About this file
This is a Performance Bond template document issued by the County of Orange, California, for use in conjunction with contracted services. The bond serves as a financial guarantee that the contractor will faithfully perform all obligations outlined in the underlying contract. The document requires the contractor (Principal) and a surety company to be jointly and severally liable to the County in a specified penal sum, ensuring compliance with all covenants, conditions, and agreements within the contract terms. The bond must include notarized signatures from the surety representative, with the surety company name typed or stamped above the signature line. The document does not establish specific contract terms, pricing, quantities, or performance timelines; instead, it functions as a standard form to be completed once a contract is awarded. The Performance Bond is a mandatory requirement for the Voter Information Guide Inkjetting and Mailing Services contract (IFB #031-3039603-CM) with a closing date of April 7, 2026, and contract commencement on July 1, 2026.
The Performance Bond imposes the bond premium cost on the contractor at a specified rate per thousand dollars of the contract price, with all associated costs and reasonable expenses incurred by the County in enforcing the bond obligation to be taxed as costs and included in any resulting judgment. The surety waives notice of any changes, extensions of time, alterations, or additions to the underlying contract terms, specifications, or work scope. The County must approve the surety and bond limits through its CEO/Risk Management office, and the County Counsel's office must approve the bond as to form. No specific bond amount is stated in the template; however, the related Voter Information Guide contract requires comprehensive insurance coverage and bonding as mandatory prerequisites for contract award, with specific bond amounts to be determined based on the contract value and County requirements.
