About this file

This is a Performance Bond template document issued by the County of Orange, California, for use in securing faithful performance of county contracts. The bond serves as a financial guarantee that contractors will complete work in accordance with contract terms and specifications. The document establishes a binding obligation between the principal (contractor), surety company, and the County of Orange, with the surety jointly and severally liable for the penal sum specified in the bond. The bond remains in effect for the duration of contract performance and covers all covenants, conditions, and agreements outlined in the underlying contract. Any modifications, extensions, or alterations to the contract terms do not affect the surety's obligations, and the surety waives notice of such changes.

The bond premium is calculated as a percentage of the total contract price, with the specific rate and premium amount to be inserted by the parties. The County reserves the right to recover all costs, expenses, and reasonable fees incurred in enforcing the bond obligation, which are taxable as costs and includable in any judgment rendered against the surety. Signature authority for contractor entities must comply with California Corporations Code Section 313, requiring either dual signatures from specified officers or a single officer signature accompanied by written corporate resolution. The surety representative's signature must be notarized with the certificate of notarization attached to the bond document. The bond is subject to approval by the County's CEO/Risk Management and the Office of the County Counsel.
