1.0 GENERAL INFORMATION

1.1. GENERAL DESCRIPTION OF WORK

The U.S. Army Corps of Engineers (USACE), Seattle District (NWS) intends to procure services for design and construction services for a Consolidated Total Force Integration (TFI) Flight Base Operations Facility not to exceed 5,784 SM. This permanent facility will consolidate the functional elements of an active duty (AD) Operations Group, Operations Squadron (with its integral Base Operations Element), Aircraft Flight Equipment (AFE), and an Air National Guard (ANG) Air Refueling Squadron Operations Group, Operations Support Flight, Sensitive Compartmented Information Facility (SCIF), Joint Worldwide Intelligent Communications System (JWICS), weather equipment infrastructure, and a Flight Kitchen in support of an additional 12 Primary Aircraft Authorization (PAA) and the associated new squadron while maximizing Total Force Integration (TFI) efficiencies. The facility will include reinforced concrete foundation, concrete floor slab, structural steel frame, standing seam metal roof and exterior. Project will include fire suppression and alarm systems, all utilities and building systems, pavements, communications, site improvements, and associated support facilities to provide a complete and usable facility. Building systems include but are not limited to HVAC, plumbing, mechanical, fire protection, electrical, and communication systems. Support facilities include but are not limited to land clearing, paving, fencing, general site improvements, utility connections, site lighting, parking, access drives, curb and gutter, sidewalks, storm drainage, landscaping, access roads/paving, and signage.

Project shall provide new parking (3,948 SM), demolish building B1 (2,026 SM) and parking lot (3,138 SM), and provide integrated access to flight line as part of this facilities' site work. Anti- Terrorism/Force Protection (AT/FP) and physical measures for the design will include minimum standoff distances from roads, parking areas and vehicle unloading areas. Department of Defense principles for high performance energy and sustainable building measures are required in the design and construction of the project in accordance with federal laws and Executive Orders. The building will require third party certification of High Performance and Sustainable Building Guiding Principles Compliance (HPSBGPC) using either US Green Building Council (USGBC) or Green Building Initiative (GBI).

1.2. CONTRACT COST CEILING LIMITATION FOR DESIGN AND

CONSTRUCTION COSTS

The design and construction costs will be subject to the funds available for this project. The ceiling limitation to design and construct this project is at $36,300,000.00, in which the project may not be awarded over that amount. Offerors are notified that they are under no obligation to approach this ceiling. However, the Government may not be able to make an award if the dollar amount set for this project is exceeded.

1.3. GOVERNMENT SECURITY REQUIREMENTS

Solicitation responses will ONLY be received electronically. Please refer to Paragraph

1.10 for Submittal information.

Be advised regarding any Site Visit during Phase 2 Solicitation: Effective August 25, 2021, Federal employees, contractors, and visitors who enter a Federal facility or site must follow facility signage and requirements, and agency safety protocols, regarding vaccination and testing documentation. Contractors and visitors attempting to gain entry at GSA owned or leased facilities secured by Federal Protective Service (FPS) must complete the Certification of Vaccination form available at https://www.saferfederalworkforce.gov/downloads/CertificationVaccinationPRAv7.pdf and show the form upon entry. Contractors and visitors who are not fully vaccinated or who decline to disclose their vaccination status must also be prepared to show proof of a negative COVID-19 test from within the previous three days, in accordance with Safer Federal Workforce Task Force requirements and agency requirements, as applicable.

Technical inquiries and questions relating to proposal procedures or bonds are to be submitted via Bidder Inquiry in ProjNet at http://www.projnet.org/projnet

To submit and review bid inquiry items, bidders will need to be a current registered user or self-register into the system. To self-register go to web page, click BID tab select Bidder Inquiry, select agency USACE, enter Key for this solicitation listed below, and your e-mail address, click login. This Request for Proposal (RFP) does not commit the Government to pay, as a direct charge, any costs incurred in the preparation and submission of a proposal.

1.8. PRE-PROPOSAL CONFERENCE

The Government intends to hold a pre-proposal conference during Phase 2 (two) at the http://www.projnet.org/projnet project site.

1.9. ACCURACY IN PROPOSALS

Proposals must set forth full, accurate, and complete information as required by this RFP, (including attachments). The penalty for making false statements is prescribed in 18 U.S.C. 1001.

