About this file

This is a Faithful Performance Bond document for the County of Orange, California, used in conjunction with an Animal Disposal Services contract. The bond serves as a guarantee that the Principal (contractor) will faithfully perform all covenants, conditions, and agreements outlined in the underlying service contract. The bond is executed jointly and severally by the Principal and a Surety company authorized to conduct business in California, binding both parties to the County. The document requires completion of specific fields including the bond number, contract date, contractor name and address, surety company name and address, and the penal sum amount. The bond obligates the contractor to perform work according to contract specifications and indemnify and defend the County against any claims or damages arising from non-performance.

The bond premium is calculated at a specified rate per thousand of the contract price and must be paid by the contractor. The Surety waives notice of any changes, extensions, alterations, or additions to the contract terms and agrees that such modifications will not affect its bond obligations. The document requires notarization of the Surety representative's signature and approval by both the County's CEO/Risk Management office and the Office of the County Counsel. Execution must comply with California Corporations Code section 313, requiring either dual signature authority from specified corporate officers or a single officer's signature accompanied by a corporate resolution evidencing binding authority. The bond includes provisions for the County to recover all costs, reasonable expenses, and attorney fees incurred in enforcing the bond obligation, which shall be taxed as costs in any judgment rendered.
