Performance Work Statement (PWS)
Remark Previously Established Blazes and Signs
Cumberland Gap National Historical Park
1. Background. The Cumberland Gap National Historical Park (the Park) is located in Kentucky, Tennessee, and Virginia, and contains approximately 25,000 acres within its authorized boundary. The Park’s mission is to ensure that its natural and cultural resources are preserved and protected for the use and enjoyment of present and future generations. Marking the boundary of park-owned lands is a significant step in the protection of the Cumberland Gap National Historical Park, allowing park staff to distinguish park property from adjoining private property and clarifying jurisdictional issues.
2. Required Services. The contractor shall provide all labor, tools, equipment, and supervision required to mark up to twelve sections of boundary within the park. The segments will be listed as one Base and Eleven Options in the contract. Options will be awarded based on available funding. The general location of these segments is provided on Exhibit 2. They are numbered in the order of priority, with Option 1 set as the highest priority. The Base and Options are divided into 12 equal segments of 6.28 miles, or 33,158.4 feet, of boundary.
3. Contractor Responsibilities: The following conditions shall apply to the work being done:
• The contractor will make a diligent effort to locate all physical evidence which could affect the location of the boundary line. The intent of this project is to remark the previously established blazes and signs. Survey work will not be required.
• No trees shall be felled. No vegetation is to be removed.
• The contractor will be sensitive to the adjacent property owners’ property and rights and will not infringe upon that property or those rights. Except where the adjacent property is an open public right of way, the Contractor will approach the boundary segment from the park property.
• The Government will furnish maps and records to adequately establish boundary location.
• Much of the park boundary is accessible by foot only. The contractor will have access to the following public roads, administrative park roads, and trails to access boundary segments.
o Segment 2: Tiprell Road (vehicle), Bannerfield Road (ATV/ UTV only), Tri-State Peak, Cumberland Trails (Foot travel only).
o Segment 3: Yellow Creek Road (ATV/ UTV Only), Watson Branch Road
(ATV/ UTV only).
o Segment 4: Watson Branch Road, Top of the World Road, Bennett’s Gap
Trail, Parker’s Gap Trail (ATV/ UTV only).
o Segment 5: Possible access on private side (Tommy Lewis, caretaker)
(ATV, UTV only).
o Segment 6: Davis Branch Range Road (ATV/UTV only).
o Segment 7: Pine Branch Trail (Foot travel only), Shillalah Creek Road
(4x4 vehicle, ATV, UTV).
o Segment 8: Shillalah Creek Road (4x4 vehicle, ATV, UTV), Brush
Mountain Road (ATV/ UTV only).
o Segment 9: Shillalah Creek Road (4x4 vehicle, ATV, UTV), Brush Mountain Road
(ATV/ UTV only), Ewing Trail (ATV/ UTV only).
o Segment 10: Chadwell Gap Trail (Foot travel only), Dry Branch Road (4x4 vehicle).
o Segment 11: Access to boundary via Golf Course Road (Jody North, landowner).
o Segment 12: Colson Lane (4x4 vehicle, ATV, UTV), Gibson Gap Trail
(ATV/ UTV only), US Highway 58, US Highway 25E, Tiprell Road.
• The contractor will paint blazes on trees along the boundary line.
• Trees on the line and within 24 inches of the line will be painted at approximately
20-foot intervals.
• The contractor will use yellow Nelson Boundary Mark Brush Type Paint. Blazes will be painted approximately six feet above ground level. Blazes will consist of two, 4-inch-tall horizontal stripes, separated by approximately 3 inches, approximately 1/4th the distance around the tree, facing the adjoining landowner.
Blazes adjacent to concrete monuments will consist of three, 4-inch-tall horizontal stripes, separated by approximately 3 inches, approximately 1/4th the distance around the tree, facing the adjoining landowner.
• The contractor will install NPS boundary signs.
• NPS boundary signs will be nailed on trees approximately every 100 feet along the boundary line, facing the adjoining landowner.
• Completion shall be within 180 days of the signing of the contract.
4. Government Furnished Property, Materials & Supplies.
• The government shall furnish all NPS boundary signs (3”x12”). See Exhibit 1 below. The contractor shall supply all nails for boundary signs.
5. Management. The contractor shall manage the total work effort in accordance with effective and efficient management principles and safe working practices to ensure on- time completion of this contract.
6. Safety & Environmental Compliance.
• The contractor shall comply with pertinent provisions of the Occupational Safety and
Health Act (OSHA), and state, local, safety, laws.