1.10. PROPOSAL SUBMITTALS

In strict compliance with guidance relating to the current situation with COVID-19 and social distancing, the ONLY authorized transmission method for proposals in response to this solicitation is electronically via SAFE online submission. NO OTHER

TRANSMISSION METHODS (E-MAIL, FACSIMILE, REGULAR MAIL, HAND

CARRIED, ETC.) WILL BE ACCEPTED.

1.10.1 Instructions for Submitting Electronic Proposals

In an effort to reduce paperwork and cost, all proposals shall be submitted electronically through the SAFE site. Submission shall be in Adobe PDF format. Submit no more than five (5) PDF files. Total file size cannot exceed 8GB. Files may be compressed and/or combined into ZIP files using compression utility software such as WinZip or PKZip to reduce file size and facilitate transmission.

1.10.2 Request for Upload Code

Please allow time for any possible system issues.

Include “W912DW22R0003 SAFE Proposal Drop-Off Request …” in the subject. Include the name and email address of the sender, and the name of the offeror in the body of the email.

The request code will allow a one-time file upload via the SAFE site. Offerors that fail to email for request a code five (5) working days before proposal submission date may not be able to receive a request code in time to upload their submission.

You will receive an email from NoReplyTo@mail.mil with the subject line similar to "[DoD SAFE] W912DW21RTEST Proposal Drop-off Invite". The body of the email will contain a hyperlink, with the drop-off key embedded, for your use in uploading your proposal. The body of the email may also contain additional instructions from the Contracting Specialist in a note beneath the hyperlink. The drop-off key will be valid for 10 calendar days.

1.10.3 Instructions for Upload of Proposal

Follow the hyperlink in the email. This will take you to the DoD SAFE drop off page. The page will be pre-populated with the Name and email you provided, the name and email of the recipient, and the note with additional instructions from the Contracting Specialist.

The Proposer must enter the e-mail address for both the Contracting Officer and Specialist.

The Proposer can enter an additional e-mail address if desired. After entering the e-mail address, click the ADD button to add the person(s) e-mail to the “Recipients List” of your response. When your proposal is submitted, a notification will be sent to the recipients you added.

NOTE: Do NOT send the SAFE site packages to group e-mail accounts.

Accept the default checkbox settings. Add the files that contain your offer. Files for upload will be listed beneath the “Click to Add Files or Drag Them Here” button. Enter a description for each file. Ensure your proposal is complete and all files are listed; this is a one-time drop-off key. Click on “Drop-off Files” when all files are listed.

When the upload is complete, DoD SAFE will present a screen listing the files uploaded and transmit an email to the recipient(s) to inform them that your proposal has been uploaded.

1.10.4 Receipt of Submissions

The Government will consider proposal submission timely if it is completely uploaded into the SAFE website and the acknowledgement email sent by the date and time proposals are due. It is the Offeror’s responsibility to allow sufficient time for upload. It can take several minutes or even hours in some cases.

The government will not be responsible for submissions delivered to any location or to anyone other than those designated to receive proposals. Offerors are responsible for ensuring that proposals are submitted so as to reach the designated recipient. Offerors are responsible for allowing sufficient time for the proposal to be received in accordance with the instructions provided. It is the responsibility of the firm to confirm the Government’s mailto:Susan.F.Newby@usace.army.mil receipt of the proposal prior to the due date.

I.11. PROPOSAL FORMAT

File format. Proposals shall be submitted in PDF format, suitable for reading using Adobe Acrobat in a Windows 10 operating system. PDF files may be combined and compressed using compression utility software such as WinZip or PKZip.

File Organization. Volumes I and II shall be submitted in different files. Each Volume shall be organized as specified below. PDFs shall be indexed and bookmarked to facilitate navigation.

File Names shall clearly state the RFP Number, Volume Number and Offeror Name. If applicable, file names may include the Tab, Example Project Number, and similar relevant information.

Formatting. Pagination shall be in 8 ½” x 11” format, using at least ½” margins and 10 point or larger font size.

The prime or joint venture’s name, address, a signature of the official that can bind the firm and a telephone number shall appear in the lower left corner of the title page of any document/volume to be evaluated.

Volume number, section and date submitted shall appear in the bottom right corner of each page (along with the revision number for the amended page, if necessary).

