About this file
This document is a justification for a sole source bridge contract award. The Department of Veterans Affairs Veterans Health Administration Veterans Integrated Service Network 23 requires a short-term Medical Officer of the Day Physician Service contract on a sole source basis with Eskridge Enterprises, LLC to provide services from September 25, 2023 through March 25, 2024 for 3,880 hours at an anticipated cost of $ while a new long-term contract is solicited and awarded. The justification cites unusual and compelling urgency as the authority for the sole source award since Eskridge Enterprises, LLC is currently providing credentialed and background-checked employees, and any interruption in services would suspend veteran care while a new contractor becomes credentialed, which could take months.

DEPARTMENT OF VETERANS AFFAIRS
Justification and Approval (J&A) For
Other Than Full and Open Competition (>SAT)
Acquisition Plan Action ID: 36C263-23-AP-4816, 656-23-4-066-0275
1. Contracting Activity:
The Department of Veterans Affairs, VISN 23, St Cloud MN VA Medical Center, 4801 Veterans Drive, St Cloud MN 56303, requires a short-term Medical Officer of the Day Physician Service contract to support facility operations as a result of the outcome of a GAO protest. The contract is being issued by the NCO23, Health Care Team 1, 2501 W 22nd Street, Sioux Falls SD 57105. The supporting ACQ Plan is 36C263-23-AP-4816 and accompanying PR IFCAP is 656-23-4-066-0275. This action will serve as a short-term contract until a new long-term contract has been awarded as part of the resolution of a GAO protest to contract 36C26323C0067.
2. Nature and/or Description of the Action Being Processed:
This is a temporary bridge contract for six (6) months to retain Medical Officer of the Day Physician Services until a new contract is solicited and awarded. Contract 36C26323C0067 for Medical Officer of the Day Physician Services is being terminated due to the merits of a GAO protest. An interim, urgent and compelling bridge contract is required to retain Medical Officer of the Day Physician Services to support patient services.
Required Services: Medical Officer of the Day Physician Service Proposed Contract Number: 36C26323C0092 Period of Performance: 9/25/2023-3/25/2024
3. Description of Supplies/Services Required to Meet the Agency’s Needs:
Medical Officer of the Day Physician Services to support the St Cloud MN VA Hospital.
The estimated number of hours is 3,880 with an anticipated cost of $ for the period 9/25/2023-3/25/2024.
4. Statutory Authority Permitting Other than Full and Open Competition: 41 USC §3304(a)(1), as implemented by FAR 6.302-1.
( X ) (2) Unusual and Compelling Urgency per 41 USC §3304(a)(2) as implemented by FAR 6.302-
2;
5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):
The current contract holder ESKRIDGE ENTERPRISES, LLC is currently providing credentialed, backgrounded, and acceptable employees to bridge the requirement until a new long-term contract is solicited and awarded. An interuption or break in services would suspend services for Veterans and any new contractor would require re-credentialing/backgrounding actions that could take months to complete. The St Cloud VA Hospital does not have the resources or manpower to provide Medical Officer of the Day Physician Services. Accordingly ESKRIDGE ENTERPRISES, LLC is the only firm capable of providing the services described in Section III above without the Veteran’s Health Administration experiencing unacceptable delays in fulfilling its requirements.