• The contractor shall comply with pertinent Environmental Protection Agency laws and regulations.
• The park safety officer has the authority to issue restraint or cease-and-desist orders to the contractor when violations or unsafe acts are present and threaten Government and contractor employees or damage to Government property.
• The contractor shall immediately report to the Contracting Officer, COTR and park safety officer all accidents resulting in employee injury or death or damage to property while performing this contract.
7. Insurance. The Contractor shall be insured in accordance with State of Kentucky insurance regulations. The Government is not responsible for damage to Contractor’s equipment, vehicles, tools or materials or their employees and the personal property brought on-site. The Government will not accept any liability due to contractor employee negligence.
• Workers Compensation: The contractor shall furnish proof of workers compensation insurance to the Contracting Officer for those employees performing work related to this contract and shall comply with the Workman’s Compensation Laws of the State of Kentucky.
• Liability: The Contractor shall maintain a level of insurance that will protect the contractor and the Government from any claims as a result of bodily injury (including death) and property damage which may arise from and during the performance of this contract, and shall submit proof of insurance to the Contracting Officer.
8. Performance Requirements Summary (PRS). The contractor performance requirements are summarized into required services that relates directly to successful contract completion. The performance standard identifies the minimum acceptable levels of service allowed. For all of the services covered by this contract, the performance standard is 100% compliance. The monitoring method shall be through random inspection.
9. Motor Vehicle & Traffic Regulations. Contractor employees operating motor vehicles shall possess a valid driver's license. Driver and vehicle permits, licenses, registrations and proof of insurance shall always be maintained in the vehicle and made available upon request. Contractor employees shall always comply with federal vehicle motor law requiring seat belts be worn.
Contractor employees shall adhere to the posted speed limits. Contractor employees are expected to comply with all park regulations.
10. Food Storage Guidelines. All Contractor employees shall comply with park food storage guidelines. All food items must be stored in a hard-sided vehicle or in a food storage locker and must never be left unattended. "Food" includes any item with a scent, regardless of packaging.
This may include items that you do not consider food, such as canned goods, bottles, drinks, soaps, cosmetics, toiletries, trash, ice chests (even when empty), and unwashed items used for preparing or eating meals.
11. Replacement of Contractor Employee for Security Reasons. The Government retains the right to request removal of the contractor’s employee(s), regardless of prior clearances.
12. Non-Payment for Additional Work. Any additional contractor performed services not specified in contract, either at its own volition or at the request of an individual other than an appointed Contracting Officer, except as may be explicitly authorized in the contract, shall be performed at the financial risk of the contractor. Only an appointed Contracting Officer is authorized to bind the Government to a change in specifications, contract terms, or conditions.
13. Conflict of Interest. The contractor shall not employ off-duty COTR’s or other Government employees if such employment would create a conflict of interest or be contrary to the policies contained in conflict-of-interest directives.
14. Quality Control. The contractor shall establish and maintain a Quality Control Plan (QCP) to ensure the work performed conforms to the contract requirements. The Performance Requirements Summary establishes performance standards that are the minimum requirements for acceptable performance of required services. The contractor’s QCP shall address methods for remedying poor performance. The Contractor shall develop QCP and submit with proposal package. The Contractor’s QCP includes:
• Required services identified in Performance Requirements Summary,
• Contractor’s surveillance methodology,
• Method and timeframe for responding to COTR or customer complaints, and
• Progress meetings with Government stakeholders.
15. Quality Assurance. The COTR will monitor the contractor’s performance under this contract using the quality assurance procedures specified in the Government’s Quality Assurance Surveillance Plan (QASP). The QASP may be modified after contract award upon review and acceptance of the contractor’s QCP to ensure both plans are mutually supportive. The purpose of the QASP is to ensure that the required services are performed in accordance with the contract requirements. The plan ensures reliable and continued operation by precluding unnecessary complaints and unacceptable performance. Government’s QASP includes:
• Acceptance of the contractor’s quality control plan
• Random inspection of the contractor’s work
• Communicating customer complaints
• Progress meetings with the contractor
The implementation of this QASP does not relieve the contractor of its responsibility to implement and abide by the QCP incorporated into this contract, and to provide acceptable performance of all required services listed herein.
16. Inspection. The Government will conduct inspection upon completion of required services. Final payment will be processed upon confirming that all noted contractor performance deficiencies have been satisfactorily corrected.