1.12. JOINT VENTURE PROPOSAL REQUIREMENTS

When proposing as a joint venture, all members of the joint venture shall sign the SF 1442 and the bid bond (in Phase 2) unless a written agreement by the joint venture is furnished with the proposal designating one firm with the authority to bind the other member(s) of the joint venture. In addition, a copy of the joint venture agreement shall be submitted with the proposal. Failure to comply with the foregoing requirements may eliminate the proposal from further consideration. If this is an 8(a) or HubZone joint venture, the offeror shall ensure that it complies with the applicable requirements of 13 CFR Part 124 and 13 CFR Part 126, respectively.

52.228-1 BID GUARANTEE (SEP 1996)

(a) Failure to furnish a bid guarantee in the proper form and amount, by the time set for opening of bids, may be cause for rejection of the bid.

(b) The bidder shall furnish a bid guarantee in the form of a firm commitment, e.g., bid bond supported by good and sufficient surety or sureties acceptable to the Government, postal money order, certified check, cashier's check, irrevocable letter of credit, or, under Treasury Department regulations, certain bonds or notes of the United States.

The Contracting Officer will return bid guarantees, other than bid bonds, (1) to unsuccessful bidders as soon as practicable after the opening of bids, and (2) to the successful bidder upon execution of contractual documents and bonds (including any necessary coinsurance or reinsurance agreements), as required by the bid as accepted.-

(c) The amount of the bid guarantee shall be 20% percent of the bid price or $3,000,000.00, whichever is less.-

(d) If the successful bidder, upon acceptance of its bid by the Government within the period specified for acceptance, fails to execute all contractual documents or furnish executed bond(s) within 10 days after receipt of the forms by the bidder, the Contracting Officer may terminate the contract for default.-

(e) In the event the contract is terminated for default, the bidder is liable for any cost of acquiring the work that exceeds the amount of its bid, and the bid guarantee is available to offset the difference.

52.228-11 INDIVIDUAL SURETY—PLEDGE OF ASSETS (FEB 2021) (DEVIATION 2020-O0016)

(a) Offerors shall obtain from each person acting as an individual surety on a bid guarantee, a performance bond, or a payment bond –

(1) Pledge of assets; and

(2) Standard Form 28, Affidavit of Individual Surety, except that the words “being duly sworn, depose and say” on the Standard Form 28 are replaced with the word “affirm” and the Standard Form 28 is not required to be sworn and notarized in block 12.

(b) Pledges of assets from each person acting as an individual surety shall be in the form of—

(2) A recorded lien on real estate. The offeror will be required to provide—

(i) A mortgagee title insurance policy, in an insurance amount equal to the amount of the lien, or other evidence of title that is consistent with the requirements of Section 2 of the United States Department of Justice Title Standards at https://www.justice.gov/enrd/page/file/922431/download. This title evidence must show fee simple title vested in the surety along with any concurrent owners; whether any real estate taxes are due and payable; and any recorded encumbrances against the property, including the lien filed in favor of the Government as required by FAR 28.203- 3(d);

(ii) Evidence of the amount due under any encumbrance shown in the evidence of title;

(iii) A copy of the current real estate tax assessment of the property or a current appraisal dated no earlier than 6 months prior to the date of the bond, prepared by a professional appraiser who certifies that the appraisal has been conducted in accordance with the generally accepted appraisal standards as reflected in the Uniform Standards of Professional Appraisal Practice, as promulgated by the Appraisal Foundation.

1.0 OVERVIEW

1.1. This solicitation is for the design and construction of a facility and associated features located at Fairchild AFB, Spokane, WA The facility must meet Department of Defense (DOD) criteria, Executive Orders and other applicable laws, regulations, and industry standards. In Phase 1 of the 2-phase design-build selection procedure, interested firms or joint venture entities (referred to as "Offerors") submit certain specified performance capability proposals, demonstrating their capability to successfully execute the design-build construction contract resulting from this solicitation. The Government will evaluate the performance capability proposals in accordance with the criteria described herein and will short-list up to five (5) (unless the Contracting Officer determines that a larger competitive range is in the best interest of the government) of the Phase 1 Offerors to compete for the design-build contract in Phase 2.

1.2. Phase 2 shall be issued via Amendment. In Phase 2, the successful Offerors will submit proposals including pricing information in accordance with specified instructions. Unless the Contracting Officer decides discussion are necessary, it is the intent of the Government to make an award based on initial offers, so initial proposals should contain the Offeror's best terms.

