buy American Act is not applicable as this procurement is for Information Technology items.

9. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition:

SDVOSB Trillamed.

10.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required:
