About this file

This document is a Justification and Approval (J&A) for the use of other than full and open competition to award a firm fixed-price contract for the maintenance, service, and repair of Phantom High Speed Digital Imaging Systems manufactured by Vision Research, Inc.

The Naval Surface Warfare Center Indian Head Division has a requirement for these services, as the Phantom cameras are proprietary to Vision Research and they are the only authorized service provider. Market research was conducted, but no other companies were found capable of servicing these specialized cameras. The estimated value of the contract is $2 million over the one-year base period and four 12-month option periods. The contract will be awarded on a sole-source basis to Vision Research, Inc. under the statutory authority of 10 U.S.C. 3204(a)(1), as the only responsible source. The Contracting Officer has determined the anticipated costs will be fair and reasonable.

4. Statutory Authority Permitting Other Than Full and Open

Competition

10 U.S.C. 3204(a)(1), as implemented by FAR 6.302-1 – Only

One Responsible Source and No Other Supplies or Services will Satisfy Agency Requirements.

5. Rationale Justifying Use of Cited Statutory Authority

Vision Research, Inc. is the only manufacturer and seller of Phantom High-speed cameras. Their camera platform is made up of hardware components that other camera manufacturers cannot repair or replace. Phantom High-speed cameras are proprietary to Vision research, Inc. and they are the only authorized service facility for these cameras. Under 6.302-1(c) the services are peculiar to one manufacturer due to the proprietary nature. The services for the Phantom Camera is essential to the Government’s requirements, thereby precluding consideration of other service companies, to continue the vital research in process with the Government owned Phantom cameras.

6. Description of Efforts Made To Solicit Offers from as Many Offerors as Practicable

Market research was conducted where Fastec Imaging, iX Cameras, Y.M. Camera, ALPCAM, Tech Imaging, Edgertronic, AOS Technologies, Nacinc, MCT Cameras, and Kron technologies were contacted directly to see if any of these companies offered Phantom High-Speed Camera service.

ALPCAM, Tech Imaging, Edgertronic, AOS Technologies, Nacinc, MCT Cameras and Kron technologies failed to reply to the inquiry. A representative from each of Fastec Imaging, iX Cameras, and Y.M. Camera all confirmed that their companies were not authorized service facilities for Phantom Cameras. Furthermore, they were not able to service Phantom High-speed cameras due to the proprietary technology used in the cameras.

To further broaden market research and to satisfy the requirements of DFARS PGI 206.302-1(d), a Sources Sought notice was posted on beta.SAM.gov on June 30, 2023, in which zero (0) capability statements were received in response to the posting.

As required by FAR 5.203, a pre-solicitation notice was publicized on beta.SAM.gov on July 19, 2023, in which zero (0) capability statements were received as a result of the post.

No additional efforts were made to increase competition after market research was performed, following which it was determined that no other company can offer the required equipment or services. Vision Research is the OEM and remains the sole manufacturer, distributor, and provider of the required equipment and services.

7. Determination of Fair and Reasonable Costs

The Contracting Officer has determined that the anticipated cost to the Government for the services covered by the J&A will be fair and reasonable.

8. Actions To Remove Barriers to Competition

For the reasons set forth in Paragraph 5, NSWC IHD Contracts Department has no plans at this time to compete future contracts for the types of services covered by this document. If another potential source emerges, NSWC IHD Contracts Department will assess whether competition for future requirements is feasible.