1.3. ORDER OF PRECEDENCE - Design/Build Contract

• The contract includes the standard contract clauses and schedules current at the time of contract award. It entails (1) the solicitation in its entirety, including all drawings, cuts, and illustrations and any amendments, and (2) the successful offeror's accepted proposal. The contract constitutes and defines the entire agreement between the Contractor and the Government. No documentation shall be omitted which in any way bears upon the terms of that agreement.

• b. In the event of conflict or inconsistency between any of the provisions of this contract, including the Request for Proposal, Contractor's proposal, or contract deliverable, precedence shall be given in the following order:

1. Betterments: Any portions of the accepted proposal, or any subsequent design or other submittal, which both conform to and exceed the provisions of the Request for Proposal.

"Betterment" is defined as any product, component, or system, which exceeds the minimum requirements stated in the Request for Proposal.

2. The provisions of the solicitation, including drawings and attachments.

3. All other provisions of the accepted proposal including RFP Standard Form SF 1442 and

Schedule.

4. Any design products including, but not limited to, plans, specifications, engineering studies and analyses, shop drawings, equipment installation drawings, etc. These are "deliverables" under the contract and must conform to or exceed all provisions of the contract, in order of precedence herein.

2.0 GENERAL INSTRUCTIONS

Firms formally organized as design-build entities, design firms and construction contractors that have associated specifically for this project, consortia of firms or any other interested parties may submit proposals. Associations may be as joint ventures or comprised of key team subcontractors. To qualify for Phase 2, the Offeror must have professional architects and engineers, registered in the appropriate technical disciplines, and the requirements specified in Contract Clause 52.236-25, "Requirements for Registration of Designers", must be met. All designs must be under the direct supervision of appropriately licensed professionals for each discipline involved.

Submit the Phase 1 proposal electronically. PHASE 1 DOES NOT INVOLVE PRICING SUBMISSION.

5.0 TAB B- FACTOR 1 - SPECIALIZED EXPERIENCE

5.1 SUBMISSION REQUIREMENTS

The prime contractor and the design firm(s) (or prime contractor if design is to be self-performed) must each demonstrate recent, relevant experience on similar projects, using Construction – Specialized Experience form (Attachment 2), and Designer – Specialized Experience Form (Attachment 3) at the end of the section. Offerors may rely on contracts performed for state, local, or corporate and private entities if the cited projects are similar in scope, magnitude, and complexity as those described in 5.1.1.2. Offerors may submit relevant projects in which the participating firms were a part of a joint venture. Offerors submitting as a joint venture may submit relevant past joint venture projects as well as relevant projects from each of the joint venture firms. Offerors may submit projects from key subcontractors reflecting relevant design or construction experience performed by that key subcontractor. However, each included firm (i.e.

subcontracor, sister-company etc.) must submit a signed Letter of Commitment. Each firm shall provide information that demonstrates the experience relevant to its role on this project. Submit projects that are 100% constructed and turned over no longer than six (6) years preceding the date that proposals are due.

Offeror will note the date of completion in proposal materials. If any firm has multiple functions or divisions, limit the project examples to those performed by the division or unit submitting the offer. Design firms may list prime contractors they have worked with for government, private or commercial customers. The offeror shall select the design firm(s) and indicate its selected Designer of Record in the proposal. If projects were design-build, identify them as such. With exception of the discussion of teaming experience and LEED/Third Party sustainability experience specified in paragraph 5.1.2, the offeror shall submit no more than six projects to demonstrate capability.

5.1.1. Submit project matrix, corresponding to the submitted projects with up to six (6) project matrix examples, to demonstrate relevant construction and design experience. "Relevant" is defined as projects similar to the project in this solicitation in scope, magnitude, and complexity and have a logical connection to the requirements of this RFP.

5.1.2. The Government will consider extent of recent experience, degree of relationship of such experience to this project and demonstrated familiarity with applicable codes and local conditions. Some examples of relevancy (see definition of relevancy in paragraph 5.1.1.) to this project include, but are not limited to the Number, size, type of work, complexity, location, and the firm's role and extent of work self-performed (breaking out all work and simply "pouring the sidewalks" on a cited project are examples of less relevant experience).

5.1.3. Three (3) types of experience areas that are considered relevant include: 1) Construction of

5.1.1.1. For Construction Experience: In addition to the requirements in 5.1.1., above, the offeror must submit only those projects for which the offeror or Key Subcontractor was the Prime Contractor or Key Subcontractor performing the construction portion of the contract. Offerors should explain how the information provided is relevant to the proposed acquisition, and the projects selected should clearly demonstrate the construction capabilities of the offeror. In addition, the offeror must clearly identify to which, if any, of the three (3) especially relevant experience area(s) each project example pertains (e.g., Project A may qualify and be listed for construction of similarly-sized facility by contract value and military construction, while Project B may qualify and be listed only for construction of similarly sized facility by contract value, etc.).

5.1.1.2. For Design Experience: In addition to the requirements in 5.1.1., above, the offeror must submit only those projects for which the Designer was the Designer of Record. Offerors must explain how the information provided is relevant to the proposed acquisition, and the projects selected should clearly demonstrate the design capabilities of the offeror. In addition, the offeror must clearly identify to which, if any, of the three (3) especially relevant experience area(s) each project example pertains (e.g., Project A may qualify and be listed for Design of similarly-sized facility by contract value and Military Construction (MILCON), while Project B may qualify and be listed only for Design of similarly sized facility by contract value, etc.).

5.1.1.3. Teaming, LEED, & Design-Build Experience: The offeror must describe any previous teaming experience within the proposed organization, if not described in the project list. Describe team members' experience on LEED projects and/or projects with Third Party Sustainable certification, if not included on the project list. Offeror may describe design-build experience on other type projects. The above information is limited to projects that are 100% constructed and turned over within the past six (6) years preceding the date proposals are due.

5.1.1.4. Definitions for Factor 1

1. Scope means containing many of the elements of work and of physical size of a vertical construction two-story building with corporate, administrative, or headquarters functions, consisting of a minimum of 40,000 square feet.

1. Complexity means new construction with varied elements of work or sequencing of the work required for a two-story corporate facility/administrative/headquarters facility and any construction of a Sensitive Compartmented Information Facility (SCIF).

2. Similar means not necessarily identical but showing a resemblance in qualities or characteristics of the proposed project, such as, for example, a two-story corporate facility/administrative/headquarters facility and any construction of a SCIF.

3. Recent means completion within six (6) years preceding the proposal due date stated in the Solicitation.

4. Magnitude means a total project contract value close to $30,000,000.00.

5. Prime Contractor is defined as the firm that signs on the Standard Form (SF) 1442.

5.2 EVALUATION CRITERIA

5.2.1. The Government will evaluate the extent that proposals demonstrate recent and relevant experience of the prime contractor and designer of record in design, construction, or design-build in accordance with their role on this project. If the design will be accomplished in- house, rather than by subcontract, then the design element of specialized experience will still be evaluated. Experience on the similar projects identified in the project lists will receive more consideration than experience provided in the supplemental narrative. Military Construction (MILCON) project experience will be rated more favorably than project experience not within military installations.

5.2.2. The Government reserves the right to verify the experience record of cited projects or other recent projects by reviewing the Corps of Engineers Construction Contractor (or Architect-Engineer) Appraisal Support System (CCASS/ACASS), including CPARS, reviewing other DOD or Government appraisal systems, or interviewing owners or references. The Government may check any or all cited references to verify supplied information.

5.2.3. To receive credit for extent (amount) of experience, the Offeror and its proposed design firm(s) shall demonstrate a history of recent, relevant experience. A firm will not receive additional credit for Specialized Experience for the relevant experience of key personnel proposed for this project.

5.2.4. The Government may give additional consideration to previous design-build experience, even if the experience is on different type projects. Similarly, the Government may give additional consideration to recent teaming experience among the team members, even if on different type design and/or construction projects than this project. Most consideration will be given to most relevant experience.

5.2.5. Additional consideration may be given if either the constructor or the design firm(s) demonstrate experience in sustainable design.

6.0 TAB C- FACTOR 2 - PAST PERFORMANCE

6.1 SUBMISSION REQUIREMENTS

6.1.1. In accordance with FAR 42.1503, past performance will be evaluated using the Past Performance Information Retrieval System (PPIRS) for the prime contractor and its Designer of Record firm. If any firm has multiple functions or divisions, limit the DUNS number to the division or unit submitting the offer and divisions providing substantial support to the design-build team. The Government reserves the right to verify the past performance record of other team members besides the prime contractor, and DOR and may evaluate their PPIRS - If no relevant past performance history is available for your DUNS number, you may choose to utilize the attached Customer Satisfaction Survey/ Past Performance Questionnaire (PPQ) (Attachment 4) which will be used for evaluation.
